Home My WebLink AboutR-20-0209City of Miami Resolution R-20-0209 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 7573 Final Action Date: 7/23/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING THE CITY OF MIAMI'S ("CITY") LIST OF EXPEDITED PROJECTS PURSUANT TO SECTION 18-117 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TITLED "ECONOMIC STIMULUS AWARDS AND AGREEMENTS", BY REPLACING THE CURRENT "ATTACHMENT A - 4/12/19 REVISED" WITH "ATTACHMENT A - 6/17/20 REVISED MIAMI RECOVERY INITIATIVE", ATTACHED AND INCORPORATED, FOR THE PURPOSE OF INCLUDING UPCOMING OFFICE OF CAPITAL IMPROVEMENTS' SOLICITATIONS AND PROJECTS WITH FUNDING ALLOCATED FROM VARIOUS SOURCES INCLUDING, BUT NOT LIMITED TO, THE MIAMI FOREVER BOND AS WELL AS OTHER LOCAL, STATE, AND FEDERAL STIMULUS FUNDING, IF AND WHEN AVAILABLE; AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR, RECEIVE, REVIEW, REJECT, EVALUATE, AWARD, NEGOTIATE, AND EXECUTE CONTRACTS, INCLUDING PROFESSIONAL SERVICES AGREEMENTS AND CONSTRUCTION CONTRACTS, FOR THE PROJECTS IDENTIFIED IN "ATTACHMENT A - 6/17/20 REVISED MIAMI RECOVERY INITIATIVE," ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER DOCUMENTS, INCLUDING ANY AGREEMENTS, AMENDMENTS, AND EXTENSIONS, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING, THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. WHEREAS, on March 9, 2020, in accordance with Section (1)(a), Article IV of the Florida Constitution and Chapter 252, Florida Statutes, Florida Governor Ron DeSantis promulgated Executive Order 20-52 to declare a state of emergency in the State of Florida in response to the Novel Coronavirus ("COVID-19") pandemic; and WHEREAS, on March 12, 2020, in accordance with said Executive Order and Chapter 45 of the Code of the City of Miami, Florida, as amended ("City Code"), Mayor Francis X. Suarez declared a local state of emergency; and WHEREAS, the COVID-19 pandemic has caused the largest economic recession in United States history, affecting the local public, private, and non-profit sectors; accounting for City of Miami Page 1 of 3 File ID: 7573 (Revision:) Printed On: 5/5/2025 File ID: 7573 Enactment Number: R-20-0209 untold losses suffered by local businesses; and rising unemployment in the City of Miami ("City"); and WHEREAS, the City has developed the Miami Recovery Team to address said economic and social impacts resulting from the COVID-19 pandemic by proposing alternative policies and programs while working closely with the affected local sectors; and WHEREAS, the main goal of these policies and programs is to sustain and recover local businesses and mitigate economic hardship to the most vulnerable, while creating and implementing a plan of action to coordinate recovery efforts by City departments, stakeholders, and supporting entities, including the use of available local, state, and federal recovery programs; and WHEREAS, said plan of action includes strategies for adapting to changing public health, social, and economic conditions; reopening businesses; and establishing new businesses in the long-term by taking bold, inclusive action that seeks to reduce our community's future risks overall in its approach to a comprehensive community recovery initiative; and WHEREAS, the Miami Recovery Team has identified specific capital construction projects that have been categorized as "shovel -ready" under a list titled "Miami Recovery Initiative" and which could play a critical part in the City's recovery effort; and WHEREAS, the selection of these capital projects is one of the first initiatives from the Miami Recovery Team with the goal of stimulating the local economy by producing immediate business and employment opportunities and accessing Miami Forever Bond funds as well as other local, state, and federal stimulus funding, if and when available; and WHEREAS, Section 18-117 of the City Code, titled "Economic Stimulus Awards and Agreements," established measures to stimulate the local economy by creating a process to expedite the award of professional services agreements and construction contracts for certain projects identified in the then current attachment to said ordinance, as revised from time to time by resolution; and WHEREAS, the City desires to replace the current "Attachment A - 4/12/19 Revised" with "Attachment A - 6/17/20 Revised Miami Recovery Initiative," attached and incorporated, for the purpose of including upcoming Office of Capital Improvements ("OCI") solicitations; and WHEREAS, pursuant to Section 18-117 of the City Code, amongst the requirements for such projects, the Office of Management and Budget ("Budget") will perform a review of budgetary availability prior to the time of award of any contract for the same; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Amendment of the list of expedited projects pursuant to Section 18-117 of the City Code, titled "Economic Stimulus Awards and Agreements", by replacing the current "Attachment A - 4/12/19 Revised" with "Attachment A - 6/17/20 Revised Miami Recovery City of Miami Page 2 of 3 File ID: 7573 (Revision:) Printed on: 5/5/2025 File ID: 7573 Enactment Number: R-20-0209 Initiative", attached and incorporated, for the purpose of including upcoming OCI solicitations and projects is hereby authorized.' Section 3. Funding shall be allocated from various sources, including, but not limited to, the Miami Forever Bond as well as other local, state, and federal stimulus funding, if and when available. Section 4. The City Manager is authorized1 to advertise for, receive, review, reject, evaluate, award, negotiate, and execute contracts, including professional services agreements and construction contracts, for the projects identified in "Attachment A - 6/17/20 Revised Miami Recovery Initiative", attached and incorporated, all in a form acceptable to the City Attorney. Section 5. The City Manager is further authorized1 to negotiate and execute any and all other documents, including any agreements, amendments, and extensions, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the City Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations as may be deemed necessary for said purpose. Section 6.
