A. REQUEST
Pursuant to Chapter 55, Section 55-15(c), of the Code of the City of Miami, Florida, (the "Applicant"), per their
Versailles West Paseo -Tentative Plat #1940-A (the T-Plat) requests to close, vacate, abandon and discontinue
from public use: 1) a portion of SW 36 Court (Right -of -Way) located between SW 7 Street and SW 8 Street ,2) a
10-foot utility easement that is located within the midblock of SW 7 Street and SW 8 Street and west of SW 36
Court , and 3) a platted, private alley that located within the midblock of SW 7 Street and SW 8 Street and is
east of SW 36 Court, that is within City of Miami, Florida. The total square footage and acreage of these
vacated and closed areas, based on the T-Plat, is approximately 17,433 square feet or 0.400 acre.
B. RECOMMENDATION
Based on staff analysis, conditions of approval, and the Plat and Street Committee findings, as detailed in this
report, the Planning Department recommends the "Approval" of the requests to close, vacate, abandon, and
discontinue from public the following:
1. A portion of SW 36 Court (Right -of -Way)
2. A 10-foot utility easement (the Easement)
3. A 10-foot platted public alley (the Alley)

C. BACKGROUND
This request has three parts: 1) to close, vacate, abandon, and discontinue from public use, an existing portion
of SW 36 Court (the "Right-of-Way11) that is approximately 13,766 square feet located between SW 7 Street and
SW 8 Street, 2) to close a 10-foot utility easement ("Easement") that is located within the midblock of SW 7
Street and SW 8 Street and west of SW 36 Court, and 3) to close a private, 10-foot platted public alley (Alley)
closure that is located within the midblock of SW 7 Street and SW 8 Street and is east of SW 36 Court.

The closure, vacation, abandonment, and discontinued use public use an existing portion of SW 36
Court that is considered a key element in unifying the property. This portion of SW 36 Court lies
between Block 1 of "Green Trail Sub."; according to the plat thereof as recorded in Plat Book 109,
Page 97, and Block 2 of "Loquat Farm", according to the plat thereof as recorded in Plat Book 16,
Page 26, both of the Public Records of Miami -Dade County, Florida. said portion bounded north by
the southerly right- of- way line of SW 7th Street, and bounded south by the northerly right-of-way of
SW 8th Street, Public Records of Miami Dade County, Florida
The closure, vacation, abandonment, and discontinued use public use a 10-foot utility easement
that is considered a key element in unifying the property, this 10-foot utility easement consist of a
portion of Lot 2, Block 1 "Green Trail Sub." according to the plat thereof as recorded in Plat Book
109, Page 97, of the Public Records of Miami -Dade County, Florida.
The closure, vacation, abandonment, and discontinued use public use a 10-foot platted public Alley
that is considered as a key element in unifying the property. This 10-foot platted public Alley lies
within Block 2, "Loquat Farm," according to the Plat thereof, as recorded in Plat 16 at Page 26, of
the Public Records of Miami -Dade County, Florida.
D. ANALYSIS
At the March 14, 2019, Plat and Street Committee (PSC) meeting, the PSC approved the Tentative Plat
(5-0) to close, vacate, abandon and discontinue from public use: a portion of SW 36 Court (Right -of -Way)
located between SW 7 Street and SW 8 Street, a 10-foot utility easement that is located within the midblock
of SW 7 Street and SW 8 Street and west of SW 36 Court , and a platted, private alley that located within
the midblock of SW 7 Street and SW 8 Street and is east of SW 36 Court.
Per Section 55-15(c) of the City Code of Ordinances, the PSC considerations are with respect to the four
items below in making their recommendations to the Planning, Zoning, and Appeals Board (PZAB).
The results of the PSC's review of the public interest findings concerning the proposed vacation closures for
the "Right of Way", "Easement", and "Alley" are summarized below for this T-Plat:

1. Is it in the public interest, or would the general public benefit from the vacation of th
easement?
Plat and Street Committee response:
"Utility easements and alley are currently not being used by the public. City Commissio
already been obtained for the closure of this alley under Versailles West tentative plat ap
(superseded by this tentative plat application). SW 36 Ct- a 27-foot wide, three-dimensiona
ingress/egress is provided within the area of SW 36 Ct that is proposed to be closed and vaca
vehicular circulation and access by the general public is minimum. Preliminary Site Plan shows sidewalk is
being provided to accommodate pedestrian circulation. Circulation pattern within the closed/vacated right of
way area will be improved by designating drop-off location for tourist buses."
2. Is the general public no longer using the rights of way or easement, including public service vehicles
such as trash and garbage trucks, police, fire or other emergency vehicles?
Plat and Street Committee Response:
"Suitable emergency and public service vehicle access is still being provided along SW 36 Ct that is
proposed to be closed and vacated."
3. Would there be no adverse effect on the ability to provide police, fire or emergency services?
Plat and Street Committee response:
"There is no adverse effect to the police, fire or emergency services."
4. Would the vacation and closure of the rights of way or easements have a beneficial effect on pedestrian
and vehicular circulation in the area?
Plat and Street Committee response:
"Vehicular circulation will be improved by designating drop-off location for tourist buses."

CONCLUSION
The closure, vacation, abandonment, and discontinued use of a portion of SW 36 Court (Right -of -Way), a 10-
foot platted utility easement, and a 10-foot platted, private easement is important for the revitalization and
enhancement of the localized area and will result in a net positive impact in terms of improved overall traffic
circulation and pedestrian accessibility.
Furthermore, this closure, vacation, abandonment, and discontinued use of specific utility easement sections
from public use is consistent with the Miami Neighborhood Comprehensive Plan's Transportation Element, Goal
TR-1:
"Maintain an effective and cost-efficient circulation network that provides transportation for all persons while
reducing both the dependency on automobiles and overall roadway congestion."
F. CONDITIONS
Based on the Plat and Street Committee findings, conditions of approval, and staffs analysis, the Planning
Department recommends the "Approval" of this Application subject to the following conditions:
1) The applicant or their successor shall comply with the conditions of approval stated for the Application
for Vacation and Closure of the alleys, in a letter dated June 10, 2019 issued by the Department of
Resilience and Public Works.
2) The applicant will demarcate and annotate with a callout on their finalized, approved T-Plat language for
an "access easement" for the proposed vacation and closure of a portion of SW 36 Court (Right -of -Way)
that it will promote the beneficial effect on pedestrian and vehicular circulation in the area without any
temporary or permanent encumbrances, unless approved by the City of Miami.
3) Pursuant to Miami 21 Article 5, Section 5.6.1.i Building Disposition (T6): for sites with three hundred and
forty (340) feet Frontage length or more, a cross -Block passage shall be provided as follows: If the
Frontage Line of a site is at any point more than three hundred and forty (340) feet from a Thoroughfare
intersection, the Building shall provide a cross -Block Pedestrian Passage. The applicant fulfills this
requirement by providing a three-dimensional pubic ingress and egress easement, which will be

dedicated by the T-Plat. To ensure unfettered pedestrian circulation, there will be n
permanent horizontal or vertical obstructions, unless formally authorized by the Cit
Department of Resilience and Public Works.
4) This property abuts a portion of Calle Ocho (Eighth Street) right-of-way between Br
the Palmetto Expressway in Miami -Dade County, Florida, which has been designate
highway pursuant to House Bill 1104 (Chapter 86-308). The act would prohibit the use
certain actions, such as the removal of trees. The measure requires the approval of the D

Archives, History, and Records Management of the Department of State before any alteration may se
made on Eighth Street. Further, before any such alterations may be made, a public hearing must be held
after notification of all affected parties. Certain restrictions are also placed on the erection of signs along
Eighth Street; however, these restrictions do not supersede more stringent local sign ordinance(s).
5) Prior to the building phase, the applicant shall coordinate, in writing, with both the City of Miami's
Building Department and the Florida Department of State's Division of Library and Information Services
for guidance on any proposed modifications to this abovementioned state designated historic highway.
6) The applicant shall provide a written request to the City of Miami Office of Capital Improvements and
Department of Resilience and Public Works to obtain confirmation. If the Confirmation indicates that
funds were expended, the City's Finance Department and Office of Management and Budget will
determine the amount of the City's expenditure, specifically including the expenditure of restricted funds
(bond funds, grant funds, or otherwise) for such improvements as a separate line item. The City
Manager or his or her designee will issue a Total Expenditure, which shall specify the amount that the
Applicant must repay to the City ("Total Expenditure").
Said Confirmation and, if applicable, Total Expenditure must be obtained prior to the scheduling of a
public hearing regarding the vacation and closure before the City Commission, or before the PZAB for
the Alternative Method under the City Code Section 55-15(i) and (j) Payment to the City of the amount
indicated on the Total Expenditure shall be paid to the City before recordation of the Final Plat in
accordance with Section 55-8 of the City Code, or before scheduling for PZAB consideration for the
Alternative Method under the City Code Section 55-15(i) and (j).

Ladies and Gentlemen:
The City of Miami Plat and Street Committee, at its meeting of'March 14, 2019, APPROVED the above
tentative plat subject to the following revisions being made to the tentative plat, additional information
being provided and/or variances being granted. Please be advised that the processing of your tentative plat
cannot proceed until these conditions and/or comments have been satisfied.
Resilience and Public Works
1. Application - Survey section will follow up with Ivan R. for school concurrency.
2. A plat approval letter from the Florida Department of Transportation (FDOT) is required prior to
final plat submittal. A copy of the final plat must be submitted to the FDOT, not a copy of the
tentative plat.
3. Provide corrections on the underground information of existing storm water system adjacent to
proposed plat, along SW 36 Ct.
4. Propose use, confirm the number of stories of building (Tract A).
5. Contact Survey section for additional minor comments.
6. Provide complete dimensions for the proposed easement, to clarify curve geometries at both ends.
7. Location of proposed to be vacated 10-foot utility easement is not accurately drawn.
8. Development — curb and gutter alignment will be coordinated with easement area/alignment.

9. Provide a tree table listing all trees with common and botanical names, height, diameter and spread
prepared by a Certified Arborist with name and certification number.

Standard Comments for Street and/or Easement Vacation
14. A letter from the Miami -Dade Water and Sewer Department is required to determine if any
adjustments to their facilities or easements are required.
15. Existing utilities located within the street, alley, and easement to be closed and vacated must be
relocated or easements provided.
16. Provide a legal opinion as to if any claim has been filed for reversionary rights to the Right of Way
to be closed and vacated, pursuant to Florida Statutes Chapter 177, Section 177.085.
17. Public Hearing/Planning, Zoning and Appeals Board (PZAB).
a. An Opinion of Title as to reversionary rights for the right-of-way/easement to be closed and
vacated will be required by the PZAB (does not apply for easement within private
property). The Opinion of Title must also address whether or not there are individuals, in
addition to the abutting property owners, having an interest in the right-of-way/easement to
be closed and vacated. A copy of the Opinion of Title must be provided to the Resilience
and Public Works Department, prior to acceptance of the application.
b. The PZAB will require a sketch and legal description with a square footage, on an 8 '12" X
11" paper, for the proposed closure. Contact the Office of the Hearing Boards, at 305-416-
2030. Provide a copy to the Resilience and. Public Works Department.
18. The Plat and Street Committee has reviewed this tentative plat and determined that all technical
requirements contained in the Miami City Code Subdivision Regulations have been met and has
approved the tentative plat. The members of the Plat and Street Committee have further considered
the request for vacation and closure of the street/alley/easement with respect to Miami City Code
requirements and have voted 5 (five) in favor and 0 (zero) in denial of this vacation and closure
request.
19. Provide a written request to the City of Miami Office of Capital Improvements and Department
of Resilience and Public Works to obtain a Confirmation ("Confirmation"). If the Confirmation
indicates that funds were expended, the City's Finance Department and Office of Management
and Budget will determine the amount of the City's expenditure, specifically including
expenditure of restricted funds (bond funds, grant funds, or otherwise) for such improvements
as a separate line item. The City Manager or his or her designee will issue a Total Expenditure,
which shall specify the amount that the Subdivider must repay to the City ("Total
Expenditure").
Said Confirmation and, if applicable, Total Expenditure must be obtained prior to the
scheduling of a public hearing regarding the vacation and closure before the City Commission,
or before the PZAB for the Alternative Method under the City Code Section 55-15(i) and (j).
Payment to the City of the amount indicated on the Total Expenditure shall be paid to the City
before recordation of the Final Plat in accordance with Section 55-8 of the City Code, or before
scheduling for PZAB consideration for the Alternative Method under the City Code Section 55-
15(i) and (j).
Standard Comments
20. A letter from Comcast is required to determine if any adjustments to their facilities or easements are
required.
21. Verify with Miami -Dade County that the proposed plat name is acceptable.
22. All encroachments across proposed tract and/or lot lines must be removed prior to final plat
submittal.

23. An Opinion of Title, in the City of Miami Opinion of Title form, must be provided
final plat submittal.
24. Current backup documentation will be required for all who execute the final plat. A r
authority to execute documents and a Certificate of Good Standing from the Secretary o
required, if applicable.
25. Tentative plat application must be made with Miami -Dade County after receiving approval from the
City of Miami Plat and Street Committee. Provide a copy of the notice of action to Public Works.
26. Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is the
owner's responsibility to work with his/her surveyor and attorney to assure that everything is in
order before submitting the final plat package.
27. Be advised that if all requirements for scheduling the final plat for City Commission action are not
in order, the final plat will not be scheduled for a City Commission meeting.
28. A letter of concurrency from Miami -Dade County School Board is required prior to the final plat
approval (see contact sheet). The tentative plat name and tentative plat number must be included on
the application form.
29. A letter from Miami -Dade Water and Sewer Department is required to release the final plat in
connection with water and sewer service agreements.
30. For informational purposes, provide two 8 '/2" x 11" sketches of the division of the land; one sketch
of the existing divisions before the plat is recorded and one sketch of the divisions after the plat is
recorded.

of -way when property is platted. These subdivision improvements include paving, drainage,
landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your
part. REQUIRED: The submission of an electronic file of the tentative plat, in an AutoCAD, to the
City of Miami Public Works Department, Development and Roadway Plans Section will
EXPEDITE the preparation and enhance the ACCURACY of the subdivision improvement letter
required for the final plat approval.
2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric,
telephone, water, etc., caused by this plat will be at the property owner's expense. Also, utility
easements may be required on the property being platted.
3. A building permit will not be issued on the property being platted until the final plat is recorded or
as authorized by the City of Miami Code Section 55-10(i). Also, the Temporary Certificate
Occupancy and/or Certificate of Occupancy for any building construction will be issued only after
all the required subdivision improvements have been completed.
4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to the
issuance of a building permit.
5. In order to mitigate problems associated with access and construction activities throughout the
neighborhood, the contractor/developer is encouraged to notify the affected neighborhood residents,
in writing, of the project starting and completion dates at the time of issuance of permits. The
contractor/developer may coordinate the notification of residents with the local City of Miami NET
Service Center.
6. Additional items must be provided to the City of Miami Department of Public Works before the
fmal plat is submitted to the City Commission for approval. You will be notified in writing as to
what these items are after the amount of the bond has been determined for the necessary
subdivision improvements. It is required that the applicant contacts the City of Miami Public Works
Survey Section to verify that all final plat submittal documents are complete prior to final plat
submittal.
7. Tentative plat approval is only valid for 1(one) year and 6(six) months from the date of the Plat and
Street Committee meeting at which time it was approved.
