A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING AN INCREASE IN THE LIMIT ON THE HOME INVESTMENT
PARTNERSHIP PROGRAM ("HOME") ADMINISTRATION FUNDS FROM TEN
PERCENT (10%) OF THE ANNUAL ALLOCATION TO TWENTY-FIVE
PERCENT (25%) FOR FISCAL YEAR 2019-2020 TO REFLECT THE UNITED
STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT'S
GUIDANCE, ATTACHED AND INCORPORATED, WHICH PERMITS CERTAIN
STATUTORY SUSPENSIONS AND REGULATORY WAIVERS IN RESPONSE
TO THE NOVEL CORONAVIRUS PANDEMIC; FURTHER AUTHORIZING THE
CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY
DOCUMENTS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
FOR SAID PURPOSE.
WHEREAS, on July 11, 2019, pursuant to Resolution No. 19-0274, the Miami City
Commission approved the Home Investment Partnership Program ("HOME") funds allocation
for fiscal year 2019-2020 ("Fiscal Year") in the total amount of $3,297,681.00, which included an
amount of $329,768.00 for program administration; and
WHEREAS, on April 10, 2020, the United States Department of Housing and Urban
Development ("HUD") announced the availability of statutory suspensions and regulatory
waivers for the HOME program, which are intended to provide maximum administrative flexibility
to Participating Jurisdictions ("PJ") and to better assist low- and very low-income households as
they deal with the effects of the Novel Coronavirus ("COVID-19") pandemic; and
WHEREAS, the suspensions are also intended to relieve the PJ of the burden of
identifying other general funds to pay HOME administrative and planning costs at a time when
the State and local tax revenues, which provide general operating revenue, are decreasing; and
WHEREAS, on April 21, 2020, the City of Miami's ("City") Department of Housing and
Community Development sent HUD a written notification that it intends to implement the HOME
statutory suspensions and regulatory waivers, which includes increasing the limit of the
administrative expense funds from ten percent (10%) of the annual allocation to twenty-five
percent (25%) for the Fiscal Year; and
WHEREAS, the City's Administration recommends increasing the limit on the HOME
administration funds from ten percent (10%) of the annual allocation to twenty-five percent
(25%) for the Fiscal Year to reflect the statutory suspensions and regulatory waivers guidance
from HUD in support of the COVID-19 pandemic response;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission authorizes' the increase of the limit on the HOME
administration funds from ten percent (10%) of the annual allocation to twenty-five percent
(25%) for the Fiscal Year to reflect HUD's guidance, attached and incorporated as Exhibit "A",
which permits certain statutory suspensions and regulatory waivers in response to the COVID-
19 pandemic.
Section 3. The City Manager is authorized' to negotiate and execute any and all
necessary documents, all in a form acceptable to the City Attorney, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
