HomeMy WebLinkAboutPZAB (6793) ResolutionbFR City of Miami PZAB Resolution Enactment Number: PZAB-R-19-049 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 6793 Final Action Date: 11/20/2019 A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD ("PZAB") RECOMMENDING APPROVAL OF AN ORDINANCE OF THE MIAMI CITY COMMISSION, TO AMEND ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, MORE SPECIFICALLY BY AMENDING ARTICLE 6, TABLE 13, TITLED "SUPPLEMENTAL REGULATIONS", TO ADD A SUPPLEMENTAL REGULATION FOR "PUBLIC STORAGE FACILITIES," REQUIRING ON -SITE BULK WASTE DISPOSAL, PROVIDING FOR ALLOWANCE BY WARRANT, DESIGN REVIEW, AND SEPARATION/DISTANCE REQUIREMENTS, AND REGULATIONS WITHIN TRANSECT ZONES; PROVIDING THAT ON -SITE BULKY WASTE DISPOSAL NOT BE SEPARATELY CHARGED TO EXISTING CLIENTS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 22, 2009, the City of Miami ("City") adopted Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida ("Miami 21 Code"); and WHEREAS, on January 26, 2012, the City adopted Ordinance No. 13307 (11-0875zt) modifying regulations for Public Storage facilities providing additional flexibility to such uses and removing 2,500 feet distance separation requirements in T5 and T6 Zones; and WHEREAS, on March 23, 2017, the City adopted Ordinance No. 13674 modifying regulations for Public Storage facilities to require distance separation requirements of 2,500 feet radius from another existing facility which applied in T5 and T6 Zones; and WHEREAS, Public Storage Facilities are generally designed with a lack of architectural diversity and inactive ground floors; and WHEREAS, the lack of distancing requirements in District Zones allows the close proximity of Public Storage Facilities which creates an adverse impact on the surrounding community; and WHEREAS, the design of a Public Storage Facility should be in a manner that is in keeping with the character and scale of the surrounding area; and WHEREAS, the Miami 21 Code, as amended, does not require bulk waste storage or compactors at Public Storage Facilities; and WHEREAS, there has an increase of illegal dumping cases found within the areas of Public Storage Facilities within the City of Miami, and City of Miami Page 1 of 7 File ID: 6793 (Revision:) Printed On: 11/21/2019 WHEREAS, it has been determined that the increase illegal trash and bulky waste dumping cases are due to the lack of on -site bulk waste disposal available at such commercial facilities; and WHEREAS, all new Public Storage Facilities are required to provide on -site bulk waste disposal at no additional cost to clients as approved by the Director of Solid Waste, or his/her designee; and WHEREAS, all existing Public Storage Facilities will be required to provide on -site bulk waste disposal at no additional cost to clients within one -hundred and eighty (180) days upon adoption of this legislation, as approved by the Director of Solid Waste, or his/her designees; and WHEREAS, all Public Storage Facilities shall be reviewed and approved by the Director of Solid Waste, or his/her designee to ensure the appropriate waste containers are located on - site for customer use per Sec. 22-2 (c) and (f) of the City Code of Ordinances; and WHEREAS, requiring on -site bulk waste disposal at all Public Storage Facilities will help decrease illegal dumping of trash and bulky waste, which will benefit the overall health, safety and welfare of residents within the City; and WHEREAS, the PZAB has considered whether the proposed change will further the goals, objectives, and policies of the Comprehensive Plan, the Miami 21 Code, and other City regulations; and WHEREAS, due consideration has been given to the need and justification for the proposed change, including changed conditions that make the passage of the proposed change necessary; and WHEREAS, the PZAB at its meeting on November 20, 2019, following an advertised public hearing, after careful consideration of this matter, a motion to recommend approval of the zoning ordinance was made, wherein it passed unanimously, eight (8) to zero (0); NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Planning, Zoning and Appeals Board hereby recommends to the City Commission that the Miami 21 Code, as amended, be amended by making modifications to Article 6, Table 13, in the following particulars:1 ARTICLE 6. SUPPLEMENTAL REGULATIONS 1 Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. T5 - URBAN CENTER ZONE - OPEN DENSITY (UPA) PUBLIC STORAGE FACILITY * T5 —URBAN CENTER ZONE RESTRICTED LIMITED OPEN 65 UNITS PER ACRE 65 UNITS PER ACRE 65 UNITS PER ACRE Allowed by Warrant and subject to the following additional requirements: Minimum distance requirement of 2,500 feet radius between proposed facility and another existing facility. Waiver for reduction in distance requirement is not permissible. Public Storage Facilities shall have ground floor retail along principal frontage. A minimum of 50% of the proposed ground floor retail shall be unrelated to the Public Storage Facility. The maximum size of any individual storage rental space shall be 400 square feet. Controlled access and adequate security surveillance shall be provided throughout facility. Hours of operation shall be limited to 5:00 am to 11:00 pm. Shall be referred to the Urban Development Review Board (UDRB). Provide bulk waste disposal on -site available to clients at no additional cost. Bulk waste facility requirements subject to review by the Solid Waste Director or designee. * T6 —URBAN CORE ZONE RESTRICTED LIMITED OPEN 150 UNITS PER 150 UNITS PER 150-1,000 UNITS PER ACRE* ACRE* ACRE* Allowed by Warrant and subject to the following additional requirements: Minimum distance requirement of 2,500 feet radius between proposed facility and another existing facility within any T5 or T6 Zone. Waiver for reduction in distance requirement is not permissible. Bulk waste facility requirements subject to review by Solid Allowed by Warrant and subject to the following additional requirements: Minimum distance requirement of 2,500 feet radius between proposed facility and another existing facility. Waiver for reduction in distance requirement is not permissible. Shall have ground floor retail, manufacturer -enabled retail, or industrial uses along principal frontage. A minimum of 50% of the proposed ground floor uses shall be unrelated to the Public Storage Facility. Shall be referred to the Urban Development Review Board (UDRB).
