RESOLUTION NO. 009/2021
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE MIAMI
DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF
MIAMI, FLORIDA EXPRESSING SUPPORT OF THE NITE OWL
DRIVE-IN MOVIE THEATER ("NITE OWL") AND URGING THE
MIAMI CITY COMMISSION TO WAIVE THE TWO (2) TEMPORARY
EVENT LIMITATION PER YEAR TO ALLOW GREENSLIME
LABORATORIES, INC. THE OPPORTUNITY TO CONTINUE
OPERATING NITE OWL AT 1400 NORTHEAST 1ST AVENUE, 1441
NORTHEAST MIAMI PLACE, 1442 NORTHEAST 1ST AVENUE, 1422
NORTHEAST 1ST AVENUE, 1433 NORTHEAST MIAMI PLACE, AND
73 NORTHEAST 14TH STREET, MIAMI, FLORIDA, RESPECTIVELY,
FOLIO NOS. 0131360051420, 0131360051360, 0131360051370,
0131360051380, 0131360051390, 0131360051400, AND 0131360051410,
UNTIL AT LEAST JANUARY 14, 2022; DIRECTING THE EXECUTIVE
DIRECTOR TO FORWARD A COPY OF THIS RESOLUTION TO THE
OFFICIALS STATED HEREIN.
WHEREAS, the Miami Downtown Development Authority of the City of Miami, Florida's ("Miami DDA")
2025 Downtown Miami Master Plan calls for the Miami DDA to "Enhance our Position as the Business and Cultural
Epicenter of the Americas" and to "Grow & Attract Business Enterprises;" and
WHEREAS, due to the novel coronavirus 2019 ("COVID- 19") pandemic, some of the most prominent
international art events such as Art Basel and Art Miami were cancelled in 2020, theaters and other entertainment
venues largely remai closed, and the City of Miami ("City") is suffering a loss of significant tax revenue, decline of
business activity, and lack of cultural activities that bring the community together; and
WHEREAS, Greenslime Laboratories, Inc., doing business as Nite Owl Theater ("Nite Owl"), has established
and is operating a drive-in movie theater at 1400 Northeast 1" Avenue, 1441 Northeast Miami Place, 1442
Northeast 1st Avenue, 1422 Northeast 1st Avenue, 1433 Northeast Miami Place, and 73 Northeast 14th Street,
Miami Florida, respectively, Folio Nos. 0131360051420, 0131360051360, 0131360051370, 0131360051380,
0131360051390, 0131360051400, and 0131360051410 (collectively, "Property"); and
WHEREAS, Nite Owl is a public -private partnership with the Omni Redevelopment District Community
Redevelopment Agency, Knight Foundation, Fairchild Tropical Garden, and Adrienne Arsht Center, among others;
and
WHEREAS, Nite Owl provides safe, contactless, and touchless entertainment, with state-of-the-art laser
projection system, to City families and tourists while the majority of the entertainment industry remains shut down due
to COVID-19 associated risks; and
WHEREAS, Nite Owl complies with all City, Miami -Dade County, and State of Florida COVID-19
guidelines and regulations to ensure safety of all participants who are required to remain in their vehicles at all times
and required to wear masks for restroom visits; and

WHEREAS, pursuant to Section 62-521 of the Code of the City of Miami, Florida, as amended ("City Code"),
temporary events like Nite Owl are limited to no more than two (2) per year per property for no longer than two (2)
weeks per event and pursuant to Section 62-521(b) of the City Code, the number and time limitations for temporary
events may be waived upon affirmative vote of the City Commission; and
WHEREAS, Nite Owl submitted a request to the Miami City Commission to waive the temporary event
limitation to allow operation of the drive-in theater until January 14, 2022; and
WHEREAS, considering the undeniable need for community entertainment and support for local businesses
during the COVID-19 pandemic, Board of Directors of the Miami DDA urges the City Commission to approve
Nite Owl's request to operate the drive-in theater until at least January 14, 2022; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE MIAMI
DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, FLORIDA:
Section I . The recitals are true and correct and are adopted by reference and incorporated as if fully set forth
in this Section.
Section 2. The Board of Directors of the Miami DDA expresses support of the Nite Owl drive-in movie
theater and urges the Miami City Commission to waive the two (2) temporary event limitation per year to allow
Nite Owl the opportunity to continue operating the drive-in theater at the Property until at least January 14, 2022.
Section 3. The Board of Directors of the Miami DDA directs the Executive Director to forward a
copy of this Resolution to the Mayor and Members of the Miami City Commission and City Manager
Arthur Noriega, V.
Section 4. This Resolution shall become effective immediately upon its adoption.
