Background of Item: On July 11, 2019, pursuant to Resolution No. 19-0274, the Miami City Commission approved the Home funds allocation for fiscal year 2019-2020, in the total amount of $3,297,681.00, which included an amount of $329,768.00 for program administration. On April 10, 2020, HUD announced the availability of the statutory suspensions and regulatory waivers guidance of the HOME program. These suspensions and waivers are intended to provide maximum administrative flexibility to Participating Jurisdictions ("PJs") and better assist low -and very low income household as they deal with the effects of the Covid-19 pandemic. The suspension is also intended to relieve the PJ of the burden of identifying other general funds to pay HOME administrative and planning costs at a time when the State and local tax revenues that provide general operating revenue are decreasing. On April 21, 2020 the City of Miami, Department of Housing and Community Development ("HCD") sent HUD a written notification via email, its intent to implement the HOME statutory suspensions and regulatory waivers guidance, which included increasing the limit of the administrative expenses funds from 10 percent annual allocation to 25 percent for fiscal year 2019-2020; and The City Administration recommends increasing the limit on the Home Investment Partnership program ("HOME") administration funds from 10 percent annual allocation to 25 percent for fiscal year 2019-2020, to reflect the statutory suspensions and regulatory waivers guidance from Department of Housing and Urban Development ("HUD"), in support of the Covid-19 pandemic response. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission authorizes the increase of the limit on the HOME administration funds from ten percent (10%) of the annual allocation to twenty-five percent (25%) for the Fiscal Year to reflect HUD's guidance, attached and incorporated as Exhibit "A", which permits certain statutory suspensions and regulatory waivers in response to the COVID- 19 pandemic. Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, all in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, City Attor ey ) 6/16/2020 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
