WHEREAS, due to the resignation of Commissioner Keon Hardemon ("Hardemon") effective November 17, 2020, a vacancy exists in the District 5 Commission seat in the City of Miami; and WHEREAS, pursuant to Section 12 of the Charter of the City of Miami, Florida, as amended, ("City Charter"), a vacancy on the City Commission caused by resignation shall be filled within ten (10) days after such vacancy occurs by a majority of the remaining City Commissioners or, if the City Commissioners fail or refuse to fill such vacancy within ten (10) days after it occurs, then a special election shall be called to fill the vacancy; and WHEREAS, Section 12 of the City Charter further provides that the person appointed to the vacancy must meet the qualifications of the office as required in Section 4 of the City Charter and that the term of office of the person so appointed shall be until the successor in office is elected and qualified at whichever of the following occurs first: (1) the odd -year general municipal election for Mayor and City Commissioners held pursuant to Section 4 of the City Charter or (2) the even -year State of Florida general election, at which election national, state, and county offices are filled; and WHEREAS, pursuant to Section 4 of the City Charter, the next general municipal election for Mayor and City Commissioners will be held on November 2, 2021; and WHEREAS, it is the desire of the City Commission to fill the vacancy by appointment in accordance with the provisions of Section 12(a) of the City Charter; and WHEREAS, at a publicly noticed hearing, the City Commission received comments from the public including all interested individuals interested in being appointed to fill the vacancy; and WHEREAS, Jeffrey Watson indicated his desire to be appointed to fill the vacancy; and WHEREAS, Mr. Watson pledged to the City Commission that he will not seek election for the District 5 City Commission seat at the next general municipal election in November 2021; and WHEREAS, based upon all comments received including comments from all interested individuals to fill the vacancy and based upon Mr. Watson's pledge to not see election in November 2021, the City Commission has determined that Mr. Watson is the most qualified individual to fill the vacancy for the District 5 Commission seat; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Mr. Watson, subject to meeting all required qualifications to fill the vacancy, is appointed as a member of the City Commission, District 5, to fill the vacancy created by the resignation of Keon Hardemon to serve until the next general municipal election in November 2021.
