HomeMy WebLinkAboutSubmittal-Commissioner Diaz de la Portilla-DRAFT Resolution* IMP! 9PAII1 ia0 R . ae Q Submitted into the public record for item(s) NA.1, City of Miami on 05-13-2021, City Clerk City Hall 3500 Pan American Drive Legislation Miami, FL 33133 www.miamigov.com Resolution: File Number: Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION RESCINDING RESOLUTION NO. 20-0297, ADOPTED SEPTEMBER 24, 2020, WHICH EXTENDED THE CITY OF MIAMI'S MOTORIZED SCOOTER PILOT PROGRAM ("PILOT PROGRAM") UNTIL THE EXECUTION AND ROLLOUT OF THE PERMANENT MOTORIZED SCOOTER PROGRAM OR UNTIL THE END OF THE PILOT PROGRAM PERIOD ESTABLISHED BY SECTION 2-33(C)(9) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"); DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL STEPS NECESSARY TO END THE MOTORIZED SCOOTER PILOT PROGRAM, INCLUDING BUT NOT LIMITED TO, BRINGING AN ORDINANCE RESCINDING THE MOTORIZED SCOOTER PILOT PROGRAM AND REJECTING ALL PENDING APPLICATIONS, RENEWALS, OR EXTENSIONS OF PERMITS. SPONSOR(S): Commissioner Alex Diaz de la Portilla WHEREAS, pursuant to Ordinance No. 13795 adopted on October 11, 2018, the City Commission established a Motorized Scooter Pilot Program ("Pilot Program") within City of Miami ("City") Commission District 2 for a period of six (6) months from October 1, 2018 to April 1, 2019; and WHEREAS, due to permitting, information technology, technical, and other issues, the rollout for the Pilot Program commenced April 1, 2019 with an expiration six (6) months thereafter on October 1, 2019; and WHEREAS, pursuant to Ordinance No.13862 adopted on September 26, 2019 and Resolution No. R-19-0520 adopted December 12, 2019, the Pilot Program was extended to February 14, 2020; and WHEREAS, on February 13, 2020, the City Commission adopted Resolution No. R-20- 0040 extending the Pilot Program to April 15, 2020 in order to provide the City's Administration the time necessary for a thorough and competitive sealed solicitation process for the establishment of a permanent Motorized Scooter Program ("Permanent Program"); and WHEREAS, pursuant to Section 8-19 of the City Code, any further extension of this Pilot Program may be approved by Resolution subject to the provisions of Section 2-33(c)(9) of the City Code; and WHEREAS, on September 24, 2020, pursuant to Resolution No. 20-0297, the City Commission extended the program until the execution and rollout of a Permanent Program; and WHEREAS, many accidents have been reported to the City and many unsafe conditions have been posed by the scooters in the City rights -of -way; and City of Miami Page 1 of 2 File ID: (Revision:) Printed On: 9071 Submittal -Commissioner Diaz de la Portilla-DRAFT Resolution File ID: Submitted into the public record for item(s) NA.1, on 05-13-2021, City Clerk WHEREAS, the scooters now pose a safety risk to the public and the Pilot Program is no longer serving the general health, safety, no general welfare, the City Commission desires to end the program; Enactment Number: NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Resolution No. 20-0297, adopted September 24, 2020, is rescinded, which extended the City's Pilot Program until the execution and rollout of the Permanent Program or until the end of the Pilot Program period established by Section 2-33(c)(9) of the City Code. Section 3. The City Commission directing the City Manager to take any and all steps necessary to end the Pilot Program, including but not limited to, bringing an ordinance rescinding the Pilot Program and rejecting all pending applications, renewals, or extensions of permits. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor: 1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
