Subject: Extend COVID-19 Restaurant Recovery Program
Purpose of Item:
Resolution of the Miami City Commission to take any and all steps necessary, to
temporarily extend the Covid-19 Restaurant Recovery Program by repurposing portions
of City rights -of -way, including parking lanes and vehicular travel lanes, where deemed
feasible by the City's Department of Resilience and Public Works and the Miami Police
Department, to allow for increased pedestrian usage for residents and additional
sidewalk cafe seating to assist struggling businesses due to the COVID-19 crisis until
September 30, 2021.
Background of Item:
The City Manager is directed to take any and all steps necessary, to temporarily extend
the Covid-19 Restaurant Recovery Program by repurposing portions of City rights -of -
way, including parking lanes and vehicular travel lanes, where deemed feasible by the
City's Department of Resilience and Public Works and the Miami Police Department, to
allow for increased pedestrian usage for residents and additional sidewalk cafe seating
to assist struggling businesses due to the COVID-19 crisis until September 30, 2021.
The program extension will include the collection of permit fees for the use of sidewalks
and parking lanes following the rates established on City of Miami Code Section 54-224,
as well as fees due to the Miami Parking Authority for the use of parking lanes. The City
Manager is directed to collaborate with the Miami Parking Authority, the Miami Police
Department, and the Downtown Development Authority (DDA), the Coconut Grove
Business Improvement District, the Wynwood Business Improvement District, and any
other relevant and necessary entities to accomplish the goals set forth in this
Resolution.

A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO TAKE ANY AND ALL STEPS NECESSARY TO TEMPORARILY
EXTEND UNTIL SEPTEMBER 30, 2021 THE COVID-19 RESTAURANT RECOVERY
PROGRAM APPROVED BY RESOLUTION NO. R-20-0156 AND INCLUDE THE
COLLECTION OF FEES FOR USE OF SIDEWALKS AND PARKING LANES SIMILAR
TO THOSE FEES REQUIRED BY SECTION 54-224 OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, AS WELL AS THOSE FEES REQUIRED BY THE
MIAMI PARKING AUTHORITY FOR USE OF PARKING LANES; URGING MIAMI-
DADE COUNTY, THROUGH ITS DEPARTMENT OF TRANSPORTATION AND
PUBLIC WORKS, AND THE FLORIDA DEPARTMENT OF TRANSPORTATION TO
ASSIST THE CITY OF MIAMI IN ACCOMPLISHING SUCH A GOAL TO THE EXTENT
NECESSARY; DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED COPY
OF THIS RESOLUTION TO THE OFFICIALS NAMED HEREIN.
WHEREAS, under the provisions of law and Sections 252.31 - 252.60, Florida Statutes,
Mayor Francis X. Suarez ("Mayor") of the City of Miami ("City") declared on March 12, 2020 that
a State of Local Emergency exists within the City in response to the Novel Coronavirus
("COVID-19") pandemic; and
WHEREAS, in accordance with the provisions of Section 252.38(3)(a), Florida Statutes,
the Mayor has extended the State of Local Emergency for additional seven (7) day periods; and
WHEREAS, on May 20, 2020, the City Commission adopted Resolution No. R-20-0156
to assist businesses negatively affected by the COVID-19 pandemic by authorizing the City
Manager to identify feasible portions of City rights -of -way that may be repurposed for pedestrian
and sidewalk cafe usage and to take any and all steps necessary to effectuate such repurposing
until August 20, 2020 ("COVID-19 Restaurant Recovery Program"); and
WHEREAS, on July 23, 2020, the City Commission adopted Resolution No. R-20-0231,
which extended the COVID-19 Restaurant Recovery Program until January 31, 2021; and
WHEREAS, the City Commission wishes to extend the COVID-19 Restaurant Recovery
Program until September 30, 2021 subject to the payment of fees by applicants of the program
similar to those required by Section 54-224 of the Code of the City of Miami, Florida, as
amended ("City Code"), for use of the sidewalk and any applicable fees imposed by the Miami
Parking Authority for use of parking lanes;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The COVID-19 Restaurant Recovery Program created by Resolution No. R-
20-0156 adopted on May 14, 2020 and extended by Resolution No. R-20-0231 adopted on July
23, 2020, which provided for an expiration date the program of January 31, 2021, is hereby
extended until September 30, 2021 in order to continue to assist struggling businesses affected
by the COVID-19 pandemic with all other provisions of such prior Resolutions to remain the
same except as provided in Section 3 of this Resolution.
Section 3. The program extension is subject to the imposition of fees similar to those
required by Section 54-224 of the City Code for use of the sidewalk and any applicable fees
imposed by the Miami Parking Authority for use of parking lanes by any applicant.
Section 4. The City Manager is directed to collaborate with the Miami Parking Authority,
the Miami Police Department, and the Downtown Development Authority, the Coconut Grove
Business Improvement District, the Wynwood Business Improvement District, and any other
relevant and necessary entities to accomplish the goals set forth in this Resolution.
Section 5. The City Commission urges Miami -Dade County ("County"), through its
Department of Transportation and Public Works, and the Florida Department of Transportation
("FDOT") to assist the City to the extent necessary to accomplish the goals set forth in this
Resolution.
Section 6. The City Clerk is directed to transmit a certified copy of this Resolution to the
County Board of County Commissioners, the County Mayor, the Director of the County's
Department of Transportation and Public Works, and the FDOT District Six Secretary.
Section 7. The Resolution shall become effective immediately upon its adoption.
