A RESOLUTION OF THE EXECUTIVE BOARD OF THE COCONUT GROVE VILLAGE WEST
HOMEOWNERS AND TENANTS ASSOCIATION APPROVING THE RECOMMENDED CHANGES TO
THE NEIGHBORHOOD CONSERVATION DISTRICT (NCD) ZONING LEGISLATION AS
PRESENTED BY THE ZONING COMMITTEE.
WHEREAS, the Coconut Grove Village West Homeowner and Tenants Association (hereinafter referred
to as "HOATA") wishes to propose changes to the NCD-2 zoning overlay of Miami 21, the Zoning Code of
the City of Miami, currently being revised by the City of Miami.
WHEREAS, HOATA offers its opinion and represent what it believes would be in the best interest of the
community regarding future responsible and sustainable development within the village of Coconut
Grove. These recommended changes have been discuss- arid are supported by a large majority of
residents and stakeholders of Coconut Grove,
NOW, THEREFORE, BE IT RESOLVED BY THE COCONUT GROVE VILLAGE WEST
HOMEOWNERS AND TENANTS ASSOCIATION, THAT:
Section 1. That the foregoing "Whereas" clauses are hereby ratified and confirmed as being true
and correct and are hereby made a specific part of this Resolution upon adoption hereof.
Section 2. The main change to the structure of the current NCD document will include an internal
separation of the original NCD-3 and NCD-2 areas and regulations. The docu ent consists of one NCD
overlay but creates a new sub -section that specifically addresses the original NCD-2 area, now being
referred to as Village West Island District.
Section 3. HOATA proposes the following changes for NCD-2 Intent Language as follows:
3.1 PURPOSE AND INTENT:
Village West Island District reflects the historic legacy of the African -American communitys
unique Caribbean and Bahamian character and heritage, The Village West Island boundaries shall
include all sites located in the INCD-2 district boundaries. All properties in this district shall
maintain the character of the existing neighborhood through sensible development,
complementing historic resources including; the Mariah Brown House, the first home for a
Bahamian settler; the Historic Black Cemetery; the E.W.F. Stirrup House, home of the first black
doctor; historical churches, and several OTHER sites, The Coconut Grove NCD protects the
history of the Village West Island District by promoting its revitalization and restoration of
gateways, gathering places, and activities representative of its historic residents, culture, heritage
and legacy. This protection is vital in helping to preserve the character, residents and legacy of
the founding families whose descendants still reside within this district and those
desirous of returning.
3.2 Boundaries
The special district area increased from only Charles Avenue to indude all of the Village West
Island District. The boundaries of the Village West Island District are as follows: NORTH: U.S.
Highway 1; EAST: McDonald Street/SW 32 Avenue/Via Abitare; SOUTH: Charles Terrace/Franklin
Avenue/Marler Avenue; WEST: Brooker Street/Jefferson Street.
3.3 Floor Lot Ratio (FLR)
The .50 FLR best reflects the character of Coconut Grove Village West's average 5,000 sq. ft.
properties; protects the value of our tree canopy; and, supports our appeal as a tourist
destination,

3.4 Auxiliary Dwelling Units (ADU`m)
Allow Auxiliary Dwelling Units (A0J's)onlots ofany size and require owners to reside on site
and not require additional parking: forADU's.
3.5 Definition of Mixed Use Cultural District
Refer bothe Grand Avenue Vision Plan/City of Miami Design Guidelines, (Novpmber,20D2)
asthe guideline standards for the NCQ-2design standards. (See Exhib�tattached)
3.6 Village West architectural design guidelines are to be included in the M[D-2
document. Refer to the Grand Avenue Vision, Plan/City ofMiami Design Guidelines (November,
2OO2).
Sectiom4. Affordable Rental Units and Commercial Space
Initeqmhased with programmatic and financial resources, i.e, Community Redevelopment Agency /[pA\,
Community Development BUockGrant (CDBG),Opportunity ZomeFund, Special' District, etc. tmsecure the
bandho|dfor stakeholders and long-term residents. These resources will help to acquire a minimum of
1,500 rental units and fifty(50) single family homes at affordable rates to |ndude low -to -moderate and
ex±remneKy-lowincome residents to remedy the displacement ofthose affected and wish to netunn. These
resources will also help to acquire a minimum of 50,000 s4. ft of affordable commercial space for
Disadvantaged Business Enterprise (DBE) Mimmrity/VVomem, to generate local businesses in order to
promote and establish new businesses, revitalization and metoraUonof this community.,
SectimmS. Permits
5.1 Permit(s) in violation ofappicntion(s) for new construction, renovation, demolition and
development must be submitted tnappropriate City ofMiami administrator and reviewed by
Coconut Grove Village West Homeowners and Tenants Association (HO/UA) prior to
issuance. (Reference Chapter l7ofthe City {ode/Policy)
5.2 Any and all violations of the Village West Island District guidelines, relating to tree
removal, architectural design guidelines, new oonstnudimm, renovation, demolition and/or
development will be subject to severe fines and/'or cancellation of permit(s).
Saatimm6. Advisory
All rea!|tom, developers, banks, financial institutions, investment brokers and private
property/land sales should be made aware that the Village West Island District has restrictions
prior to, their purchase. An Advisory will be posted on websites, at aU City of Miami departments
that issue permits for any and all new construction in the Village West Island District area and
stamped on all plans submitted for review in the City of Miami Planning and Z�oning Department

Section 7. Public Meetings
APublic Meeting sponsored byCoconut Grove Village West Homeowners and Tenants Association,
(HOAJA) for community input is required for any new construction, renovation, demolition and/or
development inthe Village West Island District,
