City of Miami File ID: 7821 (Revision:) Printed On: 5/9/2025 City of Miami Legislation Ordinance Enactment Number: 13930 File Number: 7821 Final Action Date: 10/8/2020 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 1 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TITLED "GENERAL PROVISIONS;" MORE PARTICULARLY BY AMENDING SECTION 1-16 OF THE CITY CODE TO ALLOW ALTERNATE SEALS ON LIMITED OCCASIONS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, Section 165.043, Florida Statutes, authorizes the governing body of a municipality, by ordinance, to designate an official municipal seal and prohibits the unauthorized use, manufacture, display, and other employment of any facsimile or reproduction of the municipal seal, except by municipal officials or employees in the performance of their official duties, without the express written approval of the governing body; and WHEREAS, on March 22, 2018, the City Commission adopted Ordinance No. 13750, which designated the official City Seal of the City of Miami pursuant to Section 165.043, Florida Statutes, and established regulations for the use of the City Seal; and WHEREAS, the City Commission wishes to allow, with its approval on limited occasions, the use of alternate seals; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted and incorporated as if fully set forth in this Section. Section 2. Chapter 1 of the Code of the City of Miami, Florida, as amended, is further amended in the following particulars:1 "CHAPTER 1 GENERAL PROVISIONS Sec. 1-16. City Seal. A. City Seal: As used herein, the City seal shall mean the graphical seal as depicted below and comprised of a round seal with the words "The City of Miami" and "Florida" arranged in a semicircular form, constituting the border and the design of the Royal Palm Tree in an 1 Words and/or figures stricken through shall be deleted. Unauthorized Use of the City Seal: It shall be unlawful and a violation of this Section to manufacture, use, display, or otherwise employ any facsimile or reproduction of the City Seal, except by City officials or employees in their official duties, without the express approval of the City Commission. Such unauthorized use shall constitute a violation of this Section and may be punished by a court of competent jurisdiction up to the maximum penalty permitted by law as provided by Section 1-13 of this Code and Florida Statute 165.043. C. All seals previously used or adopted by the City are solely reserved for use by the City, its pursuant to Florida Statute 165.0'13." Alternate Seal. The City Commission may approve by Resolution, on limited occasions, an alternate City Seal or logo. The alternate seal may include modernized design updates or color highlights of the aforementioned seal design. D. All seals previously used or adopted by the City are solely reserved for use by the City, its agencies, and instrumentalities, which shall maintain all rights authorized and provided for pursuant to Florida Statute 165.043." Section 3. The City, its agencies, and instrumentalities retain all rights to the continued use of all seals previously used or adopted by the City until it deems fit. Section 4. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective immediately after final reading and adoption thereof.2 2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within then (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein. whichever is later.
