A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO NEGOTIATE WITH SAINT JAMES COMMUNITY DEVELOPMENT
CORPORATION OF MIAMI, INC., OR AN AFFILIATE ENTITY MEETING THE CITY
MANAGER'S APPROVAL AT TIME OF CONVEYANCE ("ST. JAMES"), AND MIAMI-
DADE COUNTY ("COUNTY") FOR THE INCLUSION OF THE ALLAPATTAH BRANCH
PUBLIC LIBRARY ("LIBRARY") WITHIN THE AFFORDABLE AND WORKFORCE
HOUSING DEVELOPMENT TO BE CONSTRUCTED BY ST. JAMES ("PROJECT") ON
THE CITY OF MIAMI OWNED PROPERTY LOCATED AT 1785 NORTHWEST 35TH
STREET TO BE CONVEYED TO ST. JAMES PURSUANT TO SECTION 29-B(A) OF
THE CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AS
AUTHORIZED BY RESOLUTION NO. R-20-0295; FURTHER DIRECTING THE CITY
MANAGER TO NEGOTIATE WITH ST. JAMES AND THE COUNTY TO ENSURE THE
CONTINUOUS OPERATION AND PUBLIC AVAILABILITY OF THE LIBRARY AT THE
PROPERTY, OR OTHER ACCEPTABLE LOCATION ON A TEMPORARY BASIS,
UNTIL SUCH TIME THE NEW LIBRARY IS INCORPORATED WITHIN THE PROJECT
AND OPEN AND AVAILABLE TO THE PUBLIC.
WHEREAS, the City of Miami ("City") is the fee simple owner of the property located at
1785 Northwest 35th Street, Miami, Florida ("Property"); and
WHEREAS, the City and Miami -Dade County ("County") entered into a lease agreement
dated November 1, 1971, which allowed the transfer of the City's Library Systems to the
County, and the same was renewed on May 15, 2007 for the County to continue to lease,
operate, and maintain the eight (8) library facilities and extend the term ("Lease"); and
WHEREAS, the Lease provides for the Allapattah Branch Public Library ("Library") to be
located on the Property; and
WHEREAS, pursuant to Resolution No. R-20-0295, the City Commission authorized the
City Manager to terminate a portion of the Lease pertaining to the Library to carve out the
Property pursuant to Section 13 of the Lease and to provide formal notice of partial lease
termination to the County; and
WHEREAS, pursuant to Resolution No. R-20-0295, the City Commission also authorized
the City Manager to negotiate and execute a quitclaim deed and other necessary documents, all
in forms acceptable to the City Attorney, for the conveyance of the Property to Saint James
Community Development Corporation of Miami, Inc., or an affiliate entity meeting the City
Manager's approval at the time of conveyance ("St. James"), for the redevelopment of the
Property into workforce and affordable housing, subject to various conditions described in
Resolution No. R-20-0295 ("Project"); and
WHEREAS, the City is in the process of partially terminating the Lease with the County
as to the Property and negotiating the conveyance of the Property to St. James by quitclaim
deed pursuant to Resolution No. R-20-0295; and
WHEREAS, the City Commission wishes to direct the City Manager to negotiate with St.
James and the County for the inclusion of a new public library no less than five thousand
(5,000) square feet in size and located within the ground floor of the Project; and
WHEREAS, the design and development of the new public library should take into
consideration the input provided by the community and various stakeholders; and
WHEREAS, the City Commission also wishes to ensure the Library will continue to
operate at all times during the design and development of the Project and hereby directs the
City Manager to negotiate with St. James and the County to ensure the continuous operation
and public availability of the Library at the Property, or at another publicly accessible nearby
location on a temporary basis, until completion and public availability of the new public library
within the Project; and
WHEREAS, public libraries provide necessary resources to the most vulnerable
populations within the community, including, but not limited to, high -risk students, seniors,
homeless individuals, and immigrants; and
WHEREAS, the incorporation of a public library within the Project will provide internet
access and literary materials to those in most need and will support the education and growth of
the community; and
WHEREAS, pursuant to Section 2-33(f) of the Code of the City of Miami, Florida, as
amended, the City Commission, by a majority vote, hereby deems this Resolution to be of an
emergency nature;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated herein as if fully set forth in this Section.
Section 2. The City Manager is hereby directed to negotiate with St. James and the
County for the inclusion of the Library within the ground floor of the Project.
Section 3. The City Manager is further directed to negotiate with St. James and the
County for the continuous operation of the Library at the Property or other acceptable location
on a temporary basis until such time the new library is incorporated within the Project and open
and available to the public.
Section 4. The City Manager is authorized' to negotiate and execute any and all
necessary documents, all in forms acceptable to the City Attorney, as deemed necessary to
accomplish the above -stated directive.
Section 5. This Resolution shall become effective immediately upon its adoption.
