HomeMy WebLinkAboutR-21-0020City of Miami Resolution R-21-0020 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 8339 Final Action Date: 1/14/2021 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS, PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY A FOUR FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDINGS, ATTACHED AND INCORPORATED AS EXHIBIT "A," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY"); WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE TRANSFER OF FUNDS FROM THE DISTRICT 3 SHARE OF THE CITY'S ANTI -POVERTY INITIATIVE ("API") PROGRAM IN A TOTAL AMOUNT NOT TO EXCEED THREE HUNDRED TWENTY THOUSAND FOUR HUNDRED SEVEN DOLLARS AND FORTY-SEVEN CENTS ($320,407.47) FOR THE DISTRICT 3 FOOD DISTRIBUTION PROGRAM TO THE DISTRICT 3 DISCRETIONARY ACCOUNT FOR EXPENDITURES CONSISTENT WITH THE API PROGRAM. SPONSOR(S): Commissioner Joe Carollo WHEREAS, the City of Miami ("City") created the Anti -Poverty Initiative ("API") to address poverty based on a strategy of focusing the provision of support towards the goal of having the City's residents achieve self-sufficiency; and WHEREAS, currently, the District 3 Commissioner provides and distributes food products and supplies for the benefit of low-income and underprivileged residents in District 3 using District 3 Discretionary Funds ("Food Distribution Program"); and WHEREAS, the provision and distribution of the food products as part of the Food Distribution Program is consistent with and furthers the API program within the City; and WHEREAS, the District 3 Commissioner desires to continue the Food Distribution Program; and WHEREAS, pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("Code"), the City Manager has made a written finding, attached and incorporated as Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of funds for the Food Distribution Program; and WHEREAS, the City Manager is requesting authority from the City Commission to execute any and all documents necessary for said transfer of Funds for the Food Distribution Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 8339 (Revision:) Printed On: 5/15/2025 File ID: 8339 Enactment Number: R-21-0020 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. Pursuant to Section 18-85(a) of the Code, by a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written findings, attached and incorporated as Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of funds for the Food Distribution Program and waiving the requirements for said procedures are hereby ratified, approved, and confirmed. Section 3. The City Manager' is authorized to transfer grant funds from the District 3 share of the City's API program in an amount not to exceed Three Hundred Twenty Thousand Four Hundred Seven Dollars and Forty -Seven Cents ($320,407.47) to reimburse the District 3 discretionary account for the Food Distribution Program. Section 4. This Resolution shall become effective immediately upon its adoption.
