Background of Item: On July 23, 2020, pursuant to Resolution No. R-20-0237 the Miami City Commission approved the acceptance of $1,312.500.00, which included an amount of $1,181,250.00 to be used for mortgage assistance for homeowners with loss or reduction in income by creating and funding the City of Miami Mortgage Assistance Program. On September 15, 2020, the City of Miami ("City") was notified by Florida Housing Finance Corporation of an additional allocation of CFR funds in the amount of $787,500.00. These funds must be spent for mortgage assistance by December 30, 2020. The City Administration recommends the acceptance of additional amount of CRF funds in the total amount of $787,500.00, allocating an amount of $78,750.00 for program administration and an amount of $708,750.00 to be used for mortgage assistance for homeowners with loss or reduction in income, in conformity with the Local Housing Assistance Program ("LHAP"). In accordance with Section 2-33(f) of the Code of the City of Miami, Florida, as amended, the City Commission, by a majority vote, hereby deems this Resolution to be of an emergency nature. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The acceptance of an additional allocation of CRF funds from the United States Treasury Department through Florida Housing Finance Corporation, in the total amount of $787,500.00, thereby allocating an amount of $78,750.00 for program administration and an amount of $708,750.00 to be used for mortgage assistance for homeowners with loss or reduction of income in conformity with the Local Housing Assistance Program ("LHAP"), is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, including amendments, extensions, and modifications, all in forms acceptable to the City Attorney, subject to all federal, state, and local laws that regulate the use of such funds, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, Ginty Attor ey 9/29/2020 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited, to those prescribed by applicable City Charter and Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
