This Letter of Intent is a part of, and supplements, the above referenced application for a
Comprehensive Plan Amendment to change the land use designation from Single Family
Residential ("SFR") to Restricted Commercial ("RC") on property located at 4214 S.W. 3rd
Street, Miami, Florida (the "Application"), and legally described as:
Lot 4R, Block 3 of the Revised Plat of Portions of Blocks 1,2 & 3, of West Flagler Center, Le
Jeune Addition, Plat' Book 41, Page 11, of the Public Records of Miami -Dade County, Florida
(the "Property").
Together with the Application Applicant has filed a companion application to rezone the
Property from T3-R to T4-L ("Rezoning Application").
Attached hereto as Exhibit A is a copy of the Revised Plat of Portions of Blocks 1, 2 & 3, of
West Flagler Center, Le Jeune Addition, Plat Book 41, Page 11, of the Public Records of Miami -
Dade County, Florida ("Plat").
The Property. The Property consists of an improved parcel of land composed of a platted lot
("Lot 4R"). See copy of survey for Lot 4R attached hereto as Exhibit B ("Survey"). For

purposes of this analysis the "Property" and "Lot 4R" are one in the same and these t
be used interchangeably herein.
According to the Miami -Dade County Property Appraiser's Web -Page ("Property Appraiser")
the Lot 4R is improved with a 1-story residential structure containing approximately 1610
adjusted square feet of living area. Also according to the Property Appraiser, the original
structure of approximately 1,083 sq. ft. was constructed in 1939, with smaller additions added in
1974 and 1975. According to the Survey, Lot 4R has a frontage on S.W. 3`d Street of 60' and a
depth of 107'.
Lot 4R is currently held under the same ownership with the west %Z of an adjacent platted lot
("West %2 of Lot 5R"). See copy of Warranty Deed attached hereto as Exhibit C.
Lot 4R and the West Y2 of Lot 5R have been held under joint ownership and conveyed together
in an unbroken chain of title since 1940. See attached copy of 1940 deed ("1940 Deed")
attached hereto as Exhibit D.
The West Y2 of Lot 5R measures 30' X 107'. Together, Lot 4R and the West '/2 of Lot 5R
measure 90' X 107'.
Only Lot 4R is the subject matter of the Application.
Land use and zoning designations of Lot 4R and surrounding properties. Attached as
Exhibits E-1 and E-2 are copies of aerial photographs depicting the zoning and land use
designations of Lot 4R, together with the designations of abutting, adjacent and surrounding
properties within a 300 foot radius of Lot 4R (the 300' Radius Aerial").
Lot 4R is located on the south side of S.W. 3rd Street and is approximately 100 feet west of S.W.
42nd Avenue (Le Jeune Road). The City of Miami Zoning Map (the "Zoning Map") designates
Lot 4R as T3-R, with a land use designation of Single Family Residential ("SFR").
Analysis of properties in the vicinity of Lot 4R. As stated above, to the immediate east of the
Lot 4R is the West '/2 of Lot 5R, which is jointly owned with Lot 4R. The West % of Lot 5R is
designated T-6-O on the Zoning Map and has a land use designation of Restricted Commercial
("RC").
It is Applicant's intent to extend the RC designation from the West %2 of Lot 5 west to
encompass the whole of Lot 4R. If approved, the Application would create uniformity between
the land use designations of Lot 4R and the West %2 of Lot 5R.

To the immediate east of the West Y2 of Lot 5R is a parcel composed of the East %2
together with Lot 6R (together, the "East Parcel"). The East Parcel is also designated T6-8- • m
the Zoning Map and has an RC land use designation. If approved, the Application would create
uniformity between the land use designations of Lot 4R, the West %2 of Lot 5R, the East '/2 of
Lot 5R and Lot 6R, which abuts S.W. 42°d Avenue (Le Jeune Road).
To the north of Lot 4R, across SW 3rd Street, are improved properties zoned T3-R and T4-L,
with SFR and Medium Density Multi Family Residential ("MDMFR") land use designations,
respectively.
To the west of Lot 4R are improved properties zoned T3-R with an SFR land use designation,
and to the south are improved properties zoned T3-R, with an SFR land use designation and T4-
L properties with an RC land use designation.
It is important to note that on the west side of Lejeune Road from approximately S.W. 2nd Street
to S.W. 3rd Street, all T6-8-O properties have a T4-L buffer between the T6-8-O properties and
the T3-R to the west, with one exception. That exception is between Lot 4R and the West Y2 of
Lot 5R. It should also be noted that the T4-L buffer has a land use designation of Medium
Density Multi Family Residential ("MDMFR"). The MDMFR designation does not abut or
encompass Lot 4R. Instead, Lot 4R abuts an SFR designation along the west side, but abuts the
RC land use designation along the east, northeast and southeast sides.
The predominant pattern for the properties on the west side of Le Jeune Road from S.W. 3rd
Street south of, and including, Lot 4R between S.W. 3rd Street and S.W. 7th Street is a T4-L
buffer between the T6-8-O and the T3-R and a land use designation of RC over both the T6-8-O
and T4-L, the same zoning and land use designations requested in the Application and the
Rezoning Application.
Therefore, if both the Application and Rezoning Application are approved, Lot 4R would be
totally compatible and consistent with the properties on the west side of Le Jeune Road from
S.W. 3rd Street south to S.W. 7th Street.
Justification for requested rezoning of Lot 4R from SFR to RC. The requested
Comprehensive Plan Amendment to change the land use designation of Lot 4R from SFR to RC
is consistent with the land use pattern on the west side of Le Jeune Road currently existing from
S.W. 3°d Street to S.W. 7th Street. In addition, as stated above, Lot 4R and the West'/2 of Lot 5R
have been conveyed together since 1940. Approval of the Application will establish a uniform
land use designation over both properties.

under one integrated plan of development with a single building spanning the boundary line
between the Property and the Adjacent Property ("Integrated Development"); and

and criteria shall apply to the Property:
a) The Property may be used for ingress and egress to the Integrated
Development, and may contain parking spaces screened from public view, as well
as a parking ramp leading to second and third floor parking area.
b) The Integrated Development may include a single building
structure spanning the boundary line between the Property and the Adjacent
Property, to create a single unified building structure.
c) No portion of a building on the Property shall be located closer
than 12 feet to the west boundary line of the Property. The area within this 12-
foot setback shall be open space and landscaping. No portion of a building on the
Property shall be located closer than 10 feet to the north boundary line or closer

e) Maximum number of stories of any structure located on the

3. Effective Date. This instrument shall constitute a covenant running with the title
to the Property and be binding upon Owner, its successors and assigns upon recordation in the
Public Records of Miami -Dade County, Florida. These restrictions shall be for the benefit of,
and a limitation upon, all present and future owners of the Property and for the public welfare.
4. Term of Covenant. This voluntary covenant on the part of the Owner shall
remain in full force and effect and shall be binding upon the Owner, its successors in interest and
assigns for an initial period of thirty (30) years from the date this instrument is recorded in the

ACKNOWLEDGEMENT BY APPLICANT
1. The Department of Resilience and Public Works, Transportation, Coordinated Review Committee and other City
and County agencies review zoning public hearing requests and provide input, which may affect the scheduling
and outcome of my hearing. These reviews may require additional hearings before other City and County
boards, which may result in the modification of plans, studies and/or the proffering of agreements to be
recorded. The submission and acceptance of a request for public hearing means that the application is ready to
be scheduled for public hearing. I am also aware that I must comply promptly with any City or County conditions
and notify the Hearing Boards (Hearing Boards) in writing if my public hearing application will be withdrawn.
2. Filing fees may not be the total cost of a hearing. Some requests require notices to be mailed to property
owners up to a mile from the subject property and I am responsible for paying the additional radius mailing
costs. In addition to mailing costs, I am responsible for additional fees related to application changes, plan
revisions, deferrals, re -advertising, etc. that may be incurred. I understand that fees must be paid promptly. The
only fees that will be refunded after the submission and acceptance of an application for public hearing has
occurred will be the surcharge fees related to appeals, as expressly listed in Chapter 62 of the City Code
(Code).
3. Requests for public hearing will be scheduled by the Hearing Boards in accordance with the scheduling timeline
set forth in the Code and the Zoning Ordinance of the City of Miami (Miami 21), as applicable. I must submit any
requests to reschedule, continue or defer my hearing date to the attention of the decision -making body for its
consideration and vote at the public hearing on which my application is scheduled to be heard. I understand that
any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, per instance, as per the Code.
4. Applicable Florida Building Code requirements, or other applicable requirements, may affect my ability to obtain
a building permit even if my zoning application is approved; and a building permit will probably be required. I am
responsible for obtaining any required permits and inspections for all structures and additions proposed, or built,
without permits. In addition, a Certificate of Use (C.U.) must be obtained for the use of the property after it has
been approved at a zoning public hearing. Failure to obtain the required permits and/or C.U., Certificates of
Completion (C.C.), or Certificate of Occupancy (C.O.) will result in an enforcement action against any occupant
and owner. Submittal of the zoning public hearing request may not forestall enforcement action against the
property.
5. If my request is denied, deferred, or otherwise not approved, I understand that I will not be reimbursed for any
fees paid.
6. Any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, per instance, as per the Code.
7. Any covenant to be voluntarily proffered must be submitted in word format to the Planning Department and to
the Office of the City Attorney through ePlan for review and comments from the Planning Department, Office of
the City Attorney, and any other City departments as deemed necessary. The covenant will be reviewed in
ePlan and the applicant will be notified of any necessary changes, corrections or comments through ePlan.
Once the covenant receives a recommendation of approval from the Planning department and as to legal form,
Hearing Boards staff will extract the approved covenant directly from ePlan to include as part of the agenda.
The applicant is responsible to submit to the Hearing Boards the signed covenant with a current Opinion of Title
no later than two (2) weeks prior to the initial public hearing. I understand that any requests by the applicant to
reschedule, continue or defer the hearing date that are granted shall incur a $1,000.00 fee, per instance, as per
the Code.

Lobbyists shall be required to state the existence of any direct or indirect business association, partnership, or
financial relationship with the Mayor, any member of the City Commission, any member of a City board, the
City Manager or a member of the City staff before whom he/she lobbies or intends to lobby. Attach separate

Lobbyists, as defined in City Code Section 2-653, shall pay an annual registration fee of $525.00, plus $105.00 for
each principal represented for each issue lobbied on behalf of any one principal. Each issue associated with lobbying
shall be described with as much detail as is practical. The City Clerk, or the City Clerk's designee, shall reject any
registration statement that does not provide a clear description of the specific issue on which such lobbyist has been
retained to lobby or if any section of this form is left blank. Regardless of the date of the annual registration, all
lobbyists' annual registrations shall expire December 31 of each calendar year and shall be renewed on a calendar
year basis.
Each lobbyist shall, within sixty (60) days after registering as a lobbyist, submit to the Office of the City Clerk a
certificate of completion of an ethics course offered by the Miami -Dade County Commission on Ethics & Public
Trust ("Ethics Commission"). Lobbyists who have completed the initial ethics .course mandated by the preceding
sentence and have continuously registered as a lobbyist thereafter shall be required to complete a refresher ethics
course offered by the Ethics Commission every two (2) years. Each lobbyist who has completed a refresher ethics
course shall submit a certificate of completion within sixty (60) days after registering as a lobbyist.

ACKNOWLEDGEMENT BY APPLICANT
1. The Department of Resilience and Public Works, Transportation, Coordinated Review Committee and other City
and County agencies review zoning public hearing requests and provide input, which may affect the scheduling
and outcome of my hearing. These reviews may require additional hearings before other City and County
boards, which may result in the modification of plans, studies and/or the proffering of agreements to be
recorded. The submission and acceptance of a request for public hearing means that the application is ready to
be scheduled for public hearing. I am also aware that I must comply promptly with any City or County conditions
and notify the Hearing Boards (Hearing Boards) in writing if my public hearing application will be withdrawn.
2. Filing fees may not be the total cost of a hearing. Some requests require notices to be mailed to property
owners up to a mile from the subject property and I am responsible for paying the additional radius mailing
costs. In addition to mailing costs, I am responsible for additional fees related to application changes, plan
revisions, deferrals, re -advertising, etc. that may be incurred. I understand that fees must be paid promptly. The
only fees that will be refunded after the submission and acceptance of an application for public hearing has
occurred will be the surcharge fees related to appeals, as expressly listed in Chapter 62 of the City Code
(Code).
3. Requests for public hearing will be scheduled by the Hearing Boards in accordance with the scheduling timeline
set forth in the Code and the Zoning Ordinance of the City of Miami (Miami 21), as applicable. I must submit any
requests to reschedule, continue or defer my hearing date to the attention of the decision -making body for its
consideration and vote at the public hearing on which my application is scheduled to be heard. I understand that
any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, per instance, as per the Code.
4. Applicable Florida Building Code requirements, or other applicable requirements, may affect my ability to obtain
a building permit even if my zoning application is approved; and a building permit will probably be required. I am
responsible for obtaining any required permits and inspections for all structures and additions proposed, or built,
without permits. In addition, a Certificate of Use (C.U.) must be obtained for the use of the property after it has
been approved at a zoning public hearing. Failure to obtain the required permits and/or C.U., Certificates of
Completion (C.C.), or Certificate of Occupancy (C.O.) will result in an enforcement action against any occupant
and owner. Submittal of the zoning public hearing request may not forestall enforcement action against the
property.
5. If my request is denied, deferred, or otherwise not approved, I understand that I will not be reimbursed for any
fees paid.
6. Any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, per instance, as per the Code.
7. Any covenant to be voluntarily proffered must be submitted in word format to the Planning Department and to
the Office of the City Attorney through ePlan for review and comments from the Planning Department, Office of
the City Attorney, and any other City departments as deemed necessary. The covenant will be reviewed in
ePlan and the applicant will be notified of any necessary changes, corrections or comments through ePlan.
Once the covenant receives a recommendation of approval from the Planning department and as to legal form,
Hearing Boards staff will extract the approved covenant directly from ePlan to include as part of the agenda.
The applicant is responsible to submit to the Hearing Boards the signed covenant with a current Opinion of Title
no later than two (2) weeks prior to the initial public hearing. I understand that any requests by the applicant to
