A RESOLUTION OF THE MIAMI CITY COMMISSION OPPOSING THE PROPOSED
MIAMI-DADE COUNTY ORDINANCE (MIAMI-DADE COUNTY LEGISLATIVE FILE
NO. 210409) RELATING TO UPDATING THE MIAMI-DADE COUNTY TRAFFIC FLOW
MODIFICATIONS AND STREET CLOSURE PROCEDURE MANUAL TO PROHIBIT
THE CONSIDERATION OF ROAD CLOSINGS IN MUNICIPALITIES TO BE USED IN
CONNECTION WITH TRAFFIC CALMING MEASURES; DIRECTING THE CITY
CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE OFFICIALS NAMED
HEREIN.
WHEREAS, the Miami -Dade County Board of County Commissioners ("County
Commission") is considering adoption of an ordinance (Miami -Dade County Legislative Item File
No. 210409) ("Ordinance") at its upcoming March 2, 2021 meeting that would modify the Miami -
Dade County Traffic Flow Modifications and Street Closure Procedure Manual ("Manual") to
prohibit the consideration of road closings as a method of traffic calming; and
WHEREAS, numerous City of Miami ("City") streets serving low -density residential
neighborhoods, including single-family neighborhoods, are used daily by drivers from areas
beyond the City's boundaries to cut through on the way to jobs, schools, and other destinations
in an effort to avoid traffic on arterial roadways designed for such traffic; and
WHEREAS, such cut -through traffic has diminished the safety of pedestrians and
residents in these neighborhoods, including children and the elderly; and
WHEREAS, the Ordinance under consideration by the County is unnecessary as Miami -
Dade County ("County"), through its Department of Transportation and Public Works, already
possesses jurisdiction over most road closings and has steadfastly refused the requests made
by the City for such closings in recent years, ostensibly on technical grounds; and
WHEREAS, the Ordinance, if adopted, would foreclose the possibility of using a
legitimate traffic calming and quality of life strategy, the absence of which continues to hurt City
residents daily; and
WHEREAS, the City Commission opposes the Ordinance; and
WHEREAS, pursuant to Section 2-33(f) of the Code of the City of Miami, Florida, as
amended, the City Commission, by a majority vote, deems this Resolution to be of an
emergency nature in order to immediately protect the public health, welfare, and safety of the
City's residents;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission opposes the Ordinance updating the Manual to prohibit
the consideration of road closings in municipalities to be used in connection with traffic calming
measures.
Section 3. The City Clerk is directed to transmit a copy of this Resolution to County
Mayor Daniella Levine Cava and the members of the County Commission.
Section 4. This Resolution shall become effective immediately upon adoption.
