Subject: Authorize - Increase in Contract Capacity - The Gordian Group, Inc.
Purpose of Item:
The nature of this item is to establish a resolution of the City of Miami Commission,
authorizing an increase in capacity beyond the City Manager approved fifty thousand
dollars ($50,000.00) to the City of Tampa Request for Proposals ("RFP") No. 41111317
for Job Order Contracting Consulting Services, pursuant to Section 18-111 of the Code
of the City of Miami, Florida, as amended, with The Gordian Group, Inc. ("Gordian"),
which was competitively solicited for an initial term of two (2) years, with an option to
renew ("OTR") for three (3) additional one (1) year periods, subject to any extensions
and/or replacement contracts by the City of Tampa; allocating funds from the various
sources of funds from the user department, subject to availability of funds and
budgetary approval at the time of need; authorizing the City Manager to negotiate and
execute all other documents, including any amendments, renewals, and extensions,
subject to allocations, appropriations and prior budgetary approvals, and in compliance
with all applicable provisions of the Code of the City of Miami, Florida, as amended,
("City Code"), including the City of Miami's Procurement Ordinance, Anti -Deficiency Act,
and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, all in a
form acceptable to the City Attorney, and in compliance with all applicable laws, rules,
and regulations, as may be necessary for said purpose.
Background of Item:
The Office of Capital Improvements ("OCI") has a need for the provision of Job Order
Contracting ("JOC") Consulting Services, to provide professional consulting services, on
an as needed basis. By accessing the City of Tampa RFP No. 41111317, it will enable
OCI to procure said services, at a fair competitive rate that is acceptable to the City.
Procurement worked diligently with OCI to identify a piggy -back for these services
offered by the Gordian Group, Inc. that had favorable contract terms and pricing for the
City, which resulted in the accessing of the Tampa RFP. For continuity of services, the
initial access of the Tampa RFP was approved by the City Manager under his delegated
authority of $50,000. This contract has an initial term of two (2) years, with an OTR for
three (3) additional one (1) year periods. The estimated fiscal impact is approximately
$170,032.00 per year ($510,096.00 in the aggregate for the remainder of the OTR
periods).

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING AN INCREASE
IN CONTRACT CAPACITY BEYOND THE CITY MANAGER APPROVED FIFTY
THOUSAND DOLLAR ($50,000.00) THRESHOLD FOR CONTINUED USE OF CITY
OF TAMPA REQUEST FOR PROPOSALS CONTRACT NO. 41111317 FOR JOB
ORDER CONTRACTING CONSULTING SERVICES BY THE CITY OF MIAMI'S
("CITY") OFFICE OF CAPITAL IMPROVEMENTS ("OCI") PURSUANT TO SECTION
18-111 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY
CODE"), WITH THE GORDIAN GROUP, INC., A FOREIGN PROFIT CORPORATION
REGISTERED TO CONDUCT BUSINESS IN THE STATE OF FLORIDA, WHICH WAS
COMPETITIVELY SOLICITED FOR AN INITIAL TERM OF TWO (2) YEARS WITH
OPTIONS TO RENEW FOR THREE (3) ADDITIONAL ONE (1) YEAR PERIODS;
ALLOCATING FUNDS FROM THE CITY'S VARIOUS SOURCES OF LEGALLY
AVAILABLE FUNDS FROM THE USER DEPARTMENT, SUBJECT TO THE
AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED;
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL
OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS,
EXTENSIONS, AND/OR REPLACEMENT CONTRACTS, SUBJECT TO ALL
ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS,
COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CITY CODE,
INCLUDING THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT,
AND FINANCIAL INTEGRITY PRINCIPLES, AS SET FORTH IN CHAPTER 18 OF THE
CITY CODE, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND IN
COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS
MAY BE DEEMED NECESSARY FOR SAID PURPOSE.
WHEREAS, the City of Miami's ("City") Department of Procurement ("Procurement"), on
behalf of the Office of Capital Improvements ("OCI"), accessed City of Tampa ("Tampa")
Request for Proposals ("RFP") Contract No. 41111317 ("Contract") for job order contracting
consulting services ("Services") with The Gordian Group, Inc., a foreign profit corporation
registered to conduct business in the State of Florida ("Gordian Group"), under the delegated
authority of the City Manager; and
WHEREAS, an increase in contract capacity beyond the City Manager's approved Fifty
Thousand Dollar ($50,000.00) threshold for continued use of the Contract will enable OCI to
continue to procure said Services at a fair and competitive rate that is acceptable to the City;
and
WHEREAS, pursuant to Section 18-111 of the Code of the City of Miami, Florida, as
amended ("City Code"), the City's Chief Procurement Officer determined that said Contract was
entered into pursuant to a competitive process in compliance with the City's laws, policies, and
procedures;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. An increase in contract capacity beyond the City Manager approved Fifty
Thousand Dollar ($50,000.00) threshold for continued use of Tampa's RFP Contract No.
41111317 for the Services by OCI pursuant to Section 18-111 of the City Code with the Gordian
Group, which was competitively solicited for an initial term of two (2) years with options to renew
for three (3) additional one (1) year periods, is authorized.
Section 3. Funding is allocated from the City's various sources of funds from the user
department, subject to the availability of funds and budgetary approval at the time of need.
Section 4. The City Manager' is authorized to negotiate and execute any and all other
documents, including any amendments, renewals, extensions, and/or replacement contracts,
subject to all allocations, appropriations, prior budgetary approvals, compliance with all
applicable provisions of the City Code, including the City's Procurement Ordinance, Anti -
Deficiency Act, and Financial Integrity Principles, as set forth in Chapter 18 of the City Code, in
forms acceptable to the City Attorney, and in compliance with all applicable laws, rules, and
regulations, as may be necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.
