HomeMy WebLinkAboutR-20-0199City of Miami Resolution R-20-0199 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 7614 Final Action Date: 7/9/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR RON DESANTIS TO EXTEND EXECUTIVE ORDER 20-69 BEYOND THE 12:01 A.M., AUGUST 1, 2020 DEADLINE THROUGH AT LEAST SEPTEMBER 30, 2020; DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO THE OFFICIALS NAMED HEREIN. SPONSOR(S): Commissioner Ken Russell WHEREAS, on March 11, 2020, the World Health Organization declared the Coronavirus Disease 2019 ("COVID-19") a pandemic; and WHEREAS, the City of Miami ("City") declared a State of Local Emergency on March 12, 2020; and WHEREAS, pursuant to the State of Local Emergency, the City has taken all prudent actions necessary to protect the health, safety, and welfare of the community; and WHEREAS, the Center for Disease Control and Prevention ("CDC") has recommended, inter alia, social distancing standards for public gatherings and interaction; and WHEREAS, on March 20, 2020, Governor Ron DeSantis ("DeSantis") issued Executive Order 20-69 suspending any Florida Statute that requires a quorum to be present in person or requires a local government body to meet at a specific public place; and WHEREAS, on June 23, 2020, DeSantis issued Executive Order 20-150 extending Executive Order 20-69 until 12:01 a.m. on August 1, 2020; and WHEREAS, if DeSantis does not further extend Executive Order 20-69 beyond the 12:01 a.m., August 1, 2020 deadline, the City Commission will be required to physically meet at Miami City Hall or at such other public location allowed by law; and WHEREAS, an in -person City Commission meeting would increase the risk of the City's residents, elected officials, and City staff contracting COVID-19 due to the difficulty of adhering to CDC and social distancing guidelines in public locations; and WHEREAS, adults who are sixty-five (65) years of age or older are at increased risk for severe illness and death from COVID-19; and WHEREAS, approximately sixteen percent (16%) of the City's population is over the age of 65; and WHEREAS, people with underlying medical conditions are also at increased risk for severe illness and death from COVID-19; and City of Miami Page 1 of 2 File ID: 7614 (Revision:) Printed On: 5/5/2025 File ID: 7614 Enactment Number: R-20-0199 WHEREAS, there are over two hundred thousand (200,000) confirmed cases of COVID- 19 and over three thousand (3,000) COVID-19 related deaths in the State; and WHEREAS, there are over forty-eight thousand (48,000) confirmed cases of COVID-19 and over one thousand (1,000) COVID-19 related deaths in Miami -Dade County ("County"); and WHEREAS, over one hundred (100) City employees have tested positive for COVID-19; and WHEREAS, an extension of Executive Order 20-69 will assist the City, as well as all other local government bodies, to protect its residents, elected officials, and employees while continuing to conduct the public's business; and WHEREAS, it is prudent for the State and local governments to take all actions necessary to ensure the health, safety, and welfare of its residents, elected officials, and employees, especially those who are at greatest risk of severe illness and death from COVID- 19; and WHEREAS, in accordance with Section 2-33(f) of the Code of the City of Miami, Florida, as amended, the City Commission, by a majority vote, hereby deems this Resolution to be of an emergency nature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Commission hereby urges DeSantis to extend Executive Order 20- 69 beyond the 12:01 a.m., August 1, 2020 deadline through at least September 30, 2020. Section 3. The City Clerk is directed to transmit a certified copy of this Resolution to DeSantis, Lieutenant Governor Jeanette Nunez, County Mayor Carlos Gimenez, the Members of the County Board of County Commissioners, the Florida Association of Counties, the Florida League of Cities, and the Miami -Dade County League of Cities. Section 4. The Resolution shall become effective immediately upon its adoption.
