Ms. Lorenzo,
Your e-mail was referred to me by Mr. K8e|vvani for response. By this email we confirm the
understanding that the deferred item of RFP award is scheduled for the 12/13 meeting. Asyou know,
Rickenbacker Marina Inc. agreed to make additional payments asset forth by its legal counsel in an
open, public commission meeting, and we have honored and will continue to honor those
commitments. To my knowledge, the additional new terms set forth in the proposed draft settlement
agreement were not discussed or negotiated, We therefore see no need for an Amendment to the
Settlement Agreement which would modify other Settlement Agreement provisions by including terms
that were not a part of those discussions.
