GOP face
dilemma
in vote on
Ginsburg
successor
ST LAURA If7VAN
AND STEVEN T. DENNIS
Bloomberg Pim
WASHINGTON
Senate Republicans face
critical choice on replac-
ing the late Supreme Court
Justice Ruth Bader Gins-
burg — vote on her replace-
ment before Election Day,
or wait until immediately
afterward - when Donald
Trump will still be presi-
dent no matter the Nov. 3
outcome until next Jan-
uary.
The choice comes down
to a calculation of the poli-
tics.
Senate Majority Leader
Mitch McConnell on Fri-
day promised a vole on
Tr unp's pick to replace the
high court's liberal icon,
but he didn't put a timeta-
ble on i1. The pivotal ques-
tion in coming days is
whether McConnell would
try to keep that promise
before the November elec-
tions or hold off until a
lame duck session before
the transition to the new
Congress
Ina letter to his Repub-
lican colleagues obtained
by the Washington Post,
McConnell urged them to
"keep your powder dry" in
responding to the press
until senators return to
Washington U they are
un
sure what to say or are
clined to oppose giving a
nominee a vote. "This is
not the time to lock your-
selves into a position you
may later regret," he
wrote.
The Senate would need
to move faster than usual
to confirm a nominee be.
fore the election 45 days
from now. The average
time from nomination to
Senate vote — after vetting
and hearings — is 69.6
days, or about 2.3 months,
according to a 2018 report
from the Congressional
Research Service.
But McConnell in his
letter said there was plenty
of time. He cited Gins-
burg's nomination in 1993
which look only 50 days
from the time it was an-
nounced until she was
confirmed.
Delaying a vote until after
the election could have
political benefits. Repub-
licans could use the vacancy
to energize their base in
some of the swing states
where incumbent GOP
senators are in close con-
tests. It also would avoid a
politically perilous vote for
incumbent senators of their
party such as Cory Gardner
of Colorado and Susan
Collins of Maine who are
running for reelection in
Rates Trump lost in 2016
and trail their Democratic
challengers this year.
Pushing a nominee
through before Election Day
would require the Senate to
move with a atypical speed
that dispenses with norms
and traditions.
The confirmation pro-
cess typically involves
meetings be-
tween the nominee and
individual senators over
many weeks. And the pro-
cess before the Senate
Judiciary Committee is
quite involved and includes
a lengthy background
questionnaire for the nomi-
nee,week of hearings,
na a vote usually two
weeks later before a full
Senate vote is scheduled.
Delaying a vote until
after the elections and
before a new Congress is
sworn in in early January
has its own downsides. For
one, Arizona Democrat
challenger Mark Kelly is
favored to beat incumbent
GOP Sen. Martha MCSally
in that state's special elec-
tion to serve out the re-
mainder of the late John
McCain's Senate term. If
he wins, he could be seated
shortly thereafter, costing
McConnell one vole.
Democrats hope
Court vacancy
motivates voters
ST ALE%a0ART5
areareAkscrlaidygla,om
For decades, Repub-
licans have been more
effective than Democrats
at marshalling judicial
issues to galvanize their
voters and win elections.
Will the political dy-
namic hp this year?
The Supreme Court
vacancy created by Ruth
Bader Ginsburg's death
Friday has jolted the 2020
election, refocusing an
already turbulent cam-
paign on a judicial open-
ing that could cement a
conservative majority on
the nation's high court for
a generation.
It's a high -stakes sit-
uation reminiscent of the
2016 race, when a va-
cancy caused by the death
of Antonin SCelia — and
the resulting battle over
the court's ideological
majority — is widely be-
lieved to have benefited
Donald Tr unp's cam-
paign.
But Democrats argue
that this year's opening
presents fundamentally
different slakes for their
electoral base, calling
attention to a set of viscer-
ally important issues like
health care and abortion
rights that they hope put
Trump and the GOP on
shaky political footing.
"There no question
this will be an inflection
point that shatters the
conventional thinking
about who cares about the
court and who shows up
for them," said Christoph-
er Kong, co-founder and
chief counsel for Demand
justice, a liberal group
that focuses on the judi-
ciary.
Kang said Demand
Justice will spend S10
million on ads criticizing
senators who want to push
a Supreme Court nomi-
nation forward before the
election, though he added
the group has not yet
decided which races it will
target.
Polls indicate that, at
least at the outset, Demo-
cratic presidential nomi-
nee Joe Biden carries a
small advantage on who
voters want to see appoint
the next Supreme Court
justice. A national Fox
News poll released this
month shows that 52% of
likely voters trusted Biden
over Trump to pick the
next nominee, compared
to 45% for Trump.
M August survey from
the Pew Research Center,
meanwhile, found 66% of
Democrats say Supreme
Court appointments are
"very important" to thew
choice in the election,
compared to 61% of Re-
publicans.
hi 2016, Pew reported a
different dynamic, with
70% of Trump supporters
saying an appointment
was very important to
them while 62% of Hillary
Clinton supporters said so.
And a poll released
Saturday from the Mar-
quette University Law
School found that among
likely Biden voters in
Wisconsin, 59% said the
next court appointment
was 'very import.," to
them, compared to 51%
for Trump supporters.
Officials with the Biden
campaign also point out
that the Supreme Court
vacancy is likely to refocus
attention on a GOP law-
suit the court was set to
hear in November on
whether the Affordable
Care Act is constitutional.
A fight over repealing the
heath care law before the
2018 midterm election
became the central mes-
sage of Democratic candi-
dates that year, with many
arguing that the GOP
wanted to do away with
guarantees that Amer-
icans with pre-existing
Conditions could still re-
ceive health insurance.
"Voters understand the
nest justice who goes on
the court will decide
whether or not they will
still have protections for
pre-existing conditions,"
said one Biden aide,
granted anonymity to
speak candidly about
campaign strategy.
"That's a fight that's good
for Democrats. It carried
them to the House major-
ity in 2018 and it is moti-
vating voters in communi-
ties all over the country."
