WHEREAS, the property located at 353/363 Northeast 61 Street, Miami, Florida ("Property") currently has a Temporary Event Permit ("TEP") SEO-21-04-0039-TEP; and WHEREAS, pursuant to Section 62-521(b) of the Code of the City of Miami, Florida, as amended ("City Code"), the number and time limitations for temporary events may be waived upon affirmative vote of the City Commission; and WHEREAS, SocialXchange ("Applicant") is a premier event agency that creates events including entertainment experiences, social networking, arts, health, community services, entrepreneur workshops, and cultural events; and WHEREAS, the Applicant has also created a business that supports urban/multicultural programming in Little Haiti as part of its goal to attract residents and visitors to one of the City of Miami's most diverse and creative neighborhoods; and WHEREAS, this event has brought the community together through a variety of food trucks, places for board games, and other social activities along with a disc jockey; and WHEREAS, the current issued TEP expired on June 11, 2021 and the Applicant is seeking an additional thirty (30) days for the TEP; and WHEREAS, notwithstanding the issuance of this waiver pursuant to Section 62-521(b) of the City Code, all noise must comply with the requirements of Chapter 36 of the City Code; and WHEREAS, three (3) or more violations issued at the Property related to noise or any other violation of the City Code will result in an automatic rescission of this approval and this waiver shall be deemed void; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Pursuant to Section 62-521(b) of the City Code, the time limitations are waived and TEP Number SEO-21-04-0039-TEP is extended until July 11, 2021 for the Property. Section 3. The Applicant is still required to obtain permits and pay all fees for each applicable temporary event. Section 4. All noise must comply with the requirements of Chapter 36 of the City Code. Section 5. Three (3) or more violations of the City Code will result in an automatic rescission of this waiver. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
