WHEREAS, the Florida Department of Transportation ("FDOT") wishes to convey to the City of Miami ("City") the property located at 401 Southwest 1 Street and 40 Southwest South River Drive containing approximately twelve thousand eight hundred forty-one (12,841) square feet ("Parcel 6925"); and 4-, N 0 ' O N 41 4— N T2 N E ° 0 v c N O Suiorn.i-W-Jona_il to 8-72gand esoid-hon 12 OO- O Q O WHEREAS, FDOT also wishes to convey to the City the property located at 135 Southwest South River Drive containing approximately thirty-two thousand eight hundred eighty- five (32,885) square feet ("Parcel 6876"): and - L D WHEREAS, FDOT requested a perpetual, non-exclusive thirty (30) foot wide easement a = U a a of approximately three thousand four hundred (3,400) square feet of a portion of City -owned ..c = 5 property located at 1 Southwest South River Drive ('`Parcel 809") for the purpose of access, o r; bridge maintenance, and equipment and/or materials staging over, upon, across, in, and c o through Parcel 809; and o N v N WHEREAS, FDOT also requested the right to reserve a perpetual, non-exclusive thirty E (30) foot wide easement of a portion of Parcel 6925 of approximately two thousand six hundred ai c twenty-four (2,624) square feet ("Parcel 807") for the purpose of access, bridge maintenance, ° and equipment and/or materials staging over, upon, across, in, and through Parcel 807; and WHEREAS, FDOT also requested the right to reserve a perpetual, non-exclusive thirty (30) foot wide easement of a portion of Parcel 6876 of approximately nine thousand five hundred forty-three (9.543) square feet ("Parcel 808") for the purpose of an unobstructed viewshed over, upon, across, in, and through Parcel 808; and WHEREAS, the acceptance of Parcel 6925 and Parcel 6876 for public purpose use in exchange of grants of easement to FDOT for Parcel 807, Parcel 808, and Parcel 809 are in the best interest of the City to allow FDOT's proper bridge operation and maintenance currently serving the City's connectivity and transportation needs over the Miami River; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized' to accept the Deed from FDOT to the City for Parcel 6925 and Parcel 6876. Section 3. The City Manager is authorized' to grant the easement for Parcel 807 and Parcel 809 for the purpose of access, bridge maintenance, and equipment and/or materials staging over, upon, across, in, and through Parcel 807 and Parcel 809. Section 4. The City Manager is further authorized' to grant the easement for Parcel 808 for the purpose of an unobstructed viewshed over, upon, across, in, and through Parcel 808. Section 5. The City Manager is authorized' to negotiate and execute any and all other necessary documents, including amendments and modifications, all in forms acceptable to the City Attorney, in order to effectuate said acceptance of the Deed and the grants of easement for Parcel 807, Parcel 808, and Parcel 809. Section 6. This Resolution shall become effective immediately upon adoption and signature of the Mayor.' 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution. it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
