WHEREAS, pursuant to Resolution No. R-16-0594 adopted on December 8, 2016, the City Commission allocated funds in the amount of $306,000.00 ("Funds") to the Department of Housing and Community Development ("Department") for the Emergency Housing Relocation Program ("Program") from Aids to Government Agencies; and WHEREAS, the Program was created to provide assistance to people displaced due to building and health code violations; and WHEREAS, the Funds were not used due to a requirement for properties to be in the City of Miami ("City") and eligible residents did not have the income to support the rent levels in the City; and WHEREAS, on March 9, 2020, the Governor of the State of Florida ("State") issued Executive Order 20-52 declaring a State of Emergency for the State related to the Novel Coronavirus ("COVID-19") pandemic; and WHEREAS, the COVID-19 pandemic is causing and is expected to continue to cause serious negative impacts on the local economy and financial impacts to residents, including the substantial loss of income due to loss of compensable work hours and wages, layoffs, and business closures, hindering residents' ability to make rent payments; and WHEREAS, the various moratoriums on evictions at the State and federal levels are expected to expire within the next two (2) months; and WHEREAS, the expected evictions after the moratoriums expire may overwhelm the City's homeless prevention programs; and WHEREAS, the City's Administration recommends de -appropriating the Funds from the Program and re -appropriating the Funds for the purpose of creating and funding the Eviction Prevention Program as specified in Exhibit "A," attached and incorporated; and WHEREAS, in accordance with Section 2-33(f) of the Code of the City of Miami, Florida, as amended, the City Commission, by a majority vote, hereby deems this Resolution to be of an emergency nature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The de -appropriation of the Funds from the Program and the re -appropriation of the Funds for the creation and funding of the Eviction Prevention Program as specified in Exhibit "A," attached and incorporated, is approved. Section 3. The City Manager is authorized' to transfer the Funds and to negotiate and execute any and all necessary documents, all in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
