PROPOSED AMENDMENTS TO NCD-2 & NCD-3 LEGISLATION
Remove requirement that all new construction that adds additional FLR in the NCD-2 go
before the Historic & Environmental Preservation Board (HEPB) and maintain the
current procedure, which requires review by the Urban Development Review Board
(UDRB).
Remove language granting 100° parking waiver by right for buildings less than 1
square feet.

Remove language incorporating Accessory Dwelling Units (e.g.. cottages, granny flats)
by right into areas zoned T3 in both NCD-2 and NCD-3. I am open incorporating ADUs
in future legislation, but there are potential impacts to individual property taxes, the
comprehensive plan, traffic, and parking that 1 would like to understand better.
Change the name of the definition tbr "Green Space" to "Green/Permeable Space" and
include a list of examples of what items will count toward this requirement.
Modify the height limitation.son roofs to provide that there is a 25 foot limit, measured
from the average sidewalk elevation (see Miami 21 Section 3..5.1.) and remove language
concerning parapets.
• Remove language pertaining to penalties for 'violating the tree, ordinance. The Tree
Preservation Ordinance in Chapter 1.7 of the City Code is a more appropriate place for
modifications to penalties.
• Modify proposed FLR limitations in T3-0 to 0.8 from 0.5.
• Add provision that provides for additional FL.R. to accommodate additions to existing
homes in order to incentivize preservation of existing homes.
Modify setbacks to accommodate stepbacks. Floors above the second story should be
stepped back .from the street to permit a tree buffer to improve the street level.
