The nature of this item is to authorize a resolution of the Miami City Commission,
accepting the bid received on August 25, 2020, pursuant to Invitation For Bid ("IFB") No.
1211389, from the lowest responsive and responsible Bidder, 441 Cycle Shop, Inc., a
Florida Incorporated Company, d/b/a BMW Motorcycles of Fort Lauderdale ("BMW
Motorcycles Fort Lauderdale") for the purchase of BMW Police Motorcycle(S), on an as
needed basis, for the City of Miami's ("City") Police Department ("Police"), for an initial
term of three (3) years, with the option to renew for two (2) additional one (1) year
periods; allocating funds from Capital Project Number 40-B203218, and other sources
of funds, subject to the availability of funds and budgetary approval at the time of need;
Authorizing the City Manager to negotiate and execute all other documents, including
any amendments, renewals, and extensions, subject to allocations, appropriations and
budgetary approval having been previously made, and in compliance with applicable
provisions of the Code of the City of Miami, Florida, as amended, ("City Code"),
including, the City of Miami's Procurement Ordinance, Anti -Deficiency Act, and Financial
Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable
to the City Attorney, and in compliance with applicable regulations, as may be
necessary for said purpose.
Background of Item:
Police has identified a need to replace the Harley Davidson Motorcycles that are
currently leased and must be returned by April 2021. On July 29, 2020, the Department
of Procurement ("Procurement"), on behalf of Police, issued IFB No. 1211389, BMW
Police Motorcycle(s). As required by the Procurement Code, the IFB was advertised
and issued on-line. On August 25, 2020, at the bid closing two (2) bids were received.
The bids were evaluated and tabulated following the guidelines published in the
Solicitation. Procurement is recommending award to BMW Motorcycles Fort
Lauderdale, which met all requirements, per the bid specifications, and is the lowest
responsive and responsible Bidder. The estimated contract amount is $$191,800.00
annually (approximately $959,000.00 for all five (5) years).

A RESOLUTION OF THE MIAMI CITY COMMISSION ACCEPTING THE BID
RECEIVED ON AUGUST 25, 2020, PURSUANT TO INVITATION FOR BID NO.
1211389, FROM THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER, 441
CYCLE SHOP, INC., A FLORIDA PROFIT CORPORATION D/B/A BMW
MOTORCYCLES OF FORT LAUDERDALE, FOR THE PURCHASE OF POLICE
MOTORCYCLES, MODEL NO. R1250RT-P OR NEWER, AND THE INSTALLATION
OF ANCILLARY ACCESSORIES AND EQUIPMENT, ON AN AS NEEDED BASIS,
FOR THE CITY OF MIAMI'S ("CITY") POLICE DEPARTMENT FOR AN INITIAL TERM
OF THREE (3) YEARS WITH THE OPTION TO RENEW FOR TWO (2) ADDITIONAL
ONE (1) YEAR PERIODS; ALLOCATING FUNDS FROM CITY CAPITAL PROJECT
NO. 40-B203218 AND OTHER LEGALLY AVAILABLE SOURCES OF FUNDS,
SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT
THE TIME OF NEED; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE ANY AND ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS,
RENEWALS, AND EXTENSIONS, SUBJECT TO ALL ALLOCATIONS,
APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, COMPLIANCE WITH ALL
APPLICABLE PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED ("CITY CODE'), INCLUDING THE CITY'S PROCUREMENT ORDINANCE,
ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET
FORTH IN CHAPTER 18 OF THE CITY CODE, IN FORMS ACCEPTABLE TO THE
CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES,
AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE.
WHEREAS, the City of Miami's ("City") Police Department ("Police") has a need to
replace motorcycles which are currently leased and must be returned by April 2021; and
WHEREAS, the current motorcycle contract is non-renewable; and
WHEREAS, BMW motorcycles have been evaluated and have been deemed to have a
higher performance rating, especially as it pertains to braking, handling, and safety, than any
comparable motorcycles; and
WHEREAS, on July 29, 2020, the City's Procurement Department ("Procurement")
issued Invitation for Bids ("IFB") No. 1211389 to establish a contract for the purchase of Police
motorcycles, on an as needed basis, for an initial term of three (3) years with the option to
renew for two (2) additional one (1) year periods; and
WHEREAS, on August 25, 2020, Procurement received a bid from 441 Cycle Shop, Inc.,
a Florida profit corporation d/b/a BMW Motorcycles of Fort Lauderdale ("BMW Motorcycles Fort
Lauderdale"), the lowest responsive and responsible bidder pursuant to IFB No. 1211389;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The bid received on August 25, 2020 pursuant to IFB No. 1211389 from the
lowest responsive and responsible bidder, BMW Motorcycles Fort Lauderdale, for the purchase
of Police motorcycles, Model No. R1250RT-P or newer, and the installation of ancillary
accessories and equipment, on an as needed basis, for Police for an initial term of three (3)
years with the option to renew for two (2) additional one (1) year periods is accepted.
Section 3. Funds are allocated from City Capital Project No. 40-B203218 and other
legally available sources of funds, subject to the availability of funds and budgetary approval at
the time of need.
Section 4. The City Manager is authorized' to negotiate and execute any and all other
documents, including any amendments, renewals, and extensions, subject to all allocations,
appropriations, prior budgetary approvals, compliance with all applicable provisions of the Code
of the City of Miami, Florida, as amended ("City Code"), including the City's Procurement
Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18
of the City Code, in forms acceptable to the City Attorney, and in compliance with all applicable
laws, rules, and regulations, as may be deemed necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.
