A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING AND
DIRECTING THE CITY OF MIAMI'S OUTSIDE COUNSEL TO DISMISS, WITH
PREJUDICE, THE CASE STYLED THE CITY OF MIAMI V. ERNESTO CUESTA, ET
AL., PENDING IN THE THIRD DISTRICT COURT OF APPEALS, CASE NO. 3D21-
532.
WHEREAS, the City Commission has approved the settlement of all claims brought
against the City of Miami ("City") in the matter of West Flagler Associates, Ltd., v. City of Miami,
pending in the United States District Court for the Southern District of Florida, Case No.: 19-
21670-CIV-SCOLA;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as fully set forth in this Section.
Section 2. The City Commission hereby directs the City's Outside Counsel to dismiss,
with prejudice, the case styled City of Miami v. Ernesto Cuesta, et al., pending in the Third
District Court of Appeals, Case No. 3D21-532.
Section 3. This Resolution shall become effective immediately upon its adoption.
