HomeMy WebLinkAboutR-20-0218City of Miami Resolution R-20-0218 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 7535 Final Action Date: 7/23/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY OF MIAMI ("CITY") TO ENTER INTO A MEMORANDUM OF UNDERSTANDING ("MOU") WITH THE MIAMI-DADE COUNTY HOMELESS TRUST ("MDHT") FOR NON -ELDERLY PERSONS WITH DISABILITIES WHO ARE HOMELESS, ARE AT RISK OF HOMELESSNESS, OR ARE PREVIOUSLY HOMELESS AND ARE CURRENTLY IN PERMANENT SUPPORTIVE HOUSING OR IN A RAPID REHOUSING PROJECT TO BE REFERRED TO THE CITY'S MOVING ON PROGRAM ACCORDING TO THE CITY'S MAINSTREAM VOUCHER PROGRAM GUIDELINES; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A MOU, ATTACHED AND INCORPORATED AS EXHIBIT "A," IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER NECESSARY DOCUMENTS, INCLUDING AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 20-0102 adopted on April 9, 2020, the City Commission approved the acceptance of Mainstream Voucher Program ("Program") funds for Program Year 2019-2020 in the annual contribution amount of $432,159.00 from the United States Department of Housing and Urban Development ("HUD") for thirty (30) vouchers to provide permanent affordable housing assistance to non -elderly persons with disabilities, who are homeless, are at risk of homelessness, or are previously homeless and are currently in permanent supportive housing or in a rapid rehousing project; and WHEREAS, on May 18, 2020, the City of Miami ("City") was awarded an additional amount of $141,719.00 of Program funds for an additional nine (9) vouchers through the Coronavirus Aid, Relief, and Economic Security ("CARES") Act; and WHEREAS, the City's current Housing Choice Voucher ("HCV") waitlist does not have a sufficient number of applicants who satisfy the Program's minimum eligibility criteria; and WHEREAS, the City has incorporated a Moving On preference into its HCV and Moderate Rehabilitation Program's Administrative Plan; and WHEREAS, the City must enter into a Memorandum of Understanding ("MOU") with the Miami -Dade County Homeless Trust ("MDHT") to allocate available Mainstream City of Miami Page 1 of 2 File ID: 7535 (Revision:) Printed On: 5/5/2025 File ID: 7535 Enactment Number: R-20-0218 Vouchers under the Moving On preference, as the program requires referrals from MDHT of eligible non -elderly disabled homeless persons currently in permanent supportive housing or in a rapid rehousing project; and WHEREAS, the City's Administration recommends authorizing the City to enter into a MOU with MDHT, in accordance with the Program guidelines, to provide vouchers to non -elderly persons with disabilities, who are homeless, are at risk of homelessness, or are previously homeless and are currently in permanent supportive housing or in a rapid rehousing project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City is authorized' to enter into a MOU with MDHT to refer eligible applicants to the City's Moving On program for non -elderly persons with disabilities who are homeless, are at risk of homelessness, or are previously homeless and are currently in permanent supportive housing or in a rapid rehousing project according to the City's Program guidelines. Section 3. The City Manager is authorized1 to negotiate and execute the MOU, attached and incorporated as Exhibit "A," with MDHT, in a form acceptable to the City Attorney, for said purpose. Section 4. The City Manager is further authorized' to negotiate and execute any and all other necessary documents, including amendments, extensions, and modifications, all in forms acceptable to the City Attorney, subject to all federal, state, and local laws that regulate the use of such funds for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption.
