WHEREAS, on October 22, 2009, the City of Miami ("City") adopted Ordinance No.
13114, the Zoning Ordinance of the City of Miami, Florida ("Miami 21 Code"); and
WHEREAS, on January 26, 2012, the City adopted Ordinance No. 13307 (11-0875zt)

radius from another existing facility which applied in T5 and T6 Zones; and
WHEREAS, Public Storage Facilities are generally designed with a lack of architectural

community; and
WHEREAS, the design of a Public Storage Facility should be in a manner that is in
keeping with the character and scale of the surrounding area; and
WHEREAS, the Miami 21 Code, as amended, does not require bulk waste storage or

WHEREAS, it has been determined that the increase illegal trash and bulky waste
dumping cases are due to the lack of on -site bulk waste disposal available at such commercial
facilities; and
WHEREAS, all new Public Storage Facilities are required to provide on -site bulk waste
disposal at no additional cost to clients as approved by the Director of Solid Waste, or his/her
designee; and

adoption of this legislation, as approved by the Director of Solid Waste, or his/her designees;
and
WHEREAS, all Public Storage Facilities shall be reviewed and approved by the Director
of Solid Waste, or his/her designee to ensure the appropriate waste containers are located on -
site for customer use per Sec. 22-2 (c) and (f) of the City Code of Ordinances; and
WHEREAS, requiring on -site bulk waste disposal at all Public Storage Facilities will help
decrease illegal dumping of trash and bulky waste, which will benefit the overall health, safety
and welfare of residents within the City; and
WHEREAS, the PZAB has considered whether the proposed change will further the
goals, objectives, and policies of the Comprehensive Plan, the Miami 21 Code, and other City
