Director Department of Transportation and Public Works Miami -Dade County 701 NW 1st Court, Suite 1700 Miami, FL 33136 Modification to Zoned Street Right -of -Way Width of Northeast 1st Avenue between NE 5th Street and NE 6th Street and between NE loth Street and NE 12th Street Dear Mr. Santana and Ms. Bravo: On behalf of our client, 6 Plaza, LLC (the "Applicant"), owner of the property located at 530 NE 1st Avenue, Miami, Florida (Folio No. 01-0106-030-1012), we respectfully request that the City of Miami (the "City") amend Section 54-190 of the City Code of Ordinances to modify the zoned right-of-way width for the segment of Northeast 1st Avenue between NE 5th Street and NE 6th Street and between NE loth Street and NE 12th Street to 70 feet. The original zoned right of way width of NE 1st Avenue between NE 2nd Street and NE 14th Street was 70 feet. On September 12, 1985, the Miami City Commission adopted Ordinance No. 10031 designating a zoned right-of-way width of 95 feet for NE 1st Avenue between NE 5th Street to NE 12th Street. The purpose of Ordinance No. 10031 was to reserve additional property in anticipation of future widening as required by the recently adopted Southeast Overtown/Park West Redevelopment Plan. Since 1985, the Southeast Overtown/Park West Redevelopment Plan has been amended and no longer requires a 95-foot-wide right of way along this segment of NE 1st Avenue. Additionally, the zoned right of way width for the segments of NE 1st Avenue located between East Flagler Street and NE 5th Street; between NE 8th Street and NE 9th Street, and between NE 12th Street and NE 15th Street, were previously reduced to 70 feet.' Additionally, the portion of Northeast 1st Avenue between NE 5th Street and NE 6th Street includes the historically designated structure known as Central Baptist Church, a portion of which is located within the current zoned right of way of NE 1st Avenue, and which is currently undergoing a multimillion dollar restoration. These segments of NE 1st Avenue were never constructed to the full 95 foot width. However, the City Code has not been amended to reflect this reality. Amendment to NE 1st Avenue Zoned Right -of -Way Width March 25, 2020 development on either side of this portion of NE 1st Avenue effectively requires a 47.5 foot right- of-way dedication even though: (1) the Southeast Overtown/Park West Redevelopment Plan no longer contemplates the widening of NE 1st Avenue; (2) the zoned right of way width for other portions of NE 1st Avenue has been reduced to 70 feet; and (3) a segment of NE 1st Avenue cannot be widened because of the location of the historically designated Central Baptist Church. Based on the reasons summarized above, the Applicant has inquired about a proposed amendment to Section 54-190 of the City Code of Ordinances to modify the zoned right-of-way width for the segment of NE 1st Avenue between NE 5th Street and NE 6th Street. After these initial inquiries, the Client respectfully requests that the City amend Section 54-190 of the City Code of Ordinances to modify the zoned right-of-way width of the relevant segment of NE 1st Avenue to its original 70-foot width. This modification will permit the Applicant and other property owners along this segment of NE 1st Avenue to redevelop their properties in a coherent and pedestrian friendly manner which will contribute to the revitalization of the Urban Core. Toyos, the owner (the "Owner") of the property located on the corner of SW 10th Street and SW 28th Avenue identified by Miami -Dade Tax Folio No. 01-4109-019- 0360 (the "Property), we respectfully submit this request for an amendment to the City of Miami Code of Ordinances (the "Code"), Section 54-190 "Nonstandard street widths" to indicate that the base building line shall be located 19.25 feet from the centerline of SW 28th Avenue between SW 10th Street and SW 10th Terrace (the "Subject Portion of SW 28th Avenue"). Pursuant to Section 54-187, "public streets in the [C]ity not otherwise designated...shall be established at a minimum width of 50 feet, and the base building line shall be located 25 feet from the official centerline..." Since the Subject Portion of SW 28th Avenue, which abuts my client's Property, is not otherwise designated, the base building line for the Property at present is located 25 feet from the centerline. However, this width is impractical and overly burdensome as further explained below and a more appropriate width for the Subject Portion of SW 28th Avenue is 38.5 feet, with a base building line measurement from the centerline of 19.25 feet. As you can see from the relevant Municipal Atlas Sheet attached as Exhibit A, SW 28th Avenue terminates just south of SW 10th Terrace. The Municipal Atlas Sheet also indicates that a portion of SW 28th Avenue south of SW 10th Terrace has been declared an alley (the "Alley"), pursuant to Resolution No. 32081 and the existing structures along the Alley encroach into the zoned right-of-way. As indicated in the aerial and street photos attached as Exhibit B, the neighboring properties along the Subject Portion of SW 28th Avenue are similarly situated, and the location of those structures prevents, for all practical purposes, a continuous uniform dedication of 50 feet for SW 28th Avenue in the vicinity of the Property. Dodd December 27, 2019 Page 2 Aside from being impractical, the required dedication of the Owner's land for a right-of- way along the eastern portion of the subject property would impose a heavy burden on the Owner because it would amount to a loss of a large portion of his property in order to create a small strip of sidewalk leading to nowhere and a widened roadway which will likely never be able to be widened for the remainder of its length in the vicinity. The potential benefit here is outweighed by the burden on the Owner as well as surrounding property owners.
