HomeMy WebLinkAboutSubmittal-Renita Ross Samuels-Dixon-Information PacketNI Renita Ross Samuels -Dixon comments to City of Miami Commission on PZ.9.3001 - Neighborhood Conservation District (NCD-2 and NCD-3) Zoning Ordinance for Coconut Grove February 28, 2019 Reasons why the Proposed NCD-2 and NCD-3 Should Not Pass for First Reading: 5 1. The City, as required by, 3.12.2(c)(4), has not provided evidence that 51% of the owners within NCD-2 were Noticed of changes to its Boundaries nor deleting streets; the 8 people that came to the meetings from NCD-2 were Tenants (see Article 1.1; Renita's p 4) 2. .NCD-2 property owners did not request a change of its Intent (2.1 in proposed NCD-2) to allow the NCD-3 to expand its Boundary to include NCD-2; nor were we Noticed. (See map dated 8/8/2017). 3. The Miami Bahamas Cultural Preservation Fund, Inc. is submitting survey results from 31 (thirty-one) NCD-2 Residential Property Owners, who we reached out to, door to door. None of the owners were contacted by Community Organizations, The City, or our Commissioner and his Staff. 4. NCD-2 property owners did not request or anticipate NCD-3 would seek governance over NCD-3 and nor were we Noticed by the Coconut Grove Village Council of NCD-3's intent and purpose to do so. (See Renita's page 5 in yellow highlight); ,5. 6. Why didn't The Planning Department hire (DPZ & Company) Duany Plater-Zyberk & Company to perform an Existing Code Analysis (as they did in 2006, when looking at replacing the 11000 Code with Miami 21); or at least someone of their caliber? Without this Analysis these proposed changes can do irreparable harm to my property values, which I am noticing now; and reduce the size of home to be rebuilt if a catastrophic storm hits and destroys my property. Not to mention, without this analysis the City and Our Commissioners are negating its Citizen's Property Rights. (See attached first page of East Quadrant). The City of Miami Planning and Zoning Department never Noticed NCD-2 owners about "Diminishment" as shown on the Proposed NCD-2 and Proposed NCD-3 Boundary Maps: "Minimum Lot Size after "Diminishment"". See Proposed Boundary Map Diagram A2.1 and Diagram A3.1 (Renita's pps 4 and 25) and February 16, 2018 - DRAFT Minimum Lot Sizes Map and Proposed Public Meeting Dates. 7. We are aware of the dire need for Affordable and Workforce Housing in NCD-2; and those were the residents that were focused on when planning the proposed NCD-2 and NCD-3 Rewrite., Amendment. However, Our Commissioner neglected to ensure the NCD-2 Residential Property Owners were properly informed by tagging flyers on doors, pulling property rolls to ensure each property owner in NCD-2 was notified. City Clerk NOTE The following is an analysis of Ordinance 11000, the current zoning ordinance of the City of Miami. This analysis of the existing code is in- tended to illustrate the present regulatory framework which has estab- lished expectations for building development in Miami. This analysis will in turn inform the drafting of the new form based code and facilitate the transition form old to new. The analysis of these regulations does not address all aspects of the existing Zoning Ordinance, as that is hardly possible. For instance Special Districts provide a variety of modifiers to the basic zoning categories described which are too numerous to completely illustrate below. Special provisions contained in the special districts include: increases in FAR; height restrictions; specialized parking provisions, and -open -space requirernents;-among others LEGEND Analysis sheets contain text distinguished by a font color other than black for emphasis. Wherever color text occurs it is meant to indicate one of the following: More restrictive than previous zoning designation More permissive than previous zoning designation Changed from previous district (not necessarily more or less restric- tive) DEFINITIONS Throughout the analysis section certain terms of art appear in bold text. Below is an explanation for these terms. NLA (Net Lot Area): The total area within the lot lines, excluding any street rights -of -way or other required dedications. GLA (Gross Lot Area): The net area of the lot, as defined herein, plus half of adjoining street rights -of -way and seventy (70') feet of any other public open space such as parks, lakes, rivers, bays, public transit right-of-way and the like. For areas included in applicable Special Districts (SD-5, 6, 7, 10, 11, 14, 16), the gross lot area shall include net area of the lot plus half of adjoining street rights -of -way and ninety (90') feet of any other public open space such as parks, lakes, rivers, bays, public transit right-of- way and the like. In both cases, where such space adjoins lots on two (2) adjacent sides, the area thus added shall include the area required to complete the gap otherwise left at the intersection. FAR (Floor Area Ratio): The amount of floor area that may be developed on a given property expressed as a multiplier of the GLA (gross lot area). The ratio of floor area per GLA.
