A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO REINSTITUTE THE BAR AND ALCOHOL ESTABLISHMENT TASK
FORCE TO ENSURE PROACTIVE ENFORCEMENT BY THE CITY OF MIAMI
DEPARTMENTS OF POLICE, FIRE -RESCUE, BUILDING, AND CODE COMPLIANCE
OF THE REQUIREMENTS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, THE FLORIDA BUILDING CODE, THE FLORIDA FIRE PREVENTION
CODE, ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, AND ALL OTHER APPLICABLE ORDINANCES,
STATUTES, LAWS, AND REGULATIONS.
WHEREAS, the City of Miami ("City") has a long-established history of collective
departmental enforcement actions that serve to protect the health, safety, and welfare of the
community; and
WHEREAS, since the Novel Coronavirus ("COVID-19") pandemic, these joint
enforcement efforts have not been occurring; and
WHEREAS, notwithstanding the COVID-19 pandemic, on a regular basis, there are
businesses open and operating within the City's limits that lack the proper licensure to be open,
have done illegal remodeling, have not complied with the Florida Fire Prevention Code, and are
selling and/or distributing alcohol in violation of City and State law; and
WHEREAS, these establishments are in regular violation of State alcohol laws, the Code
of the City of Miami, Florida, as amended ("City Code"), the Florida Building Code, and
Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami
21 Code"); and
WHEREAS, these establishments create an atmosphere which is unsafe for both
patrons and the community and are negatively impacting the quality of life of our
neighborhoods; and
WHEREAS, these establishments have no concern for the danger that they pose to the
community through their illegal actions; and
WHEREAS, the random joint enforcement actions by City departments serves to prevent
the continued operation of these illegal businesses and to prosecute them for illegal activities as
provided for by law; and
WHEREAS, these actions and prosecutions serve as a deterrent to others who may
consider opening their businesses illegally and provide further support to those businesses who
are operating legally; and
WHEREAS, it is in the best interests of the City, its residents, and businesses that the
Bar and Alcohol Establishment Task Force be reinstituted; and
WHEREAS, in accordance with Section 2-33(f) of the City Code, the City Commission,
by a majority vote, hereby deems this Resolution to be of an emergency nature;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated as fully set forth in this Section.
Section 2. The Miami City Commission directs the City Manager to reinstitute the Bar
and Alcohol Establishment Task Force to ensure proactive enforcement by the City's
Departments of Police, Fire -Rescue, Building, and Code Compliance of the requirements of the
City Code, the Florida Building Code, the Florida Fire Prevention Code, the Miami 21 Code, and
all other applicable ordinances, statutes, laws, and regulations.
Section 3. This Resolution shall become effective immediately upon its adoption.
