A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING AND ADOPTING THE ANNUAL BUDGET OF THE CIVILIAN
INVESTIGATIVE PANEL, ATTACHED AND INCORPORATED AS COMPOSITE
EXHIBIT "A", IN THE TOTAL AMOUNT OF $1,174,000.00 FOR THE FISCAL
YEAR COMMENCING OCTOBER 1, 2020 AND ENDING SEPTEMBER 30,
2021.
WHEREAS, the City of Miami's ("City") Civilian Investigative Panel ("CIP") was created
pursuant to Ordinance No. 12188 on February 14, 2002 as amended by Ordinance No. 12315
adopted on January 23, 2003, Ordinance No. 12379 adopted on June 12, 2003, Ordinance
No. 13186 adopted June 24, 2010, Ordinance No. 13688 adopted on June 8, 2017, and
Ordinance No. 13719 adopted December 14, 2017; and
WHEREAS, pursuant to Section 51 of the Charter of the City of Miami, Florida, as
amended ("City Charter"), and Chapter 11.5, Article II of the Code of the City of Miami, Florida,
as amended ("City Code"), the CIP serves as an independent citizens' oversight panel with
authority to conduct investigations and propose recommendations regarding allegations of
misconduct by any sworn officer of the City police department ("MPD"), make written
recommendations related to MPD's policies and procedures, and subpoena witnesses and
documents when conducting independent investigations of allegations of police misconduct; and
WHEREAS, Section 11.5-35 of the City Code provides that the CIP shall be operated on
an annual budget that shall be no less than one percent (1%) of the approved regular salaries
and wages line item for the MPD's general fund budget except as otherwise required by the City
Manager's declaration of a fiscal emergency, financial urgency, or financial emergency; and
WHEREAS, the CIP reviewed and approved its budget for Fiscal Year 2020-2021 on
August 18, 2020 in the total amount of $1,174,000.00, a copy of which is attached and
incorporated as Composite Exhibit "A"; and
WHEREAS, the CIP requests the approval by the Miami City Commission of its budget
for Fiscal Year 2020-2021 in the total amount of $1,174,000.00, as more particularly dsecrbied
in Composite Exhibit "A", attached and incorporated;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The CIP's Fiscal Year 2020-2021 budget, attached and incorporated as
Composite Exhibit "A", in the total amount of $1,174,000.00 is approved and adopted.

Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
