This letter constitutes a request to appeal the above -referenced Planning,
Zoning, and Appeals Board (PZAB) decision, rendered on August 9, 2019 (PZAB
R-19-029/ File ID: 6076), to the City Commission, pursuant to Sections 7.1.2.6(d)
and 7.1.5(c) of the Miami 21 Code (the "Code").
On July 17, 2019, the PZAB heard Village Montessori School, Corp.,
("Village Montessori") application for an Exception for the property located at
1267 SW 22nd Street, 1292 SW 21 st Terrace, 2149 SW 13th Ave ("Property"),
PZAB File ID #6076. The PZAB voted 4 to 3 to approve Village Montessori's
application. Because this vote did not satisfy the supermajority vote requirement
set forth in the Code, the motion did not carry and the Assistant City Attorney
announced that the application was deemed denied. Village Montessori appeals
for the following reasons:
1. In quasi-judicial matters, applicants are entitled to a decision. The
failure of a motion to approve does not constitute a decision on a quasi-judicial
matter. Only a successful motion to approve or deny can have that effect. Due to
the fact that a motion to deny was not made and adopted, Village Montessori's
application was not decided. In deeming the application denied because a
motion to approve failed, Village Montessori was denied due process.

2. Section 7.1.2.6(c)(2) of the Code provides that the PZAB "shall
issue written findings that the applicable requirements of the Miami 21 Code
have or have not been met" and "shall include a citation to legal authority for any
denial of an Exception." Village Montessori's application was deemed denied
when the motion to approve failed. The PZAB board gave no findings, reasons
nor legal authority to support a denial of the application. Additionally, PZAB-R-
19-029 cites no legal authority to support a denial of the application. The
requirements of the Code were not followed.
3. The record below does not contain any substantial competent evidence
to support a denial of Village Montessori's application. Reviews by City staff
confirmed that Village Montessori's requests satisfy all requirements of the City's
Comprehensive Plan, the Code, and applicable sections of the Miami -Dade
County Code. No counter evidence was presented at the hearing. City staff
recommended approval of the application in its written analysis and oral
presentation to the PZAB. No testimony at the public hearing rebutted City
staffs analysis. Additionally, the City's transportation department reviewed the
site plan for traffic circulation, queuing and parking and recommended approval
of the application. Furthermore, the City's outside consultant, HNTB, reviewed
the application and issued a Sufficiency Letter. Finally, Miami -Dade County's
Department of Transportation and Public Works (DTPW) reviewed and
recommended approval of the application finding that "Site generated traffic was
evaluated and found to have minimal impact on the adjacent roadways." There
was no basis to deny Village Montessori's application as required by the City
Code.
Based on the foregoing, Village Montessori respectfully requests that this
appeal be processed and placed on the next available City Commission agenda.
