Subject: Establish Special Revenue - U.S. Marshall Service
Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), establishing a new
Special Revenue Project titled: "2020-2021 U. S. Marshals Service;" authorizing the City
Manager to execute an amendment to the existing Memorandum of Understanding
along with an Obligation Document for the Miami Police Department's ("MPD") Felony
Apprehension Team continued participation in the Regional Fugitive Task Force, with
the acceptance of reimbursement funds in the amount of ninety-five thousand dollars
($95,000.00); further authorizing the City Manager to accept future funding and
designate the Chief of Police or his designee to execute any and all necessary
documents, all in a form acceptable to the City Attorney, for the acceptance of said
reimbursement funds.
Background of Item:
The United States Marshals Service has requested our Department to execute an
amendment to the existing Memorandum of Understanding to enhance the
effectiveness of Federal/State/Local law enforcement resources through a well -
coordinated effort to locate and apprehend fugitives. Targeted crimes will primarily
include violent crimes against persons, weapons offenses, felony drug offenses, failure
to register as a sex offender, and crimes committed by subjects who have a criminal
history involving violent crimes.
The United States Marshals Service (USMS) has obligated reimbursement funds for the
period of October 7, 2020 to September 30, 2021, in the amount of $95,000.00.
Reimbursements are subject to the availability of funds and contingent upon the
submission of proper documentation. If the Marshal Service receives Asset Forfeiture
funding for either 1) overtime incurred by state and local investigators who provide full
time support to USMS RFTF joint law enforcement task forces; or 2) travel, training,
purchase or lease of police vehicles, fuel, supplies or equipment for state and local
investigators indirect support of state and local investigators, the USMS shall, pending
availability of funds, reimburse the City of Miami for expenses incurred.
The primary mission of the task force is to investigate and arrest, as part of joint law
enforcement operations, persons who have active state and federal warrants for their
arrest. The intent of the joint effort is to investigate and apprehend local, state and
federal fugitives, thereby improving public safety and reducing violent crime.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ESTABLISHING A NEW SPECIAL REVENUE PROJECT TITLED "2020-2021 U. S.
MARSHALS SERVICE"; AUTHORIZING THE CITY MANAGER TO EXECUTE AN
OBLIGATION FORM TO ACCEPT REIMBURSEMENTS IN AN AMOUNT NOT TO
EXCEED NINETY-FIVE THOUSAND DOLLARS ($95,000.00) FOR OVERTIME
EXPENSES INCURRED BY MEMBERS OF THE MIAMI POLICE DEPARTMENT'S
FELONY APPREHENSION TEAM ASSIGNED TO ASSIST THE UNITED STATES
MARSHALS SERVICE ("U.S. MARSHALS") PURSUANT TO THE EXISTING
MEMORANDUM OF UNDERSTANDING BETWEEN THE U.S. MARSHALS AND THE
CITY OF MIAMI; AUTHORIZING THE CHIEF OF POLICE OR HIS DESIGNEE TO
EXECUTE ANY AND ALL NECESSARY DOCUMENTS, ALL IN FORMS
ACCEPTABLE TO THE CITY ATTORNEY, FOR THE ACCEPTANCE OF SAID
REIMBURSEMENT FUNDS.
WHEREAS, the City of Miami ("City") entered into a Memorandum of Understanding
("MOU") with the United States Marshals Service ("U.S. Marshals") in March 2018 providing for
the Miami Police Department's ("MPD") continued participation in the U.S. Marshals Regional
Fugitive Task Force ("Task Force"); and
WHEREAS, pursuant to the MOU, the U.S. Marshals are obligated to provide
reimbursement funds for overtime expenses incurred by MPD officers participating in the Task
Force at the beginning of each fiscal year, subject to any administrative amendments to the
MOU; and
WHEREAS, the U.S. Marshals has obligated overtime reimbursement funding for the
Task Force during the period commencing October 7, 2020 and ending on September 30, 2021
in an amount not to exceed ninety-five thousand dollars ($95,000.00); and
WHEREAS, the reimbursement of overtime expenses is contingent upon the submission
of proper documentation, which provides the names of the MPD officers who accrued overtime
expenses while participating in the Task Force, the number of overtime hours worked, the
hourly regular and overtime pay rates in effect for each officer, and the overtime costs; and
WHEREAS, no matching funds are required from the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The following new Special Revenue Project is established and resources are
appropriated as described below:

APPROPRIATIONS: Joint Law Enforcement Operations Task Force $95,000.00
Section 3. The City Manager is authorized' to execute an obligation form to accept
reimbursement funds and designate the Chief of Police, or his designee, to execute any and all
necessary documents, all in forms acceptable to the City Attorney, for the reimbursement of
expenses incurred in an amount not to exceed ninety-five thousand dollars ($95,000.00) for
overtime reimbursement of MPD's members participating in the Task Force.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor2

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
