AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY
CHANGING THE ZONING CLASSIFICATION FROM "D1", WORK PLACE
DISTRICT TRANSECT ZONE, TO "T6-12-0", URBAN CORE TRANSECT ZONE
- OPEN, FOR THE PROPERTY LOCATED AT 690 NORTHWEST 13 STREET,
MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A",
ATTACHED AND INCORPORATED; MAKING FINDINGS; CONTAINING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the property located at 690 Northwest 13 Street, as more particularly
described in Exhibit "A", attached and incorporated ("Property"), is presently zoned "D1", Work
Place District Transect Zone on the Zoning Atlas of Ordinance No. 13114, the Zoning Ordinance
of the City of Miami, Florida, as amended ("Miami 21 Code"); and
WHEREAS, KTLC Biscayne, LLC ("Applicant") has submitted a request to the City of
Miami ("City") to change the zoning classification of the Property from "D1", Work Place District
Transect Zone, to "T6-12-0", Urban Core Transect Zone — Open; and
WHEREAS, the Applicant submitted a companion application (ePlan File ID PZ-19-
4927) to change the future land use designation of the Property on the Future Land Use Map
("FLUM") of the Miami Comprehensive Neighborhood Plan ("MCNP") from "Light Industrial" to
"Restricted Commercial"; and
WHEREAS, the Property is generally bounded on the east by Northwest 7th Avenue, on
the north by Northwest 14th Street, on the east by Booker T. Washington High School, and on
the south by a driveway and the Metrorail and is approximately 122,192 square feet (2.81 acres)
in size; and
WHEREAS, the Property is currently developed with a large single -story warehouse and
a smaller single story out -building; and
WHEREAS, the Property is currently contaminated from a prior occupant that
warehoused and sold industrial chemicals; and
WHEREAS, the current zoning of the Property, "D1", Work Place District Transect Zone,
has seen recently reduced demand for development, evidenced by an uptick in rezoning
applications away from that category; and
WHEREAS, a rezoning from "D1", Work Place District Transect Zone, to "T6-12-0",
Urban Core Transect Zone — Open, may increase the likelihood of redevelopment, and
subsequent remediation of the Property's contamination; and

WHEREAS, the Property is located east of Northwest 7th Avenue, a Transit Corridor, and
the Property is within the Transit Oriented Development ("TOD") originating from the Culmer
Metrorail station; and
WHEREAS, a Transit Corridor is an area that is radius from a thoroughfare served by
one (1) or more mass transit routes with transit vehicles operating with an average of ten (10)
minute headways between the hours of 7:00 a.m. through 7:00 p.m. and a TOD is defined as
proximate to a fixed rail transit stop; and
WHEREAS, due to its inclusion within a Transit Corridor and a TOD, the Property is well -
served by mass transportation and well positioned to absorb additional residential density and
intensity; and
WHEREAS, impact on the surrounding community will be minimized due to a high
concentration of surrounding neighborhood -serving Uses and mass transportation accessibility;
and
WHEREAS, Article 7, Section 7.1.2.8.a.3. and Section 7.1.2.8.f.2 of the Miami 21 Code
provides that a change to the Miami 21 Atlas may be made only to the next Transect Zone and
shall maintain the goals of the Miami 21 Code to preserve neighborhoods and to provide
transitions in intensity and Building Height; and
WHEREAS, the City's Planning Department reviewed the application and found that
both the requested zoning change from "D1", Work Place District Transect Zone, to "T6-12-0",
Urban Core Transect Zone — Open, is successional;
WHEREAs, the City's Planning Department has determined that a zoning change from
"D1", Work Place District Transect Zone, to "T6-8-O", Urban Core Transect Zone — Open, which
is also successional, would yield the most coherent development pattern given the adjacent
neighborhood and zoning context; and
WHEREAS, on July 1, 2020, the Planning, Zoning and Appeals Board ("PZAB"), at a
duly noticed public hearing, considered PZAB Item No. 4 and passed Resolution No. PZAB-R-
20-019 by a vote of seven to two (7-2), recommending approval to the City Commission of the
proposed zoning change from "D1", Work Place District Transect Zone, to "T6-12-0", Urban
Core Transect Zone — Open ; and
WHEREAS, the City Commission has considered the goals, objectives, and policies of
the MCNP, the Miami 21 Code, and all other City regulations; and
WHEREAS, the City Commission has considered the need and justification for the
proposed zoning change, including changing and changed conditions that make the passage of
the propose zoning change necessary; and
WHEREAS, the proposed zoning change furthers the goals and objectives of the MCNP;
and
WHEREAS, the proposed zoning change furthers the goals of the Miami 21 Code
centered on focused growth around transit and preservation of neighborhoods through transitions
in intensity and building height; and

WHEREAS, the City Commission, after careful consideration of this matter, deems it
advisable and in the best interest of the general welfare of the City and its inhabitants to
approve this amendment to the Zoning Atlas of the Miami 21 Code, as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission approves the amendment to the Zoning Atlas of the
Miami 21 Code by changing the zoning classification from "D1", Work Place District Transect
Zone, to "T6-12-0", Urban Core Transect Zone — Open, for the property located at
approximately 690 Northwest 13 Street, as more particularly described in Exhibit "A", attached
and incorporated.
Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance should not be affected.
Section 4. This Ordinance shall become effective thirty-one (31) days after second
reading and adoption thereof, pursuant and subject to Section 163.3184(12), Florida Statutes
and Section 163.3187(5)(c), Florida Statutes.'

1 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later
