Subject: Statewide Mutual Aid Agreement - State of Florida Division of Emergency
Management
Purpose of Item:
A Resolution of the Miami City Commission authorizing the City Manager to enter into a
Statewide Mutual Aid Agreement with the State of Florida Division of Emergency
Management ("Division") that provides for reciprocal emergency aid and assistance in
case of emergencies too extensive to be dealt with by any one local government alone,
and ensures the timely reimbursement of costs incurred by the local governments which
render such assistance.
Background of Item:
The State of Florida is vulnerable to a wide range of disasters that are likely to cause
the disruption of essential services and the destruction of the infrastructure needed to
deliver those services. Such disasters are likely to exceed the capability of any one local
government to cope with the emergency with existing resources. Such disasters may
also give rise to unusual technical needs that the local government may be unable to
meet with existing resources, but that other local governments may be able to offer.
Pursuant to Chapter 252 of the Emergency Management Act, the Division has the
authority to coordinate assistance and resources between local governments during
emergencies where needed.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A STATEWIDE MUTUAL AID
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE STATE OF
FLORIDA DIVISION OF EMERGENCY MANAGEMENT THAT PROVIDES FOR
RECIPROCAL AID AND ASSISTANCE TO LOCAL GOVERNMENTS IN THE EVENT
OF AN EMERGENCY TOO EXTENSIVE TO BE DEALT WITH UNASSISTED AND
ALSO ENSURES THE TIMELY REIMBURSEMENT OF ASSOCIATED COSTS
INCURRED BY THOSE LOCAL GOVERNMENTS THAT RENDER SUCH
ASSISTANCE; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE ANY AND ALL OTHER NECESSARY DOCUMENTS, ALL IN FORMS
ACCEPTABLE TO THE CITY ATTORNEY, IN FURTHERANCE OF THE TERMS AND
CONDITIONS OF THE AGREEMENT.
WHEREAS, the State of Florida ("Florida") is vulnerable to a wide range of disasters that
are likely to cause the disruption of essential services and the destruction of the infrastructure
needed to deliver those services; and
WHEREAS, such disasters are likely to exceed the capability of any one local
government to cope with the emergency utilizing existing resources; and
WHEREAS, such disasters may also give rise to unusual technical needs that the local
government may be unable to meet utilizing existing resources but that other local governments
may be able to offer; and
WHEREAS, Chapter 252, Florida Statutes, titled "Emergency Management Act",
authorizes the governing body of each political subdivision of Florida to develop and enter into
mutual aid agreements for reciprocal emergency aid and assistance in case of emergencies too
extensive to be dealt with unassisted and ensure the timely reimbursement of associated costs
incurred by local governments that render such assistance; and
WHEREAS, pursuant to Chapter 252, Florida Statutes, the Florida Division of
Emergency Management ("FDEM") has the authority to coordinate assistance between local
governments during emergencies and to concentrate available resources where needed; and
WHEREAS, the FDEM has developed a Statewide Mutual Aid Agreement ("Agreement")
to provide the process for requesting, providing, and receiving interjurisdictional mutual
assistance between participating local governments within the Florida; and
WHEREAS, it is in the best interest of the City to enter into the Agreement in order to
maximize the prompt, full, and effective use of resources of all participating local governments in
the event of an emergency or disaster;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorized' to execute the Agreement, in
substantially the attached form, between the City and the FDEM for the provision of reciprocal
aid and assistance to local governments in the event of an emergency too extensive to be dealt
with unassisted and for the timely reimbursement of associated costs incurred by local
governments that render such assistance.
Section 3. The City Manager is further authorized' to negotiate and execute any and all
other necessary documents, all in forms acceptable to the City Attorney, in furtherance of the
terms and conditions of the Agreement.
Section 4. This Resolution shall become effective immediately upon its adoption.
