City of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 5757 Final Action Date:10/22/2020 MAY BE WITHDRAWN A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER, CITY ATTORNEY, AND INDEPENDENT AUDITOR TO TAKE ANY AND ALL ACTIONS NECESSARY REGARDING ANY IMPROPER OCCUPANCY OR USE OF ANY CITY OF MIAMI OWNED PREMISES BY UNAUTHORIZED BUSINESS ENTITIES INCLUDING BUT NOT LIMITED TO THE MELREESE GOLF COURSE LOCATED AT 1802 NORTHWEST 37 AVENUE, MIAMI, FLORIDA. WHEREAS, the premises, facilities, and address of Melreese Golf Course located at 1802 Northwest 37 Avenue, Miami, Florida ("Melreese") are solely the property of the City of Miami ("City"); and WHEREAS, an investigation by the City determined that unauthorized business entities were listing the address of Melreese as their principal place of business with the Florida Department of State; and WHEREAS, a number of these business entities continue to use the address of Melreese as their principal place of business without authorization even after the current independent contractor that manages Melreese was advised of the unauthorized use; and WHEREAS, the unauthorized use outlined above constitutes a use of City -owned property without appropriate compensation in violation of the Code of the City of Miami, Florida, as amended; and WHEREAS, the City Administration believes the improper misuse of Melreese is just one example of other misuses of City -owned properties throughout the City; and WHEREAS, the City Commission finds that it is in the best interest of the City to authorize the City Manager, City Attorney, and Independent Auditor to take any and all actions necessary to ensure that unauthorized business entities are prevented from occupying or using any City -owned property including Melreese; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission hereby directs the City Manager, City Attorney, and Independent Auditor to take any and all actions necessary regarding the improper occupancy or use of any City -owned property by unauthorized business entities including, but not limited to, Melreese. Section 3. The business entities known as First Tee of Miami -Dade Foundation, Inc. and The First Tee of Miami -Dade, Inc. are given thirty (30) days to provide the City with all documentation previously requested by the City regarding the use of Melreese prior to any legal action being taken. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
