VESSELS; URGING BROAD REVIEW AND DISSEMINATION OF ANY cn L o
SUCH PROPOSALS WITH WATERWAY CONSTITUENT GROUPS;
AND OPPOSING THE CREATION OF A "VESSEL EXCLUSION ZONE"
WITHOUT ADDITIONAL CONSIDERATION FOR OTHER
IMPORTANT SAFETY AND MANAGEMENT ISSUES WITHIN THE
MARINE STADIUM BASIN; AND PROVIDING AN EFFECTIVE DATE.
(
WHEREAS, at the October 11, 2019 Board of Commissioners meeting of the Florida
Inland Navigation District (FIND), it was brought to the attention of the Board that various efforts
are underway to initiate a vessel exclusion zone in the Miami Marine Stadium Basin (Basin),
WHEREAS, the proposed vessel exclusion zone implemented by revisions to Ordinance 50, Section 42
of the Code of the City of Miami would limit the area of the exclusion zone to paddle and oar powered vessels
only, and
WHEREAS, there appears to be existing and ongoing conflicts in the Basin among existing user groups
that could lead to additional safety concerns, and
WHEREAS, FIND supports the enjoyment of the Basin by all various user groups, including power, sail,
paddle and other recreational activities, and
WHEREAS, FIND supports reasonable regulations which promote safety and increased law
enforcement, and
WHEREAS, in 2018 the total annual economic impact of the Intracoastal Waterway in Miami -Dade
County was calculated to exceed $8.5 billion; and
WHEREAS, this significant economic impact is dependent upon safe and reasonable access to, and
anchorage in, the waters of Miami -Dade County, and
WHEREAS, managed anchorage areas can provide safe, environmentally beneficial and predictable
harbor for vessels under navigation, and
WHEREAS, Miami Dade County has several existing managed anchorage areas such as Crandon Park
Marina and Coconut Grove, and
WHEREAS, FIND has awarded over $6.6 Million in grant funding for public access
projects within the Miami River Stadium Basin over the past 10 years, and

WHEREAS, FIND has demonstrated a commitment and shared vision for the
reconstruction of the Miami Marine Stadium and support for potential events (including boat races,
concerts, boat shows, etc.) to be held there, and
WHEREAS, the input and involvement of all potential stakeholders will allow for the
accommodation and consideration of all various user groups of the Basin, and
WHEREAS, the Miami -Dade FIND Commissioner has in the past requested, and hereby
reiterates and directly requests that the City of Miami keep the FIND Board informed and involved
in the development of any management plan or restrictions of use regarding the Miami Marine
Stadium Basin.
WHEREAS, the efforts to increase safety and decrease user conflicts in the Basin will not
hinder or obstruct FIND in its primary mission to provide safe navigation and public access to
the District's waterways in Miami -Dade Cunty.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF THE FLORIDA INLAND
NAVIGATION DISTRICT:
Section 1: The Board of Commissioners strongly supports increased law enforcement patrols in the
Basin to address any immediate safety concerns, and encourages the City to enforce any validly enacted
slow speed or no wake zones which may exist within the Basin.
Section 2_ The Board of Commissioners hereby supports reasonable regulations related to
safety in the Marine Stadium Basin.
Section 3 : That any management structure pertaining to the Basin address derelict vessels
within the Basin, by providing dedicated space for a protected and managed anchorage. The
Board believes that user fees from any managed anchorage should be reserved for and allocated
to cover the costs of additional infrastructure, signage, and law enforcement within the Basin.
Section 4: That any plans, ordinances, zones, or other management structure to be
implemented within the Basin follow the establishment procedures as outline in Chapter 327.46
F.S. and include all relevant stakeholders with interests in the Basin (including, but not limited
to Miami Marine Council, Marine Industries Association of South Florida, Biscayne Bay Yacht
Club, Key Biscayne Yacht Club, Miami Outboard Club, Miami Yacht Club, Coral Reef Yacht
Club, Coconut Grove Sailing Club, MAST, NMMA, Marine Stadium advocates, Miami Rowing
Club).
Section 5: That any plans, ordinances, zones, or other management structure to be
implemented within the Basin guarantee public access for stadium events and other area public
access projects (including, but not limited to the marine stadium baywalk, boat ramp, marine
stadium, managed anchorage, etc.).
Section 6 : That any plans, ordinances, zones, or other management structure be supported by
the Miami Marine Stadium Operator in order to ensure that the viability of the Marine Stadium
is not detrimentally impacted. (continued next page)

Section 8: That this Resolution be transmitted to the Florida Fish and Wildlife Commission. c

Section 7: That the substantive recommendations of this Resolution be incorporated into any °
grant agreements between the City of Miami and the Florida Inland Navigation District for -0 o 0
Waterway Assistance Projects in the vicinity of the Basin.
Section 9 : This Resolution shall be distributed and take effect immediately upon adoption.
