AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY
CHANGING THE ZONING CLASSIFICATION FROM "T6-8-L", URBAN CORE
TRANSECT ZONE - LIMITED, TO "T6-8-O", URBAN CORE TRANSECT ZONE -
OPEN", FOR THE PROPERTIES GENERALLY LOCATED AT 615
NORTHWEST 4 AVENUE, 537 NORTHWEST 4 AVENUE, 365 NORTHWEST 6
STREET, 353 NORTHWEST 6 STREET, 343 NORTHWEST 6 STREET, 335
NORTHWEST 6 STREET, 348 NORTHWEST 6 STREET, 330 NORTHWEST 6
STREET, 350 NORTHWEST 6 STREET, 358 NORTHWEST 6 STREET, 364
NORTHWEST 6 STREET, 531 NORTHWEST 3 COURT, 540 NORTHWEST 3
COURT, 534 NORTHWEST 3 COURT, 530 NORTHWEST 3 COURT, AND 590
NORTHWEST 3 COURT, MIAMI, FLORIDA, ALL AS MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED; MAKING
FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Planning, Zoning and Appeals Board, at its meeting on September 16,
2020, following an advertised public hearing, adopted Resolution No. PZAB-R-20-033 by a vote
of eleven to zero (11-0), Item No. PZAB.3, recommending approval of the proposed zoning
change as stated herein; and
WHEREAS, the real properties located at approximately 615 Northwest 4 Avenue, 537
Northwest 4 Avenue, 365 Northwest 6 Street, 353 Northwest 6 Street, 343 Northwest 6 Street,
335 Northwest 6 Street, 348 Northwest 6 Street, 330 Northwest 6 Street, 350 Northwest 6
Street, 358 Northwest 6 Street, 364 Northwest 6 Street, 531 Northwest 3 Court, 540 Northwest
3 Court, 534 Northwest 3 Court, 530 Northwest 3 Court, and 590 Northwest 3 Court, Miami,
Florida, all as more particularly described in Exhibit "A", attached and incorporated (collectively,
"Property"), are currently zoned "T6-8-L", Urban Core Transect Zone - Limited; and
WHEREAS, Make -a -Wish Foundation of Southern Florida, Inc. ("Applicant") has
submitted a request to the City of Miami ("City") to change the zoning classification from "T6-8-
L", Urban Core Transect Zone — Limited, to "T6-8-O", Urban Core Transect Zone — Open, on the
Zoning Atlas of Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as
amended ("Miami 21 Code"); and
WHEREAS, the Property is an assemblage of sixteen (16) parcels of approximately
71,191 square feet, or approximately 1.63 acres plus, with a right-of-way (Maiden Lane) of
approximately 3,000 square feet running north to south from Northwest 6 Street to the center of
the City block; and

WHEREAS, both the existing "T6-8-L," Urban Core Transect Zone — Limited, and the
proposed "T6-8-O," Urban Core Transect Zone — Open, are consistent with the Property's
Restricted Commercial Future Land Use designation in the Miami Comprehensive
Neighborhood Plan ("MCNP") and thus a Future Land Use Map amendment is not required for
the proposed zoning change; and
WHEREAS, "T6-8-O," Urban Core Transect Zone — Open, is found in the southwest
portion of the southern City block of the Property site and in its general vicinity; and
WHEREAS, the Applicant's letter of intent states that they have an interest in eliminating
the restriction that limits Office Use on the Property; and
WHEREAS, this area can help fulfill MCNP Policies LU-1.1.10 and TR-2.1.3 by
promoting redevelopment in close proximity of Transit Corridors, Metrorail stations, and
Metromover stations; and
WHEREAS, the Miami 21 Code encourages Density bonuses in Transit Oriented
Developments ("TOD") and in Transit Corridors to alleviate the crisis in Affordable Housing that
is affecting City residents and encourages development near transit; and
WHEREAS, the Property lies within a TOD, qualifying it to participate in the Affordable
and Attainable Mixed Income Public Benefits Program; and
WHEREAS, the City Commission has considered the goals, objectives, and policies of
the MCNP, the Miami 21 Code, and all other City regulations; and
WHEREAS, the City Commission has considered the need and justification for the
proposed zoning change, including changing and changed conditions that make the passage of
the proposed zoning change unnecessary; and
WHEREAS, the proposed zoning change maintains the goals of the Miami 21 Code to
preserve neighborhoods and provide transitions in intensity and building height;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby amends the Zoning Atlas of the Miami 21 Code
by changing the zoning classification from "T6-8-L", Urban Core Transect Zone - Limited, to "T6-
8-0", Urban Core Transect Zone — Open, for the Property, as more particularly described in
Exhibit "A", attached and incorporated.
Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective ten (10) days after adoption.'
1 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
