HomeMy WebLinkAboutPZAB (5140) ResolutionCity of Miami PZAB Resolution Enactment Number: PZAB-R-18-068 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 5140 Final Action Date: 12/19/2018 A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD FAILING TO MAKE A RECOMMENDATION OF AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION FROM "T3-R" SUB -URBAN - RESTRICTED TO "CS" CIVIC SPACE OF THE PROPERTY LOCATED AT APPROXIMATELY 2201 SOUTHWEST 26 STREET, MIAMI, FLORIDA, MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the property located at approximately 2201 Southwest 26 Street, Miami, Florida, as more particularly described in the attached and incorporated Exhibit "A," is currently zoned "T3-R" Sub -Urban - Restricted; and WHEREAS, Emilio T. Gonzalez, on behalf of the City of Miami ("City") ("Applicant"), has submitted a request to change the zoning classification to "CS" Civic Space; and WHEREAS, the proposed zoning change is appropriate in light of the intent of Ordinance No. 13114, as amended, the Zoning Ordinance of the City ("Miami 21 Code") and particularly in relation to the effects on adjoining properties; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") has considered the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan, the Miami 21 Code, and all other City regulations; and WHEREAS, the proposed change will allow the development of a new park and Open Space for the citizens of the City, create Green Space to improve the quality of life and general health within the Silver Bluff Estates neighborhood and will expand the City's Park level of service; and WHEREAS, PZAB has considered the need and justification for the proposed change, including changing and changed conditions that make the passage of the proposed change necessary; and WHEREAS, the proposed change maintains the goals of the Miami 21 Code to preserve neighborhoods and provide transitions in intensity and building height; City of Miami Page 1 of 2 File ID: 5140 (Revision:) Printed On: 1/3/2019 NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The PZAB's motion to approve failed, therefore, failing to make a recommendation that the City Commission amend the Zoning Atlas of Ordinance No. 13114, as amended, by changing the zoning classification from "T3-R" Sub -Urban - Restricted to "CS" Civic Space, for the property located at approximately 2201 Southwest 26 Street, Miami, Florida, as described in "Exhibit A", attached and incorporated. Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Resolution is declared invalid, the remaining provisions of this Resolution shall not be affected. Section 4.
