SPONSOR(S): Mayor Francis X. Suarez WHEREAS, pursuant to Ordinance No. 13184 adopted on June 24, 2010, the City Commission established the Advisory Committee on Elevate Miami ("Committee") to assist the Mayor, City Commission, and the City Manager in establishing a comprehensive and wide- ranging initiative known as Elevate Miami which includes digital literacy, ACCESS Miami, The Education Compact, and Community outreach to better prepare the residents of the City of Miami ("City") to participate and compete in the new digital society and digital economy by assisting them in becoming more comfortable with and adaptable to new technologies; and WHEREAS, the Committee has been inactive for an extended of time; and WHEREAS, on February 11, 2021, the City Commission adopted Ordinance No. 13965 creating the Miami Technology Council ("Council"); and WHEREAS, the City Commission has appointed members to the Council which is an active body in the City; and WHEREAS, many of the responsibilities of the Committee are now handled by the Council; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 2 of the Code of the City of Miami, Florida ("City Code"), is further amended in the following particulars:1 "CHAPTER 2 ADMINISTRATION 1 Words and/or figures stricken through shall be deleted. ADVISORY COMMITTEE ON ELEVATE MIAMI RESERVED. Sec. 2 1121. Created; number of members; function. The city "Advisory Committee on Elevate Miami" is created, consisting of nine persons. The basic function of the committee is to assist the mayor, city commission and the city manager in estab.l+shing a comprehensive and wide ranging initiative known as Elevate Miami which includes four components: {1) Digital literacy; {2) ACCESS Miami; {3) The Education Compact; and {'I) Community outreach. This initiative is meant to better prepare the citizens of the city to participate and compete in the new digital society and digital economy by assisting them in becoming more comfortable with and adaptable to new technologies. Sec. 2 1122. Composition; terms. {a) The composition of the advisory committee on Elevate Miami shall be as follows: city commission. {2) One at large member nominated by any city commissioner subject to appointment by the city commission. {3) The mayor shall nominate three members subject to appointment by the city commission. office, whichever occurs first. {5) The city's chief information officer shall not be a member of the committee but shall be informed of and invited to attend each committee meeting. {6) All members shall be qualified and distinguished by their education, experience and attainments in thc information technology profo'sion, cducation profc'sion, businc's management, or similar background. (b) All committee members shall continue to serve until their successors are duly appointed. Sec. 2 1123. Organization; quorum. {a) The committee shall be convened for its first organizational mccting by thc city manager as soon as is practical after designation of its members by the city commission. At that meeting, the committee shall: {1) Elect a chairperson for a one year term from the date of such election. {2) Establish operating procedures to govern the committee's operations and deliberations. {3) Establish an annual work program and schedule of actions to be accomplished. {/1) Conduct such other busine-c as is deemed necessary to carry out thc committee's duties and obligations. Subsequent annual organizational meetings shall be convened by the chairperson, for the above purposes, prior to thc expiration of his or her term as chairperson. (b) The chairperson shall: City of Miami Page 2 of 4 File ID: 8950 (Revision:) Printed on: 5/20/2025 File ID: 8950 Enactment Number: 14004 {1) Call and conduct all meetings. {2) Be responsible to ensure that notes of all meetings are maintained. {3) Be responsible that the notes of all meetings are forwarded to the mayor, the city commission and Oho city manager in a timely fashion {c) Quorum. Five members constitute a quorum to convene a meeting of the committee. An affirmativc votc of thc majority of the members present and voting at a meeting at which a gion im is present is regi sired for any action to bo taken by the members Sec. 2 112/1. Liaison and support services. It shall be the duty of the city manager to provide liaison with the committee and support service from thc administration. Sec. 2 1125. Duties. The duties of the committee shall include but not be limited to: {1) Promote the comprehensive and wide ranging initiative known as Elevate Miami. {2) Assist in obtaining funding and sponsorships from the private and public sector for Elevate Miami. Any funding obtained for thc purpose of Elevate Miami shall be deposited into a special account and such funds shall be used solely for Elevate Miami. {3) Supervise the development and mission of the Elevate Miami initiative. {'I) Make recommendations to the city commission regarding funding from the general fund for Elevate Miami. {5) Make an annual report to the city commission concerning the status of Elevate Miami. The format of the report shall include: a. An ovcrvicw of the committee's accomplishments during the year. b. Planned activities and goals for the following year, if any. c. A financial report concerning the budget of Elevate Miami, which shall include planation of any expenditures that vary by more than ten percent from the budget. d. Certification by the committee that the reported actual expenditures are true and correct and that, to thc bcst of thc mcF1419c s4-nowledge all grant one„ and local rules, regulations, ordinances, and statutes. c. An invcntory list of all donatcd itcms, by month, that includes the name of each donor and a brief description of the item donated. {6) Make and adopt any other rules and regulations necessary to carry out thc dutics described in this section. Secs. 2-11261 - 2-1139. Reserved." Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately after final reading and signature of the Mayor.2 2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
