Purpose of Item:
Similar to the Coconut Grove BID IN 2013, the Wynwood BID are seeking to alleviate
the City of Miami and Legal Department from the burdensome process of
applying/removing liens for unpaid assessments and improving assessment collections
up to 90%, by authorizing BID annual assessments to be sent annually, via Ad Valorem
assessments, within the Miami Dade County November Tax Roll.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
FOLLOWING AN ADVERTISED PUBLIC HEARING PURSUANT TO SECTION
197.3632, FLORIDA STATUTES, EXPRESSING ITS INTENT TO USE THE UNIFORM
METHOD OF COLLECTING NON -AD VALOREM ASSESSMENTS FOR THE
WYNWOOD BUSINESS IMPROVEMENT DISTRICT ("BID"); PROVIDING FOR THE
NEED FOR THE LEVY OF SAID ASSESSMENTS; PROVIDING FOR A DESCRIPTION
OF THE LEGAL BOUNDARIES OF THE BID AREA THAT IS SUBJECT TO THE
ASSESSMENTS AS SET FORTH IN COMPOSITE EXHIBIT "A," ATTACHED AND
INCORPORATED; PROVIDING FOR A COPY OF THIS RESOLUTION TO BE SENT
TO THE PROPERTY APPRAISER FOR MIAMI-DADE COUNTY, THE TAX
COLLECTOR FOR MIAMI-DADE COUNTY, AND THE DEPARTMENT OF REVENUE
OF THE STATE OF FLORIDA; AND FURTHER AUTHORIZING THE CITY MANAGER
TO NEGOTIATE AND EXECUTE THE INTERGOVERNMENTAL COOPERATION
AGREEMENT AND ANY AND ALL OTHER NECESSARY DOCUMENTS TO
IMPLEMENT THE CITY COMMISSION'S INTENT, ALL IN FORMS ACCEPTABLE TO
THE CITY ATTORNEY.
WHEREAS, pursuant to Resolution No. R-13-0136 adopted April 11, 2013, attached and
incorporated as part of Composite Exhibit "A", the City Commission established the Wynwood
Business Improvement District ("BID") within the City of Miami ("City"); and
WHEREAS, pursuant to Resolution No. R-13-0228 adopted June 13, 2013, the City
Commission fixed the final assessment roll for the BID; and
WHEREAS, Section 197.3632, Florida Statutes, provides authority for local
governments to use the uniform method ("Uniform Method") of collecting non -ad valorem
assessments for any assessments levied pursuant to general or special law or local
government ordinance or resolution; and
WHEREAS, the City Commission has determined that the collection and enforcement of
BID assessments can be best accomplished through the Uniform Method for collecting non -ad
valorem assessments pursuant to Section 197.3632, Florida Statutes; and
WHEREAS, in accordance with Section 197.3632, Florida Statutes, and Miami -Dade
County ("County") requirements, a copy of this Resolution is required to be sent to the County's
Property Appraiser, the County's Tax Collector, and the Department of Revenue of the State of
Florida ("FDOR"); and
WHEREAS, the County additionally requires the City and the BID to enter into an
Intergovernmental Cooperation Agreement with the County ("Intergovernmental Agreement") in
order to utilize the Uniform Method and to set forth the terms and conditions thereof;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission authorizes the use of the Uniform Method for collecting
non -ad valorem assessments for the BID pursuant to Section 197.3632, Florida Statutes.
Section 3. The City Commission hereby finds and determines that collection of
assessments levied within the BID boundaries is needed for the benefit of the properties that
are specially benefited by the BID and the use of the Uniform Method of collecting the non -ad
valorem assessments is necessary to achieve a more efficient and orderly collection of such
assessments and is in the public's best interest.
Section 4. The BID boundaries consist of the commercial properties adjoining and
contiguous or bounding and abutting upon such improvements or specially benefited thereby
and further designated by the final assessment map, attached incorporated as part of
Composite Exhibit "A", contained in Resolution No. R-13-0136 adopted April 11, 2013, which
includes the specific folios included and excluded as set forth below:
All lots and lands (on Exhibits "A-1" and "A-2" attached hereto and incorporated hereby
as parts of Composite Exhibit "A") are adjoining and contiguous or bounding and abutting upon
such improvements or specially benefited thereby and are further designated by the
assessment map thereinafter provided, which include all of the commercial properties consisting
of a forty-seven (47) block area of the central commercial core of Wynwood within the City's
limits on the properties abutting as set forth below:

Section 5. Upon the adoption of this Resolution, the City Clerk is directed to send a
copy of this Resolution by United States mail, certified return receipt requested, to the County's
Property Appraiser, the County's Tax Collector, and FDOR.
Section 6. The City Manager is authorized' to negotiate and execute the
Intergovernmental Cooperation Agreement and any and all other necessary documents to
implement the City Commission's intent, all in forms acceptable to the City Attorney.
Section 7. The intent expressed herein and the authority granted herein shall continue
from year to year until such time as the City Commission intends to discontinue using the
Uniform Method of collecting such assessments. At such time as the City Commission intends
to discontinue use of the Uniform Method, it shall inform the County's Property Appraiser, the
County's Tax Collector, and FDOR on or before January 10th of such year.
Section 8. This Resolution shall become effective immediately upon its adoption.
