Authorizing the City Manager to negotiate and execute all other documents, including any amendments, renewals, and extensions, subject to allocations, appropriations and budgetary approval having been previously made, and in compliance with applicable provisions of the Code of the City of Miami, Florida, as amended, ("City Code"), including, the City of Miami's Procurement Ordinance, Anti -deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Background of Item: The City has a need for maintenance and repair of its emergency generators, on an as needed basis. On December 2, 2019, the Department of Procurement ("Procurement"), issued IFB No. 1132383, Maintenance and Repairs of Emergency Generators. As required by the Procurement Code, the IFB was advertised and issued online. On January 7, 2020, at the bid closing, two (2) bids were received. The bids were evaluated and tabulated following the guidelines published in the bid. An award was recommended and protested. As a result of the protest the City conducted additional due diligence and the originally awarded Bidder was deemed non -responsive. The original award recommendation was rescinded and the Bidders were notified. Procurement is recommending award to KW Power, which met all requirements, per the bid specifications, and is the lowest responsive and responsible Bidder. The estimated contract amount is $75,655.00 annually (approximately $529,585.00 for all seven (7) years). WHEREAS, the City of Miami ("City") has a need for the maintenance and repairs of its emergency generators; and WHEREAS, on December 2, 2019, the City's Department of Procurement ("Procurement") issued Invitation for Bid ("IFB") No. 1132383 to establish a contract for the maintenance and repairs of emergency generators on an as needed basis for an initial term of three (3) years with the option to renew for two (2) additional two (2) year periods; and WHEREAS, on January 7, 2020, pursuant to IFB No. 1132383, Procurement received a bid from the lowest responsive and responsible bidder, KW Power Systems Corp., a Florida profit corporation ("KW Power"); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The bid received January 7, 2020 pursuant to IFB No. 1132383 for maintenance and repairs of emergency generators, on an as needed basis from the lowest responsive and responsible bidder, KW Power, for an initial term of three (3) years with the option to renew for two (2) additional two (2) year periods is accepted. Section 3. Funds are allocated from various sources of funds and agencies, subject to the availability of funds and budgetary approval at the time of need. Section 4. The City Manager is authorized to negotiate and execute any and all other documents, including any amendments, renewals, and extensions, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the Code of the City of Miami, Florida, as amended ("City Code"), including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations as may be deemed necessary for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption.
