A RESOLUTION OF THE MIAMI CITY COMMISSION PURSUANT TO
CHAPTER 62/ARTICLE XIII/DIVISION 1/SECTION 62-521(B) OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "PLANNING AND
ZONING/PLANNING AND ZONING APPROVAL FOR TEMPORARY USES AND
OCCUPANCIES; PERMIT REQUIRED/TEMPORARY EVENT
PERMITS/TEMPORARY EVENTS IN GENERAL," WAIVING THE TWO (2)
TEMPORARY EVENT LIMITATION PER YEAR PER PROPERTY TO ALLOW
THE UNIVERSITY OF MIAMI TO PLACE A TEMPORARY TRAILER AT 1851
NORTHWEST 7 AVENUE, MIAMI, FLORIDA TO CONDUCT NOVEL
CORONAVIRUS VACCINATION TRIALS BEGINNING OCTOBER 2, 2020 AND
ENDING OCTOBER 2, 2022.
WHEREAS, pursuant to Chapter 62/Article XIII/Division 1/Section 62-521(b) of the Code
of the City of Miami, Florida, as amended ("City Code"), titled "Planning and Zoning/Planning
and Zoning Approval for Temporary Uses and Occupancies; Permit Required/Temporary Event
Permits/Temporary Events in General," temporary events are limited to no more than two (2)
per year per property for a maximum of two (2) weeks per permit; and
WHEREAS, pursuant to Section 62-521(b)(4) of the City Code, the number of events
can be waived upon affirmative vote of the City Commission; and
WHEREAS, the University of Miami has been selected by the COVID-19 Prevention
Network ("CoVPN") to participate in the CoVPN 3001 — Phase 3, Randomized, Stratified,
Observer -Blind, Placebo -Controlled Study to Evaluate the Efficacy, Safety, and Immunogenicity
of mRNA-1273 SARS-CoV-2 Vaccine in Adults Aged Eighteen (18) Years and Older, mRNA-
1273-P301, sponsored by ModernaTX, Inc., with funding provided by the National Institute of
Allergy and Infectious Diseases (NIAID) USA, Inc.; and
WHEREAS, the University of Miami, in order to meet the immediate space requirements
of the Novel Coronavirus ("COVID-19") Vaccination Trials, wishes to place a temporary trailer at
the property located at 1851 Northwest 7 Avenue, Miami, Florida beginning October 2, 2020
and ending October 2, 2022, which will exceed the two (2) permit per year limitation; and
WHEREAS, the temporary trailer will be in use Monday through Saturday from 6:00 A.M.
to 5:00 P.M. to accommodate the work schedules of the vaccine program volunteers; and
WHEREAS, the proposed temporary use at the above location is necessary on an
emergency basis to be able to continue developing and conducting studies that will ensure rapid
and thorough evaluation of the United States government sponsored COVID-19 vaccines;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 62-521(b)(4) of the City Code, titled "Planning and
Zoning/Planning and Zoning Approval for Temporary Uses and Occupancies; Permit Required,"
the two (2) temporary event per property per year limitation is hereby waived to allow the
University of Miami to place a temporary trailer at the property located at 1851 Northwest 7
Avenue, Miami, Florida beginning October 2, 2020 and ending October 2, 2022 to conduct
COVID-19 Vaccination Trials.
Section 3. This Resolution does not waive any other requirements of the City Code,
including but not limited to, applicable fees, inspections, and permits.
Section 4. This Resolution shall become effective immediately upon its adoption.
