Subject: Sole Source - Foster and Freeman Workstation
Purpose of Item:
The nature of this item is to authorize a Resolution of the Miami City Commission, by a
four -fifths (4/5ths) affirmative vote, pursuant to section 18-92 of the code of the City of
Miami, Florida, as amended (City Code"), after an advertised public hearing, ratifying,
authorizing, and confirming the City Manager's finding of a Sole Source; waiving the
requirements for competitive sealed bidding procedures and approving the purchase of
one (1) Foster and Freeman workstation ("workstation"), consisting of one (1) DCS®5
fingerprint imaging system and one (1) SUPERfume® fingerprint detection system, from
Foster & Freeman USA, Inc. ("F&F") for the Police Department ("Police"), for a purchase
amount of $93,881.35, to be allocated from, Special Revenue Account Number
12000.191006.664000.0.0, Award Number 2599, FY2019 Edward Byrne Memorial
Justice Assistance Grant Program subject to the availability of funds and budgetary
approvals, at time of need, authorizing the City Manager to negotiate and execute all
other documents, including any amendments, renewals, and extensions, subject to all
allocations, appropriations, and prior budgetary approvals, and in compliance with all
applicable provisions of the Code of the City of Miami, Florida, as amended ("City
Code"), including the City of Miami's procurement ordinance, anti -deficiency act, and
financial integrity principles, all as set forth in chapter 18 of the City Code, all in a form
acceptable to the City Attorney, and in compliance with all applicable laws, rules, and
regulations, as may be deemed necessary for said purpose.
Background of Item:
Police currently uses several methods for detecting fingerprints, close inspection, taping
and dusting. All of these methods rely on humans to perform the detections and then
capture the fingerprint digitally for comparison or matching with the Integrated
Automated Fingerprint Identification System ("IAFIS") operated by the Federal Bureau
of Investigation. F&F SUPERfume® automates much of this and reduces human error.
The F&F DOS® 5 is the most sophisticated fingerprint detection system on the market
today. The Workstation, which is comprised of two systems will increase accuracy and
throughput, which will result in crime getting resolved quicker. The imaging workstation
is modular which allows for modules to be added, on an as needed basis.

A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS (4/5THS)
AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), AFTER AN ADVERTISED
PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S SOLE SOURCE FINDINGS; WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDDING PROCEDURES; AUTHORIZING THE PURCHASE
OF ONE (1) FOSTER AND FREEMAN WORKSTATION CONSISTING OF ONE (1)
DCS®5 FINGERPRINT IMAGING SYSTEM AND ONE (1) SUPERFUME®
FINGERPRINT DETECTION SYSTEM FROM FOSTER AND FREEMAN USA, INC., A
FOREIGN PROFIT CORPORATION, FOR THE CITY OF MIAMI'S ("CITY") POLICE
DEPARTMENT FOR A PURCHASE AMOUNT OF NINETY THREE THOUSAND
EIGHT HUNDRED EIGHTY ONE DOLLARS AND THIRTY FIVE CENTS ($93,881.35);
ALLOCATING FUNDS FROM THE SPECIAL REVENUE ACCOUNT NO.

MEMORIAL JUSTICE ASSISTANCE GRANT PROGRAM, SUBJECT TO THE
AVAILABILITY OF FUNDS AND BUDGETARY APPROVALS AT THE TIME OF NEED;
FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE
ANY AND ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS,
RENEWALS, AND EXTENSIONS, SUBJECT TO ALL ALLOCATIONS,
APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, COMPLIANCE WITH ALL
APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING THE CITY'S
PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL
INTEGRITY PRINCIPLES, AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN
FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH ALL
APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED
NECESSARY FOR SAID PURPOSE.
WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as
amended ("City Code"), the Chief Procurement Officer ("CPO") has made a finding that Foster
and Freeman USA, Inc., a foreign profit corporation ("F&F"), is the sole source developer and
distributor of F&F software and hardware; and
WHEREAS, the City of Miami's ("City") Police Department ("Police") has a need for a
fingerprint imaging system that can enhance fingerprints and a fingerprint detection system that
can detect fingerprints in the field and digitally compare and match those fingerprints with the
Integrated Automated Fingerprint Identification System operated by the Federal Bureau of
Investigation; and
WHEREAS, the F&F Workstation ("Workstation") is a modular system that can
accommodate additional modules, if and when the need arises, consisting of one (1) DCS®5
Fingerprint Imaging System and one (1) SUPERfume® Fingerprint Detection System, the most
sophisticated fingerprint detection system currently on the market with a unique ability to
function in the field meeting the sole source criteria set forth in Section 18-92 of the City Code;
and
WHEREAS, the Workstation is currently in use at the United States Bureau of Alcohol,
Tobacco and Firearms and the United States Customs and Border Patrol; and
WHEREAS, the City's addition of this hardware and software equipment will allow for
more crimes to be solved more quickly and accurately; and
WHEREAS, the sole source findings of the CPO have been approved and adopted as
the sole source findings of the City Manager; and
WHEREAS, the City Manager and the CPO recommend that the requirements for
competitive sealed bidding procedures be waived and that the procurement of said systems be
approved; and
WHEREAS, following a published notice made fifteen (15) days prior to the award and
by a four -fifths (4/5th) affirmative vote, the City Manager seeks City Commission ratification,
approval, and confirmation of the sole source findings, waiver of competitive sealed bidding
procedures, and purchase of one (1) Workstation consisting of one (1) DCS®5 Fingerprint
Imaging System and one (1) SUPERfume® Fingerprint Detection System;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote and pursuant to Section 18-92 of the
City Code, after an advertised public hearing, the City Manager's sole source findings, waiver of
the requirements for competitive sealed bidding procedures, and authorization for the purchase
of one (1) Workstation consisting of one (1) DCS®5 Fingerprint Imaging System and one (1)
SUPERfume® Fingerprint Detection System from F&F for Police for a purchase amount of
Ninety Three Thousand Eight Hundred Eighty One Dollars and Thirty Five Cents ($93,881.35) is
hereby ratified, approved, and confirmed.
Section 3. Funds are allocated from Special Revenue Account No.
12000.191006.664000.0.0, Award No. 2599, Fiscal Year 2019 Edward Bryne Memorial Justice
Assistance Grant Program, subject to the availability of funds and budgetary approvals at the
time of need.
Section 4. The City Manager is further authorized' to negotiate and execute any and all
other documents, including any amendments, renewals, and extensions, subject to all
allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions
of the City Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial
Integrity Principles, as set forth in Chapter 18 of the City Code, in forms acceptable to the City
Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed
necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.
1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
