HomeMy WebLinkAboutPZAB (7678) ResolutionCity of Miami PZAB Resolution Enactment Number: PZAB-R-20-033 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 7678 Final Action Date: 9/16/2020 A RESOLUTION OF THE CITY OF MIAMI PLANNING, ZONING AND APPEALS BOARD ("PZAB"), WITH ATTACHMENT(S), RECOMMENDING APPROVAL OF AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION FROM "T6-8-L", URBAN CORE TRANSECT ZONE - LIMITED, TO "T6-8-O", URBAN CORE TRANSECT ZONE - OPEN, FOR THE PROPERTIES GENERALLY LOCATED AT 615 NORTHWEST 4 AVENUE, 537 NORTHWEST 4 AVENUE, 365 NORTHWEST 6 STREET, 353 NORTHWEST 6 STREET, 343 NORTHWEST 6 STREET, 335 NORTHWEST 6 STREET; 348 NORTHWEST 6 STREET, 330 NORTHWEST 6 STREET, 350 NORTHWEST 6 STREET, 358 NORTHWEST 6 STREET, 364 NORTHWEST 6 STREET; 531 NORTHWEST 3 COURT, 540 NORTHWEST 3 COURT, 534 NORTHWEST 3 COURT, 530 NORTHWEST 3 COURT, AND 590 NORTHWEST 3 COURT, MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the real property located at approximately 615 Northwest 4 Avenue, 537 Northwest 4 Avenue, 365 Northwest 6 Street, 353 Northwest 6 Street, 343 Northwest 6 Street, 335 Northwest 6 Street, 348 Northwest 6 Street, 330 Northwest 6 Street, 350 Northwest 6 Street, 358 Northwest 6 Street, 364 Northwest 6 Street; 531 Northwest 3 Court, 540 Northwest 3 Court, 534 Northwest 3 Court, 530 Northwest 3 Court, and 590 Northwest 3 Court, Miami, Florida, as more particularly described in the attached and incorporated Exhibit "A", ("Property") is currently zoned "T6-8-L" Urban Core Transect Zone -Limited; and WHEREAS, Make -a -Wish Foundation of Southern Florida, Inc. ("Applicant") has submitted a request to the City of Miami ("City") to change the zoning classification from "T6-8- L", Urban Core Transect Zone — Limited, to "T6-8-O", Urban Core Transect Zone — Open on the Zoning Atlas of Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended, ("Miami 21 Code"); and WHEREAS, the Property is an assemblage of sixteen (16) parcels of approximately 71,191 square feet, or approximately 1.63 acres plus, and includes a right-of-way (Maiden Lane) of approximately 3,000 square feet that runs north to south between Northwest 1 Street to the center of the city block; and WHEREAS, both the existing T6-8-L and the proposed T6-8-O Transect Zones are consistent with the Property's Restricted Commercial Future Land Use ("FLU") designation in the Miami Comprehensive Neighborhood Plan (MCNP"), and thus a Future Land Use Map ("FLUM") amendment is not required for the requested rezone; and City of Miami Page 1 of 3 File ID: 7678 (Revision: A) Printed On: 9/21/2020 WHEREAS, T6-8-O is found in the south of the Property site and in its general vicinity; and WHEREAS, the Applicant's letter of intent ("LOI") states they have an interest in eliminating the restriction that limits Office on the Property; and WHEREAS, this area can help fulfill the MCNP, Policies LU-1.1.10 and TR-2.1.3, by promoting redevelopment in close proximity of transit corridors, and Metrorail and Metromover stations; and WHEREAS, Planning, Zoning and Appeals Board ("PZAB") has considered the need and justification for the proposed change, including changing and changed conditions that make the passage of the proposed change necessary; and WHEREAS, PZAB has considered the goals, objectives, and policies of the MCNP, the Miami 21 Code, and all other City regulations; and WHEREAS, Miami 21 encourages density bonuses in Transit Oriented Developments ("TODs") and in Transit Corridors to alleviate the crisis in affordable housing that is affecting the City residents and to encourage development near transit; and WHEREAS, the Property lies within a TOD, qualifying it to participate in the Affordable and Attainable Mixed Income Public Benefits Program; and WHEREAS, the proposed zoning change is deemed appropriate in light of the intent of the Miami 21 Code and particularly in relation to the effects on adjoining properties; and WHEREAS, PZAB has considered the goals, objectives, and policies of the MCNP, the Miami 21 Code, and all other City regulations; and WHEREAS, PZAB has considered the need and justification for the proposed change, including changing and changed conditions that make the passage of the proposed change unnecessary; and WHEREAS, the proposed change maintains the goals of the Miami 21 Code to preserve neighborhoods and provide transitions in intensity and building height; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The PZAB recommends that the City Commission amend the Zoning Atlas of the Miami 21 Code, by changing the zoning classification from "T6-8-L" Urban Core Transect Zone -Limited to "T6-8-O" Urban Core Transect Zone — Open for the properties generally located at 615 Northwest 4 Avenue, 537 Northwest 4 Avenue, 365 Northwest 6 Street, 353 Northwest 6 Street, 343 Northwest 6 Street, 335 Northwest 6 Street, 348 Northwest 6 Street, 330 Northwest 6 Street, 350 Northwest 6 Street, 358 Northwest 6 Street, 364 Northwest 6 Street; 531 Northwest 3 Court, 540 Northwest 3 Court, 534 Northwest 3 Court, 530 Northwest City of Miami Page 2 of 3 File ID: 7678 (Revision: A) Printed On: 9/21/2020 3 Court, and 590 Northwest 3 Court, Miami, Florida, as more particularly described in "Exhibit A", attached and incorporated.
