AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
2/ARTICLE IV/DIVISION 2 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, TITLED "ADMINISTRATION/DEPARTMENTS/PLANNING, BUILDING
AND ZONING DEPARTMENT;" MORE PARTICULARLY, BY CREATING A NEW
SECTION 2-212, TITLED "CERTIFICATE OF USE PROGRAM," TO ESTABLISH A
PILOT PROGRAM FOR ONE (1) YEAR TO IMPLEMENT A PROCESS FOR THE
APPROVAL OF CERTIFICATES OF USE TO PERMIT VEHICLE STORAGE IN
CERTAIN COMMERCIALLY ZONED PROPERTIES; CONTAINING A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, businesses are required to obtain a Certificate of Use in order to operate in
the City of Miami ("City") pursuant to Chapter 2 of the Code of the City of Miami, Florida, as
amended ("City Code"); and
WHEREAS, such uses must comply with the requirements of Ordinance No. 13114, the
Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code"); and
WHEREAS, due to the negative impact of the Novel Coronavirus ("Covid-19") Pandemic
on the economy, many businesses are suffering severe financial duress; and
WHEREAS, the proposed amendment will assist commercial property owners in the City
experiencing financial duress as a result of the Covid-19 Pandemic by allowing the Temporary
Use of large commercially zoned parcels for vehicle storage without the capital investment of a
structure solely for vehicle display and storage;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted and incorporated as if fully set forth in this Section.
Section 2. Chapter 2/Article IV/Division 2 of the Code of the City of Miami, Florida, as
amended, is further amended in the following particulars:1
"CHAPTER 2

added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.

DIVISION 2. PLANNING, BUILDING AND ZONING DEPARTMENT
Section 2-212. Reserved Certificate of Use Program Pilot Program.
(a) In order to encourage economic development and notwithstanding any contradictory
provision in the City Code or the Miami 21 Code, the following Certificate of Use Pilot
Program is instituted for a period of one (1) year starting January 31, 2021 which can be
extended for a further year upon an affirmative vote of the City Commission.
(b) Open air storage of operating vehicles is permitted on properties in T6-O Transect
Zones containing a minimum of 1.5 acres.
(c) Storage of new motor vehicles shall be permitted on existing paved or unpaved lots
subject to the issuance of a Certificate of Use.
(d) This Section shall be enforced pursuant to the provisions established in Chapter 2 of the
City Code. Use of one means of enforcement shall not preclude the use of any other
remedies."
Section 3. If any section, part of section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective January 31, 2021.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
