(the "Applicant") is proposing to close and vacate the Streets, (NE 5th Avenue, NE 6th Avenue, NE 7th Avenue, NE 23rd Terrace, and NE 24th Street) rights -of -way (collectively the "Streets") through the replatting process. This is part of the proposed Island Bay Tentative Plat #1893-H (Eighth resubmittal) (the "T-Plat") that was approved by the Plat and Street Committee at its meeting on June 9, 2020. B. RECOMMENDATION Based on the Plat and Street Committee's findings, conditions of approval, and staff's analysis, the Planning Department recommends the Approval of the Applicant's request to close and vacate from public use the Streets (rights of way), as listed below: 1. BACKGROUND The Property The proposed T-Plat also entails the "Property", which once consisted of a variety of residential unit types consisting of "Single -Family Residential", "Two Family Residential", and "Single -Family Medium Density" homes. However, through the Applicant's development program, most of the residential buildings with the boundary of this property have been either demolished or slated to be demolished in the foreseeable future. The property is depicted below, Figure 1: Figure 1: the `Property" boundary (yellow outline) Approlimate SsTeeth Location The T-Plat proposes to unify the Property into two platted tracts described as Tract A and Tract B through the City's replatting process. Tract A occupies the eastern portion of the Property, contains approximately 3.86 acres of land, and is approximately 480 lineal feet long along Biscayne Bay. Vacation and Closure request With the demolition and clearance of all the residential buildings within this property, the Applicant is requesting to close and vacate from public use, the Streets that are generally bounded by NE 23rd Street to the south, NE 24th Street to the north, NE 4th Avenue to the west, and Biscayne Bay to the east. The total square footage and acreage of these areas proposed to be vacated and closed is approximately 36,798 square feet or 0.845 acre, please refer to Table 1 — Summary of Island Bay Street Closures and Dedications and Table 2 — Additional Dedications of Public Easements to the City of Miami (the "City"). Specifically, the averag Pz-19-2so1 recorded plats for the Applicant's four parcels (1-4) is 1935, based on the Applicant's T-Plat. 9��08/07/20 through this T-Plat, is proposing to unify and modernize this property that will benefit both pede vehicular circulation and allow for an orderly division of land that will ensure proper legal conformity subdivision and zoning regulations. This will be done through the replatting process pursuant to the T-Plat, which allows for the creation of two new, separate tracts: Tract "A": 168,262 SQ. FT. (3.86 acres) and Tract "B": 58,877 SQ. FT. (1.35 acres). Plat and Street Committee Staff paraphrased f the key points made by the Chair of the City's Plat and Street Committee, Abraham Bachtiar, P.E, Professional Engineer III, Supervisor - Development and Roadway Plans Section, City of Miami - Department Resilience and Public Works, in explaining the evolution of this application culminating through a final, eighth submittal, please see below p: 1. The Plat and Street Committee met on February 7, 2019 and approved the Applicant's proposed T- Plat involving the closure and vacation of the Streets' right of way/streets (not easements). 2. The Plat and Street Committee made those recommendations to the PZAB pursuant to the standard four questions from Section 55-15(c) of the City Code of Ordinances. 3. Due to recent revisions made to the Applicant's initially approved T-Plat concerning to the mitigation of those right of way vacations/closures, the Applicant was required to come back to the Plat and Street for the eighth time. 4. The Plat and Street Committee met on June 9, 2020, and all members reviewed and approved, unanimously, these revisions, with a follow-up Plat and Street Committee Letter issued by the Department of Resilience & Public Works on June 15, 2020. Per Section 55-15(c) of the City Code of Ordinances, the Plat and Street Committee's considerations are with respect to the four items below in making their recommendations to the Planning, Zoning, and Appeals Board (PZAB). Page7of 11 Criteria 1: Is it in the public interest, or would the general public benefit from the vacation of the rights of w or easement? Plat and Street Committee Finding 1: The three north -south oriented streets (NE 5th Ave, NE 6th Ave, and NE 7th) proposed to be vacated and closed only serve one city block. The proposed T-Plat has two north -south public ingress/egress easements, which will result in improved pedestrian and vehicular circulation for this area. The two east -west streets (NE 23 St and NE 24th St) proposed to be closed and vacated, through this T- Plat, dead-end at Biscayne Bay. In terms of pedestrian accessibility to civic spaces, the general public will benefit from the construction of a public 560-foot Bay Walk and the creation of a recreational "play street" area at the end of NE 23 St. Planning Department Analysis 1 The proposed T-Plat has been updated to be under Miami 21 standards, goals, and objectives. Miami 21, Article 2, Section 2.1.2(3) promotes increased access to the natural environment through the civic spaces, such as the Baywalk, which is a publicly accessible pedestrian corridor for walking and biking. The Applicant's proposed T-Plat proposes to significantly extend the Baywalk and to add a publicly accessible "Play Street" at the terminus of NE 23rd St. Planning Department Finding 1: Miami 21 It is consistent with Miami 21, Article 2, Section 2.1.2(3) Miami Neighborhood Comprehensive Plan (MNCP) Policy TR-1.1.6: The City will design and promote transportation facilities that are consistent with adjacent land uses, preserve natural features, protect historic and cultural resources, and enhance community appearance and vibrancy. Criteria 2: Is the general public no longer using the rights of way or easement, including public service vehicles such as trash and garbage trucks, police, fire, or other emergency vehicles? Plat and Street Committee Finding 2: Public service vehicles use the streets that are proposed to be vacated. However, public ingress/egress easements that are being proposed by this T-Plat will minimize the impact on the circulation and accessibility of public service vehicles. PZ-19-2601 ,44 A.`�4 08/07/20 /\1 RFV I EW C° Page 8 of 11 Plat and Street Committee Finding 3: The response time for police, fire, and emergenc a services will be enhanced by having fewer buildi (points) to serve. Before this proposed T-Plat, th- subject property contained approximately 40 residential properties and three multi -family along J' Biscayne Bay. This proposed T-Plat proposes only three destination points with modernized fire prevention features. Planning Department Finding 3: Planning Department defers to the Plat and Street Committee's findings Criteria 4: Would the vacation and closure of the rights of way or easements have a beneficial effect on pedestrian and vehicular circulation in the area? Plat and Street Committee Finding 4: Pedestrian circulations will be enhanced by the construction of interconnected sidewalks along NE 23 Ter NE 23 St. Furthermore, there will be sidewalks constructed along NE 24 Ter, which will be directly connected to the Baywalk. Planning Department Analysis 4: In accordance with Article 2, Section 2.1.3.2(d) of Miami 21, the Applicant proposes to redesign the street grid system at the Property to eliminate outdated "one -block" streets that are not interconnected to major thoroughfares, while improving both pedestrian and vehicular circulation and accessibility. The proposed T-Plat also complies with the intent and purpose of Article 3, Section 3.8.2(c) of Miami 21, which requires that all Thoroughfares should terminate at other thoroughfares, to form a network and shall not be vacated. The Applicant complies with this by proposing to maintain the View Corridor, as a legal Easement, for the dead-end portion of NE 24th Street and NE 23rd Terrace by turning it into an even wider View Corridor with an additional 20-feet to each street (i.e. 70 feet and 40 feet respectively) and with a 25- foot vertical clearance. Finally, regarding the View Corridor for NE 24th Street, there will be a minimum 10-foot wide publicly accessible pedestrian path with a pedestrian bridge connecting the areas above. Planning Department Finding 4: Miami 21 It is consistent with Miami 21, Sections 2.1.3.2(d) and 3.8.2(c) MNCP Policy TR-2.9.5: The City will prioritize enhancements of pedestrian and bicycle circulation, access, and safety in the downtown, near activity centers, along transit corridors, near schools, libraries, and parks. CONCLUSION The closure and vacation of these Streets are important for the revitalization and enhance potential net positive impacts to the City are through improved pedestrian -vehicular circula response times for the City's first responders (police, fire, rescue), the preservation of the v Biscayne Bay, and improved pedestrian access to public civic spaces, such as the Bay Walk, cohesive development project. CONDITIONS Pursuant to Chapter 55, Section 55-15, of the City's Code of Ordinances, and the findings, the Planning Department recommends Approval of the vacation and closure of these Streets from public use as proposed in the T-Plat, subject to the following conditions: 1. The vacation and closure of these Streets shall be developed in accordance with the survey plans entitled "Tentative Plat #1893-H (Eighth Resubmittal)" as prepared by Santiago A. Dominguez, Professional Surveyor and Mapper consisting of three pages dated 5/12/2020 and batch stamped and approved by the Planning Department August 5, 2020. 2. The Applicant, owner or their successor shall meet applicable development standards identified in the Miami 21 Code and all applicable local, county, state, and federal regulations. 3. The Applicant shall provide an access plan for review and acceptance by the City's Fire -Rescue, Police, Solid Waste Departments, and the Capital Improvements Program/Office Transportation. 4. A building permit, including phased permits, will not be issued on the property being platted until the final plat is recorded or as authorized by the City's Code Section 55-10(i). 5. A Certificate of Occupancy shall only be issued after all the required subdivision improvements have been completed; 6. The Applicant or their successor shall comply with the conditions of approval stated for the Application to vacate and close these Streets, in a letter dated June 15, 2020, issued by the Department of Resilience and Public Works. The Applicant shall provide a written request to the City's Office of Capital Improvements and Department of Resilience and Public Works to obtain a Confirmation ("Confirmation"). If the Confirmation indicates that funds were expended, the City's Finance Department and Office of Management and Budget will determine the amount of the City's expenditure, specifically including the expenditure of restricted funds (bond funds, grant funds, or otherwise) for such improvements as a separate line item. The City Manager or his or her designee will issue a Total Expenditure, which shall specify the amount that the Applicant must repay to the City ("Total Expenditure"). Said Confirmation and, if applicable, Total Expenditure must be obtained prior to the scheduling of a public hearing regarding the vacation and closure before the City Commission, or before the PZAB for the Alternative Method under the City Code Section 55-15(i) and (j) Payment to the City of the amount indicated on the Total Expenditure shall be paid to the City before recordation of the Final Plat in accordance with Section 55-8 of the City Code, or before scheduling for PZAB consideration for the Alternative Method under the City Code Section 55-15(i) and (j).
