According to the Sketch, the Maiden Lane consists of approximately 3,000 +/- square feet of land. Please note, the Maiden Lane is a public right of way and is not privately owned. As such, the Maiden Lane is not included in the aggregate Subject Properties subject to the rezoning request for this Application. Additionally, there are no plans to vacate the Maiden Lane at this time. The Subject Properties will be utilized as Wish House, an Office use, which will further the mission of Make a Wish while also creating jobs in the neighborhood. II. ANALYSIS FOR REZONING Under Miami 21, the current zoning designation of the Subject Properties are T6-8-Limited (L). The Applicant requests to rezone the Subject Properties to the next Building Function category within the same Transect Zone, T6-8-Open (0), pursuant to the successional zoning requirements of Article 7, Section 7.1.2.8 of Miami 21. The proposed rezoning will facilitate the creation of an office development for Make a Wish of Southern Florida and in close proximity to public transit without increasing Density, Intensity, or building height. The proposed rezoning will allow the development of a Wish House which will benefit the community while serving as a job creator for the area. The Subject Properties location within the TOD is ideal for an Office Use as the various modes of mass transit will allow employees to get to and from the Subject Properties without the need for automobile reliance. For the reasons outlined below, the proposed rezoning is appropriate for the Subject Properties, meets the criteria established in Article 7, Section 7.1.2.8 of Miami 21 and, therefore, should be approved. 1. The proposed rezoning is compatible with the surrounding zoning districts and provides a transition in density and intensity which is consistent with the goals of Miami 21. Article 7, Section 7.1.2.8(f)(2) of Miami 21 requires zoning changes to maintain the goals of Miami 21 and to provide transitions in intensity and Building Height. The area located South of the Subject Properties consists primarily of Office, Civic, and Residential uses located along the NW 5th Street corridor. The properties located along NW 5th Street (immediately abutting the Subject Properties to the South) are zoned T6-8-O and are improved with multistory commercial, office, and institutional uses many with surface parking facilities. Additionally, the Subject Properties are located within a Transit Oriented Development (TOD), as it is located within less than half a mile from the Historic Overtown/Lyric Theater Metrorail Station, a major transit hub and employment center, which provides convenient access to the most important recreational, employment, and civic centers in Miami -Dade County, including the Dadeland area, Downtown Miami, Civic Center/Health District, and Miami International Airport. The Historic Overtown/Lyric Theater Metrorail Station is surrounded by properties zoned T6-24A-O, T6-36A-O, CI, T6-12-0, and T6-60A-O. The Subject Properties are also located within the Transit Corridor created by NW 2nd Avenue and is serviced by multiple City of Miami Trolley routes as well as multiple Miami -Dade County Metrobus routes. This area has recently experienced a boom in Office use development. As the mass transit options continue to be centralized near the Subject Properties, the area will continue to be an ideal location for Office space. By rezoning from T6-8-L to T6-8-O, the Subject Properties will be allowed expanded Uses by removing the limitations on Commercial and Office Use, which will allow for the Make a Wish Foundation of Southern Florida to develop an Office Use at the Subject Properties. The area located West of the Subject Properties consists primarily of multi -family residential structures. The proposed rezoning to T6-8-O is consistent with these existing and permitted uses. The proposed rezoning does not increase the Density, Intensity, or building height permitted at the Subject Properties, it merely permits expanded Uses to support Office development as permitted and existing in the areas surrounding the Subject Properties. 2. An analysis of the development and use patterns for the vicinity of the Subject Properties supports the proposed rezoning to T6-8-O. The Subject Properties are located adjacent to NW 6th Street, which provides direct access into Downtown Miami under I-95, and less than a half a mile away from the Historic Overtown/Lyric Theater Metrorail station. The area surrounding the Subject Properties consists of multiple zoning designations including T5-L, T6-12-0, CI, and T6-8-O as depicted in the zoning map provided above. The analysis below considers related properties within a one half (1/2) mile radius of the Subject Properties pursuant to Article 7, Section 7.1.2.8(2)(g) of Miami 21. The City's growth and evolution over time inevitably require changes to the existing zoning. With the rapid expansion and development of the area surrounding the Historic Overtown/Lyric Theater Metrorail Station and Downtown Miami/Southeast Overtown in general, NW 6th Street has become a primary gateway to this area and a vital corridor. Most of this growth can be attributed to the City's efforts to encourage development along transit stations and Transit Corridors. The rapid growth of the area surrounding the Subject Properties supports and demands the zoning change to the next higher transect zone building function category (T6-8-O). The character of the NW 6th Street corridor has evolved to consist of Office uses and various nonprofit centered uses as discussed above. The Subject Properties, with its convenient access to public transit options and proximity to major educational, employment and entertainment centers, is uniquely positioned to provide the Office options the area needs to continue its remarkable growth. 4. The proposed rezoning will permit a cohesive development of the Subject Properties in accordance with the guiding principles and goals of Miami 21. CONCLUSION In light of the foregoing, the proposed rezoning of the Subject Properties from T6-8-L to T6-8-O is consistent with the scale and character of the structures and uses located in the vicinity of the Subject Properties and will contribute to the continued revitalization of the neighborhood. The proposed rezoning will allow the Subject Properties to be transformed from vacant and underutilized land into an Office use for the Make a Wish Foundation within the Transit Oriented Development that meets the intent and goals of Miami 21 while maintaining the appropriate transitions in Density and Building Height. The proposed rezoning does not increase the Subject Properties' development capacity and maintain the existing Density, building height, Intensity, and other development thresholds of the existing T6-8 Transect Zone. The Subject Properties are ideally suited for the envisioned Office development and employment center given its location within a TOD. The proposed rezoning will permit a cohesive development of the Subject Properties in accordance with the guiding principles and goals of Miami 21. CONCLUSION In light of the foregoing, the proposed rezoning of the Subject Properties from T6-8-L to T6-8-O is consistent with the scale and character of the structures and uses located in the vicinity of the Subject Properties and will contribute to the continued revitalization of the neighborhood.
