A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO ADOPT A PROCEDURE FOR COURTESY NOTICES OF
IMPENDING DEMOLITIONS TO IMMEDIATE, ABUTTING PROPERTY
OWNERS, TO RELEVANT CITY OF MIAMI DEPARTMENTS, AND TO LOCAL
HUMAN SERVICES INSTITUTIONS INCLUDING THE LIBERTY CITY
COMMUNITY REVITALIZATION TRUST, CITRUS HEALTH, UNITED WAY OF
MIAMI-DADE, MIAMI-DADE COUNTY HOMELESS TRUST, MIAMI HOMES
FOR ALL, NEIGHBORHOOD HOUSING SERVICES OF SOUTH FLORIDA,
LIVE HEALTHY LITTLE HAVANA, AND LATINOS UNITED, PRIOR TO
ENFORCING A DEMOLITION ORDER OF THE UNSAFE STRUCTURES
PANEL.

WHEREAS, the City of Miami's ("City") Building Department follows all noticing
requirements provided for by Section 8-5 of the Code of Miami -Dade County, Florida, as
amended, and Section 10-101 of the Code of the City of Miami, Florida, as amended ("City
Code"), when demolishing an unsafe structure; and
WHEREAS, the Building Department also provides two (2) courtesy notices following the
last required legal notice when demolishing an unsafe structure; and
WHEREAS, the Building Department, through the Office of the City Attorney ("OCA"),
provides a courtesy notice prior to the hiring of a demolition contractor wherein the OCA has title
run on the property and then notifies, by posting, all legally interested parties of the impending
demolition along with providing another copy of the Unsafe Structures Panel's order; and
WHEREAS, the Building Department then provides a second courtesy notice of
demolition after a contractor has been approved by posting a notice on the property that the
demolition will proceed within the next ten (10) days; and
WHEREAS, all notices include names and contact information for person(s) at the City
who can be contacted to assist with the demolition of the unsafe structure; and
WHEREAS, for any demolition occurring where person(s) may be residing, legally or
illegally, the City also offers and provides various services; and
WHEREAS, in a further abundance of caution, it may be helpful to also post additional
courtesy notices regarding the impending demolition at immediately abutting properties and
inform local human services resources that such action is imminent in case any persons decide
to come forward and seek assistance; and

WHEREAS, pursuant to Section 2-33(f) of the City Code, the City Commission, by a
majority vote, deems this Resolution to be of an emergency nature in order to immediately
protect the public's health, welfare, and safety;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby directs that the City Manager adopt a
procedure to send out courtesy notices of impending demolitions to the immediate, abutting
property owners, to relevant City departments, and to local human services institutions such as
the Liberty City Community Revitalization Trust, Citrus Health, United Way of Miami -Dade,
Miami -Dade County Homeless Trust, Miami Homes for All, Neighborhood Housing Services of
South Florida, Live Healthy Little Havana, and Latinos United prior to enforcing a demolition
order of the Unsafe Structures Panel.
Section 3. This Resolution shall become effective immediately upon its adoption.
