A RESOLUTION OF THE MIAMI CITY COMMISSION DECLARING ZERO
TOLERANCE ON ANY TYPE OF VANDALISM OR DESTRUCTION OF ANY
PROPERTY; FURTHER DIRECTING THE CITY MANAGER TO IMPLEMENT AN
IMMEDIATE ACTION ENFORCEMENT PROGRAM, THROUGH THE APPROPRIATE
CITY OF MIAMI DEPARTMENTS, AGAINST PERSONS COMMITTING THESE ACTS
TO ENSURE SUCH CRIMINAL CONDUCT IS PROSECUTED AND PUNISHED TO
THE FULLEST EXTENT ALLOWED BY LAW, INCLUDING BUT NOT LIMITED TO,
IMMEDIATE ARRESTS AND THE IMPOSITION OF FINES AND RESTITUTION TO
DETER FURTHER UNLAWFUL CONDUCT.
WHEREAS, vandalism and destruction of property is an economic and environmental
crime against the City of Miami's ("City") community and its residents which needlessly absorbs
taxpayer dollars, creates blight, and attracts other forms of crime; and
WHEREAS, a recent wave of demonstrations in the City began occurring on or around
May 30, 2020; and
WHEREAS, some protestors have used the demonstrations occurring in the City as an
opportunity to engage in criminal activity, most notably vandalizing and destroying public and
private property; and
WHEREAS, state law imposes criminal penalties against persons that unlawfully
vandalize or destroy property; and
WHEREAS, the Miami City Commission finds and declares that there shall be zero
tolerance for any person engaged in the act of vandalizing or destroying any property in the
course of participating in a demonstration and directs the City's Administration to adopt a policy,
through the appropriate City Department(s), mandating any and all actions necessary to ensure
such conduct is prosecuted and punished to the fullest extent allowed by law which may include
a jail sentence, the imposition of fines, and obtaining a criminal order of restitution; and
WHEREAS, in accordance with Section 2-33(f) of the Code of the City of Miami, Florida,
as amended, the City Commission, by a majority vote, hereby deems this Resolution to be of an
emergency nature;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Miami City Commission hereby declares zero tolerance on any type of
vandalism or destruction of any property in the City and directs the City's Administration to
implement an immediate action enforcement program, through the appropriate City
Department(s), against persons committing these acts to ensure such criminal conduct is
prosecuted and punished to the fullest extent allowed by law including, but not limited to,
immediate arrests, imposition of fines, and restitution to deter such unlawful conduct.
Section 3. This Resolution shall become effective immediately upon its adoption.
